A. That certain document designated as the International Building Code,
2012 Edition, as published by the International Code Council herein
referred to as "the code," a copy of which is on file in the office
of the City Clerk, is hereby adopted as the Building Code for the
City of Charleston, Missouri, for regulating and governing the construction,
maintenance, and conditions of all property, buildings, and structures
within the City as herein provided; and each and all of the regulations,
provisions, penalties, conditions, and terms of the 2012 International
Building Code are hereby referred to, adopted, and made a part hereof
as if fully set out herein with the following exceptions and changes:
1.
Section 101.1 (Title) of the code is hereby amended to insert
the City of Charleston, Missouri, as the adopting entity.
2.
Section 113.3 (Qualifications) of the code is hereby amended
to read: "The Board of Appeals shall consist of five members appointed
by the City Council."
3.
Section 903.2.8, Group R, of the code shall be amended to read:
"Automatic sprinkler systems shall be required in Use Group R-2 areas
of dwellings, where more than two stories in height and more than
eight dwelling units per building exist. Automatic sprinkler systems
shall not be required in buildings of Use Group R-3."
B. The following Sections of the code are also specifically adopted:
1.
Appendix B (Board of Appeals) is adopted with the amendment indicated in Subsection
(A)(2) above.
2.
Appendix I (Patio Covers) is adopted.

A. That certain document designated as the National Electrical Code,
2011 Edition, (herein referred to as "the code") as published by the
International Code Council, a copy of which is on file in the office
of the City Clerk, is hereby adopted as the Electric Code for the
City of Charleston, Missouri, for the control of all buildings and
structures as herein provided; and each and all of the regulations,
provisions, terms, conditions, and penalties of the 2011 National
Electrical Code are hereby referred to, adopted, and made a part hereof,
as if fully set out in this Section with the following exceptions
and changes:
1.
In Article 90 (Introduction), page 22, insert:
Powers and Duties: The electrical inspector shall
have control of the construction, installation, erection, extension,
alteration, or change of any electrical apparatus, machine, appliance,
device, fixture, attachment, wire, or wiring on or within any building
or structure and for special lighting for power or heat in connection
therewith. The electrical inspector shall have the right, during all
reasonable hours, to enter any building or structure, in the discharge
of his/her official duties or for the purpose of making an inspection
or test of the installation or alteration of electrical wiring or
devices contained therein and shall have the authority to cause the
termination of all electrical currents and wiring where a danger to
life or property is believed to exist. No person shall interfere with
the electrical inspector in the performance of his/her duties nor
shall any person refuse to comply with any lawful order or requirement
of said inspector.
2.
In Article 90 (Introduction), page 22, insert:
Permits Required: No alteration or addition shall
be made in the existing wiring of any building or structure nor shall
new electrical service of any kind be installed without first securing
a permit for said work from the City of Charleston.
3.
In Article 90 (Introduction), page 22, insert:
Inspections: Upon the completion of any installation,
alteration, or expansion of electrical service in any building or
structure, it shall be the duty of the person conducting said work
to notify the electrical inspector who shall conduct his/her inspection
within twenty-four hours. The work to be inspected is not to be covered
with drywall or any other materials until the inspection is completed.
4.
Delete Article 230-70 (a), Location (page 84) in its entirety
and insert: "The service disconnecting means shall be installed at
a readily accessible location inside a building or structure nearest
the point of entrance of the service conductors but shall not be installed
in bathrooms, closets, or attics."

City of Charleston, Missouri, for the control of all buildings and
structures as herein provided; and each and all of the regulations,
provisions, terms, conditions, and penalties of the 2012 International
Plumbing Code are hereby referred to, adopted, and made a part hereof,
as if fully set out in this Section with the following exceptions
and changes:
1.
Section 101.1 (Title) of the code is hereby amended to insert
the City of Charleston, Missouri, as the adopting entity.

Code, 2012 Edition, (herein referred to as "the code") as published
by the International Code Council, a copy of which is on file in the
office of the City Clerk, is hereby adopted as the Mechanical Code
for the City of Charleston, Missouri, for the control of all buildings
and structures as herein provided; and each and all of the regulations,
provisions, terms, conditions, made a part hereof, as if fully set
out in this Section with the following exceptions and changes:
1.
Section 101.1 (Title) of the code is hereby amended to insert
the City of Charleston, Missouri, as the adopting entity.

Code, 2012 Edition, (herein referred to as "the code") as published
by the International Code Council, a copy of which is on file in the
office of the City Clerk, is hereby adopted as the Property Maintenance
Code for the City of Charleston, Missouri, for the control of all
buildings and structures as herein provided; and each and all of the
regulations, provisions, terms, conditions, and penalties of the 2012
International Property Maintenance Code are hereby referred to, adopted,
and made a part hereof, as if fully set out in this Section with the
following exceptions and changes:
1.
Section 101.1 (Title) of the code is hereby amended to insert
the City of Charleston, Missouri, as the adopting entity.
B. No language contained in the Property Maintenance Code, 2012 Edition, shall overrule or make inapplicable those provisions currently contained in Chapter
505 of the Charleston Municipal Code, and any conflict of language or provisions shall be ruled by the language and provisions of Chapter
505 of the Charleston Municipal Code.

A. That certain document designated as the International Residential
Code for One- and Two-Family Dwellings, 2012 Edition, (herein referred
to as "the code") as published by the International Code Council,
a copy of which is on file in the office of the City Clerk, is hereby
adopted as the Residential Code for the City of Charleston, Missouri,
for regulating and governing the construction, alteration, movement,
enlargement, replacement, repair, equipment, location, removal and
demolition of detached one- and two-family dwellings and multiple
single-family dwellings (town houses) not more than three (3) stories
in height with separate means of egress as herein provided, providing
for the issuance of permits and collection of fees and penalties therefor
are hereby referred to, adopted, and made a part hereof, as if fully
set out in this Section with the following exceptions and changes:
1.
Section 101.1 (Title) of the code is hereby amended to insert
the City of Charleston, Missouri, as the adopting entity.
2.
Section R112.3 (Qualifications) of the code is hereby amended
to read: "The Board of Appeals shall consist of five members appointed
by the City Council."
3.
Section 309.5 (Fire sprinklers) is deleted in its entirety and,
instead, the following language is inserted: "A one-hour fire-rated
separation between the dwelling and any attached garage is required."
4.
Section R313 (Automatic Fire Sprinklers) is deleted.
5.
Section R403.2 (Footings for wood foundations) is deleted, and
the following wording is inserted. "Wood foundations and foundation
walls are prohibited."
6.
Section R404.2 (Wood foundation walls) is deleted, and the following
wording is inserted: "Wood foundations and foundation walls are prohibited."
B. The following Sections of the code are also specifically adopted:
1.
Appendix B (Board of Appeals) is adopted with the amendment indicated in Subsection
(A)(2) herein.
2.
Appendix H (Patio Covers) is adopted.
3.
Appendix M (Home Day Care) is adopted.
4.
Appendix P (Sizing of Water Piping Systems) is adopted.

A. That certain document designated as the International Fuel Gas Code,
2012 Edition, (herein referred to as "the code") as published by the
International Code Council, a copy of which is on file in the office
of the City Clerk, is hereby adopted as the Fuel Gas Code for the
City of Charleston, Missouri, for the control of all buildings and
structures as herein provided; and each and all of the regulations,
provisions, terms, conditions, and penalties of the 2012 International
Fuel Gas Code are hereby referred to, adopted, and made a part hereof,
as if fully set out in this Section with the following exceptions
and changes:
1.
Section 101.1 (Title) of the code is hereby amended to insert
the City of Charleston, Missouri, as the adopting entity.
2.
In Section 303.3 (Prohibited locations), delete exceptions 3
and 4 entirely and insert the following language: "No unvented room
heater or fireplace logs shall be allowed in sleeping rooms, bathrooms,
toilet rooms, storage closets, or surgical rooms."
3.
In Section 404 (Piping System Installation), insert the following
language: "Only rigid steel piping shall be used to penetrate floors,
walls, or ceilings. Appliances shall be connected to the building
service line by a steel flex connector not exceeding six (6) feet
in length and accompanied by an approved shutoff valve on the upstream
side of the flex connector. At no time shall the flex connector pass
through a floor, ceiling, or wall."

Any person who violates the provisions of this Article or any
code adopted pursuant to this Article, upon conviction, shall be deemed
guilty of an ordinance violation punishable by a fine of not less
than one dollar ($1.00) nor more than five hundred dollars ($500.00)
or imprisonment not exceeding ninety (90) days, or both such fine
and imprisonment. Each day that any such violation exists shall be
deemed a separate violation hereunder.
