A. In order to discharge the duties imposed
by this Chapter and to enforce its provisions, the Animal Control
Officer or any Police Officer is empowered to enter upon any premises
upon which a dog or cat is being harbored and to demand the owner
to produce the vaccination certificate for such dog or cat. The Animal
Control Officer may also enter the premises where any animal is kept
in a reportedly cruel or inhumane manner and demand to examine the
animal and to take possession thereof, if, in his/her opinion, it
should be removed from the premises.
B. For the enforcement of this Chapter and
the discharge of his/her duties, the Animal Control Officer is hereby
authorized to enter upon any premises when in pursuit of an animal
for the purpose of ascertaining its ownership and/or impounding it.

A. There is hereby established a City Animal
Shelter, wherein all animals found running at large within the corporate
limits of the City shall be restrained until disposed of in the manner
set forth in this Chapter. The location of the shelter may be changed
from time to time by resolution of the City Council at any meeting
thereof. The Animal Control Officer shall be the keeper of the shelter.
B. It shall be unlawful for any person to
willfully turn out of, or take from, or cause to escape from the City
Animal Shelter, any animal placed therein by the Animal Control Officer.

The provisions of this Chapter shall
be enforced by an Animal Control Officer, who shall be under the supervision
of the Chief of Police.

There is hereby created the office
of Animal Control Officer for the City and he/she shall report to
the Chief of Police.

A. The Animal Control Officer shall be in
good physical condition and the possessor of a current valid State
operator's license.
B. Vacancies in this position shall be filled
in accordance with the provisions of the City's personnel manual.

A. It shall be the duty of the Animal Control
Officer to:
1.
Police the City for violations of
this Chapter;
2.
Maintain the City Animal Shelter
in a sanitary condition;
3.
Care and feed the animals contained
therein;
4.
Dispose of animals as provided by
the regulations and in conformance with ASPCA standards and regulations;
and
5.
Keep a general listing of the species
of all animals impounded as well as the place the animal was seized
and the date of impoundment.

In addition to the duties set out
in this Code, the Animal Control Officer shall, under the supervision
and control of the Chief of Police, perform other duties as assigned
by the Chief of Police.

A. The Animal Control Officer shall submit
a weekly record of his/her journal to the Chief of Police, a copy
of which said weekly record is to be delivered by the Chief of Police
to the City Council.
B. It shall be the duty of the Animal Control
Officer to keep, or cause to be kept accurate and detailed records
of impoundments and disposition of all animals coming into his/her
custody.
C. It shall be the duty of the Animal Control
Officer to keep, or cause to be kept accurate and detailed records
of all bite cases reported to him/her, and his/her investigation of
all such bite cases.
D. It shall be the duty of the Animal Control
Officer to keep, or cause to be kept accurate and detailed records
of all money belonging to the City, which records shall be open to
inspection at reasonable times by such persons responsible for similar
records of the City and shall be audited by the City annually in the
same manner as other City records are audited.

No person shall interfere with, hinder,
or molest the Animal Control Officer in the performance of his/her
duty, or seek to release any animal in the custody of the Animal Control
Officer, except as provided in this Chapter.
