A. All so-called "garage sales" or "yard sales"
or other sales involving the offering for sale of multiple items of
personal property on property zoned or occupied as a residence shall
be subject to the following rules and regulations:
1.
No one shall accept or take in for
sale, any goods from any commercial business or enterprise on a consignment
basis.
2.
No signs shall be posted in the City
of Park Hills advertising such sales, except that the property owner
may install on the residential lot on which such sale is to be held
one (1) sign not larger than two (2) feet by three (3) feet advertising
such sale, and one (1) sign not larger than two (2) feet by three
(3) feet on private property other than the residential lot on which
such sale is to be held (with permission of the property owner). Such
signs shall be erected not sooner than one (1) day prior to the date
of the sale, and shall be removed at the end of the last day upon
which the sale is held.
3.
No more than three (3) such sales
per annum shall be held at the premises if occupied by the same family
or any member of such family.
4.
Any sale conducted pursuant to the
provisions hereof shall be confined to the period between 6:30 A.M.
and 6:00 P.M. of any day and shall not extend in excess of three (3)
consecutive days not to include Sunday.
5.
Any sale conducted pursuant to the
provisions hereof must be held at the residence of the applicant.
B. Definition. As used in this Article the
following term shall have these prescribed meanings:
GARAGE SALES
A sale of goods for profit offered to the public conducted
at a single-family, a dual family, or multi-family residential dwelling
place; provided, however, that for purposes of this Chapter "garage
sale" shall not include a sale of goods by auction; i.e., public sale
of goods by competitive bidding, to the highest and best bidder.

Any person conducting a garage sale
or other sale involving the offering for sale of multiple items of
personal property on property zoned and occupied as a residence shall
be required to obtain a permit therefor from the City. Applications
for such permit shall be made to the City Clerk in such form as may
be required by the City and shall be accompanied by a permit fee in
the amount of one dollar ($1.00) per day. The permit shall be displayed
in public view for duration of sale.

Any person violating any of the provisions
of this Article shall be deemed guilty of an ordinance violation and
upon conviction thereof, shall be fined a sum not to exceed five hundred
dollars ($500.00). Each day during which any violation of this Article
continues or exists shall be deemed to be a separate violation.

The provisions of this Article shall
not apply to or affect persons selling goods pursuant to an order
of process of a Court of competent jurisdiction or persons acting
in accordance with their powers and duties as public officials.

A. Sidewalk
sales of regularly merchandised retail stock are hereby permitted
to be displayed and sold on the sidewalk in front of licensed businesses
in the City of Park Hills, Missouri.
B. Sidewalk
displays may only be displayed in the downtown Monday through Saturday
from 8:00 A.M. to 5:00 P.M. and shall not occupy more than one-half
(1/2) of the sidewalk from the edge of the retail building to the
center of the sidewalk.
C. Items for sale displayed on the outside
of a business building shall be situated in a manner to ensure that
they are on private property. Placement of items shall not impede
or encumber any public sidewalk, right-of-way, or parking area. Items
must not interfere with ingress, egress, or any such passage as would
normally be utilized by the public, including accessibility features.
Items shall only be on display during normal business hours unless
hours of operation are continual. If the business gross receipts total
more than two hundred fifty thousand dollars ($250,000.00), then items
shall be allowed to remain on display on the exterior of the business.
D. This Section shall not apply to any items
too large to be in the business building. This exemption shall apply,
but not be limited to, automobiles, trucks, lumber yards (but they
shall be fenced), tractors and large accessory equipment, motorcycles,
and recreational vehicles.
E. Displayed items shall be arranged in an
organized manner.
F. Items displayed must not be subject to
deterioration.

No person shall repair any motor
vehicles or permit any work upon any such vehicle in the streets or
upon the sidewalks of the City in front of or in the vicinity of his/her
garage, repair shop, or home.
