§ 127-8 Fees for building zoning and other permits.

A. "CV" equals "construction value." Construction values will be determined by the Building Code Official and shall be based on the most recent edition of "Building Valuation Data" as published by the International Code Council in the Building Safety Journal.

B. All permit fees are nonrefundable.

C. A Pennsylvania Department of Labor and Industry fee of $4 is required for each construction or building permit.

D. All application fees are payable when application is made.

E. The hourly inspection rate for the Township's Building Code Official and Township Engineer are adopted by resolution of the Board of Supervisors annually and are on file at the Township offices.

F. Fees.

(1) Building: agricultural zoning permit.

(a) Application fee: $200 (flat fee).

(b) Permit fee: $2/$1,000 CV.

(2) Building: commercial permit.

(a) New construction/additions:

[1] Application fee: $250 (flat fee).

[2] Plan review fee: minimum, $250. See calculation in Subsection F(30).

[3] Permit fee: $10/$1,000 CV.

(b) Alterations/tenant fit out:

[1] Application/permit fee: $150 (flat fee).

[2] Plan review fee (base: 1.5 hours): $100.

[3] Additional review at BCO rate: $110 hour.

[4] Permit fee: $10/$1,000 CV.

(3) Building: residential permit.

(a) New construction/additions/modular buildings:

[1] Application fee: $150 (flat fee).

[2] Plan review fee: minimum, $250. See calculation in Subsection F(30).

[3] Permit Fee (adjusted): $6/$1,000 CV.

(b) Alterations:

[1] Application fee: $150 (flat fee).

[2] Plan review fee: minimum, $250. See calculation in Subsection F(30).

[3] Permit fee (adjusted): $6/$1,000 CV.

(4) Mechanical: commercial permit.

(a) New construction:

[1] Application fee: $75 (flat fee).

[2] Plan review fee: minimum, $250. See calculation in Subsection F(30).

[3] Permit fee (adjusted): $10/$1,000 CV; $250 minimum.

(5) Mechanical: residential permit.

(a) New construction (includes outdoor wood furnaces):

[1] Application fee: $75 (flat fee).

[3] Permit fee (adjusted): $10/$1,000 CV; $150 minimum.

(b) Conversion of HVAC system:

[1] Application fee: $35 (flat fee).

[2] Plan review (if required): $100 (flat fee).

[3] Permit fee: $225.

(c) Appliance replacement: HVAC or hot water heater (one appliance; no ductwork involved):

[1] Application/permit fee: $125 (flat fee).

(6) Electrical: commercial permit.

(a) New construction (includes emergency generators):

[1] Application fee: $75 (flat fee).

[2] Plan review fee: $250, minimum. See calculation in Subsection F(30).

[3] Permit fee (adjusted): $10/$1,000 CV; $250 minimum.

(7) Electrical: residential permit.

(a) New construction:

[1] Application fee: $75 (flat fee).

[3] Permit fee (adjusted): $10/$1,000 CV; $150 minimum.

(b) Service upgrade or replacement (service/wiring/panel board):

[1] Application fee: $35 (flat fee).

[2] Permit fee: $225.

(c) Extend wiring system (detached garage or shed):

[1] Application/permit fee: $100 (flat fee).

(d) Finished basements or additions: $225 (flat fee).

(e) Emergency generator installations:

[1] Permit fee: $225 (flat fee).

[2] Install generator transfer switch: $100 (flat fee).

(8) Plumbing: commercial permit.

(a) New Construction:

[1] Application fee: $75 (flat fee).

[2] Plan review fee: see calculation in Subsection F(30).

[3] Permit fee (adjusted): $10/$1,000 CV; $250 minimum.

(9) Plumbing: residential permit.

(a) New construction:

[1] Application fee: $75 (flat fee).

[2] Plan review fee: See calculation in Subsection F(30).

[3] Permit fee (adjusted): $10/$1,000 CV; $150 minimum.

(b) System replacement or extension (water service/DWV):

[1] Application fee: $35 (flat fee).

[2] Permit fee: $225.

(c) Fixture relocation (one fixture, supply piping, drain and vent):

[1] Application/permit fee: $80 (flat fee).

(d) Water/sewer service line replacement:

[1] Application/permit fee: $150 (flat fee).

(e) Water/sewer service line repair:

[1] Application/permit fee: $75 (flat fee).

(f) Tap-in Fee to existing public sewer service line: refer to East Brandywine Township Municipal Authority fee schedule.

[Note: road opening permit fees may apply to plumbing permits. See Subsection F(41).]

(10) Fire protection permits.

(a) Sprinkler, commercial permit: $750; includes 1-1/2 hours of plan review (must meet base requirements); additional required review at $110/hour.

(b) Fire Alarm (detection), commercial permit: $750; includes 1-1/2 hours of plan review (must meet base requirements); additional required review at $110/hour.

(c) Sprinkler, residential permit: $400; includes 1-1/2 hours of plan review (must meet base requirements); additional required review at $110/hour.

(d) Fire inspections, Commercial Buildings: Hotels, Motels, Assembly, Institutional, Business, Factory, Industrial High-Hazard, Mercantile, Storage, Utility and any miscellaneous or similar buildings. Fire Inspections required shall be charged at the Building Code Official's current hourly rate.

(11) Blasting/fireworks permit: $35 application fee, plus reimbursement of the Building Code Official's hourly rate for all time spent reviewing plans, location of blasting/display, insurance certificates and specifications for the protection of the public/public display of fireworks pursuant to the Township Fire Code. All fees shall be paid prior to the issuance of the permit.

(a) Fireworks display permit fee: $125 (+ T & M).

(b) Blasting permit fee: $75 (+ T & M).

(12) Alternate energy permits.

(a) Solar panels or arrays, windmills: $225; includes one hour of plan review (must meet base requirements); additional required review at $72/hour.

(b) Wood stove and pellet stove installations: $75.

(13) Decks: residential permit; includes one hour of plan review (must meet base requirements); additional required review at $72/hour.

(a) Decks (with U & O fee): $350.

(b) Decks with roof/pergola (with U & O fee): $425.

(c) Decks with screened-in porch (with U & O fee): $425.

(d) Deck repairs, replacing decking/flooring, handrails or adding/changing stairs: $207 (flat fee).

(14) Pool permits.

(a) Aboveground swimming pool, hot tub, spa:

[1] Application fee: $50 (flat fee).

[2] Permit fee: $150 (flat fee).

(b) In-ground swimming pool:

[1] Application fee: $50 (flat fee).

[2] Plan review fee: $250 minimum. See calculation in Subsection F(30).

[3] Permit fee: $5/$1,000 CV; $150 minimum.

(c) Extend wiring system:

[1] Application/permit fee: $80 (flat fee).

(15) Manufactured housing permit: $250 (flat fee).

(16) Demolition permits.

(a) Residential dwelling (on-site utilities): $80 (flat fee).

(b) Residential dwelling (public utilities): $175 (flat fee).

(c) Accessory structures: $25 (flat fee).

(d) In-ground swimming pools: $75 (flat fee).

(e) Commercial structures: $350 (flat fee).

(17) Demolition of historic resource permits (Class I or Class II).

(a) Application fee: $600 (flat fee).

(b) Consultant fees: (T & M).

(18) Roofing permits.

(a) Commercial roofing alterations: $10/$1,000 CV (flat fee).

(b) Residential roofing alterations: $150 (flat fee).

(19) Retaining walls.

(a) Application fee: $250 (flat fee).

(b) Plan review fee: See calculation in Subsection F(30).

(c) Permit fee: $10/$1,000 CV.

(20) Accessory structures.

(a) Garden sheds (maximum of 250 square feet): $50 (flat fee); zoning permit application required.

(b) Detached garages or post-frame (Pole) Buildings:

[1] Up to 250 square feet: $50 (flat fee)

[2] Over 250 square feet (footings and foundations required; building permit application required:

[a] Application fee: $100 (flat fee)

[b] Permit fee: $2/$1,000 CV; $80 minimum.

(21) Sign permit (includes temporary signs):

(a) Up to 25 square feet: $50 (flat fee)

(b) Over 25 square feet: $100 (flat fee)

(c) Banners (up to 100 square feet): $125 (flat fee)

(d) Billboards:

[1] Application fee: $100 (flat fee)

[3] Permit fee (adjusted): $10/$1,000 CV; $150 minimum.

(22) Tennis/basketball court permit: $125 (flat fee); stormwater management permit review required.

(23) Logging permit: $300 (flat fee)

(24) Fences (height from ground is six feet or higher): $75 (flat fee)

(25) Reinspections (ALL): $80 (flat fee)

[NOTE: any time the inspector returns to inspect unfinished work or previously failed inspections, or additional inspections are required, this charge applies. Minimum of one hour will be charged unless otherwise agreed upon in writing by the Township. Payable before reinspection will be scheduled.]

(26) Work begun without permit: Permit fees are doubled.

[NOTE: Any inspection which results in a determination by the Township Building Code Official that any work requiring permits was performed without first securing the necessary permits will be surcharged 100% of the cost of the permit, plus enforcement costs. The surcharge penalty will be in addition to the required permit fees.]

(27) Certificate of occupancy.

(a) Commercial/industrial: $125.

(b) Residential: $75.

(28) Zoning permits.

(a) Zoning permit: $75 (flat fee).

(b) No-impact home occupation: $25 (flat fee).

(c) Major home occupation: $125 (flat fee)

(29) Zoning determination letter: The Township will charge the hourly rate of the Zoning Officer for all time spent researching and preparing a zoning determination letter requested by a property owner. All fees must be paid prior to the issuance of the letter.

(30) Plan review. The Plan Review fee is based on the construction value (CV), as determined above.

(a) CV up to $3,000,000: fee equals 0.0006 x CV ($250 minimum).

(b) CV over $3,000,000 to $6,000,000: fee equals $3,600 + (0.0005 x CV).

(c) CV over $6,000,000: fee equals $5,100 + (0.00035 x CV).

[NOTE: Municipal Engineer or other consultant fees may apply, at their current hourly rate.]

(31) Administrative fee: $40 (per hour or portion thereof).

(32) Township Manager or Roadmaster fee: $65 (per hour or portion thereof).

(33) Township or Municipal Authority Engineer, Township or Municipal Authority Solicitor and other consultants: Hourly rate charged to Township will be billed to the applicant.

(34) Stormwater management.

(a) Act 167 stormwater management/impervious surface reviews.

[1] Application and Code review fee: $100. All applications creating new impervious surfaces must pay this fee.

(b) Stormwater management plan reviews.

[1] Engineer review escrow fee: $1,000.

[2] Construction escrow review fee (refundable): $2,500. (Must be issued as a separate check. Fee is released upon written request by the property owner or contractor once construction of the stormwater facility has been completed and approved by the Township.)

[3] Operation and maintenance fee: $250. (a permanent fee, retained to assure maintenance of the stormwater management facility by the property owner).

[Note: fees applicable under Ordinance 01 of 2014, Act 167 Stormwater Management.]

(35) Soil and Erosion control or grading plan reviews: $200 base permit fee, plus reimbursement of Engineer's review costs for grading involving movement of 5,000 square feet of earth disturbance or greater, or for any change in a drainage pattern.

(36) Roadside stands/tent sales: $50 (flat fee). Permit must be displayed. Permit is limited to a maximum three-month term.

(37) Fuel storage tanks and related facilities.

(a) For each 1,000 gallons of storage capacity or portion thereof:

[1] Each fuel storage tank: $30 (per 1,000 gallons).

[2] Each fueling station: $50 (flat fee).

(38) Temporary construction trailers or buildings: $250 per year/building.

(39) Highway occupancy permit: PennDOT application only.

(40) Township driveway permit: $80 (flat fee)

(41) Road opening permit (Township-owned roadways):

(a) Openings not larger than 16 square feet: $100 (flat fee).

(b) For each additional 16 square feet of opening or portion thereof: $25.

(42) Permit extension requests.

(a) Residential permits: $50 (flat fee).

(b) Commercial permits: $100 (flat fee).

§ 127-9 Designation of municipal code official to administer Building Code.

Pursuant to Section 3 of Ordinance 04-02,[1] the East Brandywine Township Board of Supervisors hereby appoints the Building and Zoning Officer of East Brandywine Township to serve as the municipal code official, defined as an individual certified by the Department of Labor and Industry under Act 45 of 1999 to perform plan reviews of construction documents, inspect construction, or administer and enforce codes and regulations under the East Brandywine Township Building Code of 2004. The municipal code official shall serve at the pleasure of the Board of Supervisors.
