It shall be the responsibility of each dog owner or person having possession, custody or control of a dog to remove any feces left by such dog on any sidewalk, gutter, street, public area, or privately owned property (other than the property of the dog owner) within the Village of Chatham.
Every person, while walking a dog along a public street, sidewalk or public place in the Village of Chatham, shall carry a device, commonly known as a "pooper scooper," or such other implement or material, to be utilized for the purpose of removing the feces and safely disposing of it in a sanitary manner.
A. 
Any violation of this article shall constitute a violation punishable by a fine of $25 for the first offense, a fine of $50 for the second offense occurring within one year of the date of the first offense, and a fine of $75 for a third and any subsequent offense occurring within one year of the date of the first offense.
B. 
This article may be enforced by The Village of Chatham Police Department Community Service Officer, the Animal Control Officer (if any) of the Village of Chatham, or any other individual specifically authorized by the Board of Trustees of the Village of Chatham.
