The driver of any vehicle other than one on official business
shall not follow any fire apparatus traveling in response to a fire
alarm closer than five hundred (500) feet or drive into or park such
vehicle within the block where fire apparatus has stopped in answer
to a fire alarm.
No vehicle shall be driven over any unprotected hose of a Fire
Department when laid down on any street or private driveway to be
used at any fire or alarm of fire without the consent of the Fire
Department official in command.
Each driver in a funeral or other procession shall drive as
near to the right-hand edge of the roadway as practicable and shall
follow the vehicle ahead as close as is practicable and safe.
No funeral, procession or parade containing two hundred (200)
or more persons or fifty (50) or more vehicles except the forces of
the United States Army or Navy, the military forces of this State,
and the forces of the Police and Fire Departments shall occupy, march
or proceed along any street except in accordance with a permit issued
by the Chief of Police and such other regulations as are set forth
herein which may apply.

A. Definitions. For purposes of this Section, the following
terms shall mean the following:
PARADE
A coordinated movement of seven (7) or more pedestrians or
vehicles upon the streets within the City, except funeral processions,
with an intent of attracting public attention that interferes with,
or can reasonably be expected to have a tendency to interfere with,
the normal flow of traffic upon the street.
PUBLIC ASSEMBLY
A gathering outside a structure of more than eight (8) persons
for a common purpose at a public place that continues in existence
for more than thirty (30) minutes.
WEAPON
Any pistol, rifle, shotgun or other firearm of any kind,
whether loaded or unloaded, air rifle, air pistol, paintball gun,
paintball rifle, explosive, blasting cap(s), knife, hatchet, ax, slingshot,
slung shot, blackjack, metal knuckles, mace, iron buckle, ax handle,
chains, crowbar, hammer, shovel or any club or bludgeon or any other
instrumentality used or intended for use as a dangerous weapon.
B. Permit Required For Parades And Processions.
1. No procession or parade shall occupy, march or proceed along any
public street, roadway or public property except in accordance with
a permit issued by the Chief of Police and with such other applicable
regulations as are set forth in this Code. The Chief of Police or
his designee are hereby authorized to issue such permits. Processions
or parades conducted by the City of Rogersville are not required to
have a permit under this Section.
2. The written application for such permit shall be filed with the Chief
of Police on a form provided by the City, such form to be filed two
(2) weeks in advance of the proposed parade or procession to allow
adequate arrangements to be made for the proper policing of the same.
The application shall contain the following:
a. The name of the applicant, the sponsoring organization, the parade
or procession chairman and the addresses and telephone numbers of
each.
b. The purpose of the parade or procession, the date when it is proposed
to be conducted, the location of the assembly area, requested route
to be traveled (if different from the route designated by the City)
and the approximate time when the parade, procession or motorcade
will assemble, start and terminate.
c. A description of the individual floats, marching units, vehicles,
bands, if any, including a description of any sound amplification
equipment to be used.
d. Such other information as the Chief of Police may deem reasonably
necessary.
3. Such permits shall set forth conditions reasonably necessary for
the protection of the rights, property and personal safety of all
parties. Failure to substantially fulfill the conditions set forth
in such permit shall render such permit null and void.
4. Upon issuance of such permit, the Police Department shall provide
Police services adjacent to the permit area to regulate vehicular
and pedestrian traffic, conditioned upon the availability of a sufficient
contingent of on-duty personnel to provide such services without diminishing
routine service levels to the entire community.
5. All parades shall follow a route to be traveled as established by
the Chief of Police or his designee unless the applicant requests
a unique route and such request is approved by the Chief of Police
or his designee and set forth in the permit.
6. If necessary Police services are unavailable on the specified date
of the procession or parade, the applicant must provide sufficient
funds to compensate the Police Department for hiring the extra amount
of Police services that are needed to regulate vehicular and pedestrian
traffic or change the location of the assembly area and route to be
traveled based completely upon a set plan that the Chief of Police
establishes.
7. By applying for and being granted such permit, the applicant shall
assume all civil liability arising from conditions, restrictions or
omissions on the face of the permit.
8. Payment of a non-refundable fee of ten dollars ($10.00) for the administrative
costs involved in the processing of the herein parade or processions
permit application shall accompany the filing of the permit application
and shall remain in the general revenues of the City without regard
to the final action taken by the Police Chief or his designee.
9. Conducting a procession or parade without a permit shall be an act
in violation of this Section and any person or group found in violation
will be subject to a fine of one hundred fifty dollars ($150.00).
C. Parade And Assembly Prohibitions. The following prohibitions
shall apply to all parades and public assemblies:
1. It shall be unlawful for any person at any parade or public assembly
to carry or possess any weapon as defined above.
2. It shall be unlawful for any person at any parade or public assembly
to carry or possess any object that is intended to be used for the
harm of any other person or property, private or public.
The driver of a vehicle shall not drive within any sidewalk
area except on a permanent or temporary driveway.
The driver of a vehicle shall not back the same unless such
movement can be made with reasonable safety and without interfering
with other traffic.
No person shall open the door of a motor vehicle on the side
available to moving traffic unless and until it is reasonably safe
to do so, nor shall any person leave a door open on the side of a
motor vehicle available to moving traffic for a period of time longer
than necessary to load or unload passengers.
No person riding upon any bicycle, motorized bicycle, coaster,
roller skates, sled or toy vehicle shall attach the same or himself/herself
to any vehicle upon a roadway.
No person shall drive a vehicle onto or from any controlled
access roadway except at such entrances and exits as are established
by public authority.
It shall be unlawful for the directing officer or the operator
of any railroad train to direct the operation of or to operate the
same in such a manner as to prevent the use of any street for purposes
of travel for a period of time longer than five (5) minutes; provided
that this Section shall not apply to a moving train or to one stopped
because of an emergency or for repairs necessary before it can proceed
safely.
No vehicle shall at any time be driven through or within a safety
zone.
Every person operating a motor vehicle on the highways of this
City shall drive the vehicle in a careful and prudent manner and at
a rate of speed so as not to endanger the property of another or the
life or limb of any person and shall exercise the highest degree of
care.
The driver of a vehicle shall not follow another vehicle more
closely than is reasonably safe and prudent, having due regard for
the speed of such vehicle and the traffic upon and the condition of
the roadway. Vehicles being driven upon any roadway outside of a business
or residence district in a caravan or motorcade, whether or not towing
other vehicles, shall be so operated, except in a funeral procession
or in a duly authorized parade, so as to allow sufficient space between
each such vehicle or combination of vehicles as to enable any other
vehicle to overtake or pass such vehicles in safety. This Section
shall in no manner affect Section 304.044, RSMo., relating to distance
between trucks traveling on the highway.
