A. There
is hereby established and created for the City of Rogersville, Missouri,
a Commission to be known as the Planning and Zoning Commission as
provided by Chapter 89, RSMo. Such Commission shall consist of nine
(9) members composed as follows, to wit: The Mayor, if the Mayor chooses
to be a member, a member of the Board selected by the Board, if the
Board chooses to have a member serve on the Commission, the City Engineer,
if applicable and not more than seven (7) citizens from the City at
large to be known as citizen members who shall be appointed by the
Mayor and approved by the Board of Aldermen. The Mayor, Board Member
and City Engineer shall serve during the term for which they were
elected or appointed. The citizen members shall serve for a term of
four (4) years from the first (1st) day of January next following
their appointment. The terms of the citizen members first appointed
shall be for varying periods so that succeeding terms will be staggered.
Thereafter, appointments shall be made to fill vacancies prior to
the first (1st) day of January of each calendar year. Any vacancy
in a membership shall be filled for the unexpired term by appointment
as aforesaid. The Board of Aldermen may remove any citizen member
for cause stated in writing and after public hearing.
B. All
citizen members shall be qualified voters and taxpayers of the City
of Rogersville, Missouri, and shall hold no other office or position
in the City administration.
All citizen members of the Planning and Zoning Commission shall
serve without compensation.

The Commission shall annually at its first (1st) meeting after
the first (1st) day of January elect from among the citizen members
its Chairman and Secretary, and any Chairman or Secretary shall be
eligible for re-election. The Commission shall hold regular meetings
at such times and places as it may establish by its own rules and
shall by its rule provide the manner for calling of special meetings.
It shall adopt rules for the transaction of its business and shall
keep a record of its proceedings, which records shall be public records.

The Planning and Zoning Commission shall make an annual report
to the Board of Aldermen covering its investigations, transactions
and recommendations and such other and further reports relative thereto
as it may deem proper or as required by the Board of Aldermen.

The Planning and Zoning Commission shall have authority to appoint
or employ such employees and staff members necessary for its work
as it may deem necessary, but the expenditures by the Commission,
exclusive of grants and gifts, shall be within the amounts appropriated
for the purpose by the Board of Aldermen.
All public officials shall upon request furnish to the Planning
and Zoning Commission, within a reasonable time, all available information
it requires for its works.

A. The
City Planning and Zoning Commission shall have the power and it shall
be its duty to perform the following functions, to wit:
1. Make and adopt a City Plan for the physical development of the municipality.
2. Make recommendations in connection with the execution and detailed
interpretation of the City Plan and make such changes and adjustments
in the plan from time to time as it may deem desirable.
3. Prepare a zoning plan for the City of Rogersville for the regulation
of the height, area, bulk, location and use of private, non-profit
and public structures and premises, and of population density, all
in conformity to the provisions of Chapter 89, RSMo.
4. Prepare and submit the Board of Aldermen its recommendations for
regulations governing the subdivision of land within the City of Rogersville,
Missouri, including, among other things, requirements for the coordinated
development of the municipality, for the coordination of streets within
subdivisions with other existing or planned streets or with other
features of the City Plan or Official Map of the City, for adequate
open spaces for traffic, recreation, light and air, and for a distribution
of population and traffic. The Commission shall further make recommenda-tions
as to requirements of the extent and manner in which the streets of
the subdivision shall be graded and improved, requirements as to the
extent and manner of the installation of all utility facilities, and
recommended manner of enforcement. All recommendations shall be in
conformity with Chapter 89, RSMo., and not in conflict with this or
any other ordinance of the City of Rogersville, Missouri.
5. Make recommendations regarding the approval or disapproval of plats
for land subdivision.
6. The Commission shall have all powers reasonably necessary and incident
to carrying out the foregoing provisions and duties and shall further
have any and all other powers conferred upon it by Chapter 89, RSMo.,
which are not in conflict with any ordinance of the City of Rogersville,
Missouri.
The Planning and Zoning Commission, its members and employees
in the performance of its functions may enter upon any land to make
examinations and surveys.
