A. 
A certain document, two (2) copies of which are on file in the office of the City Clerk of the City of Winchester, being marked and designated as the International Property Maintenance Code, 2015 edition, including Appendix Chapter A, as published by the International Code Council, be and is hereby adopted as the Property Maintenance Code of the City of Winchester, in the State of Missouri, for regulating and governing the conditions and maintenance of all property, buildings and structures; by providing the standards for supplied utilities and facilities and other physical things and conditions essential to ensure that structures are safe, sanitary and fit for occupation and use; and the condemnation of buildings and structures unfit for human occupancy and use, and the demolition of such existing structures as regulations, provisions, penalties, conditions and terms of said Property Maintenance Code on file in the office of the City of Winchester are hereby referred to, adopted, and made a part hereof, as if fully set out in this legislation, with the additions, insertions, deletions and changes, if any, prescribed in Subsection (B) of this Section.
B. 
The following sections are hereby revised:
1. 
Section 101.1, insert: "City of Winchester."
2. 
Section 103.5, insert: Section 515.070 Occupancy permit required © The fee for inspection is seventy dollars ($70.00) for the first inspection and one (1) reinspection and thirty-five dollars ($35.00) for the second reinspection and forty dollars ($40.00) for each following inspection, and the fee for the occupancy permit is ten dollars ($10.00).

Delete and replace: Section 112.4, Failure to comply. The owner or general agent of a building or premises where a violation of any provision of said regulations has been committed or shall exist, or the lessee or tenant of an entire building or an entire premises where such violation has been committed or shall exist, or the owner, general agent, lessee or tenant of any part of the building or premises in which such violation has been committed or shall exist, or the general agent, architect, builder, contractor or any other person who commits, takes part or assists in any such violation, or who maintains any building or premises in which any violation shall exist shall be guilty of a misdemeanor punishable as follows:
By a fine of not less than ten dollars ($10.00) and not more than two hundred fifty dollars ($250.00) for each and every day that such violation continues, but if the offense be willful, on conviction thereof, the punishment shall be a fine of not less than one hundred dollars ($100.00) or more than two hundred fifty dollars ($250.00) for each and every day that such violation shall continue or by imprisonment for ten (10) days for each and every day such violation shall continue, or by both such fine and imprisonment in the discretion of the court. Notwithstanding the provisions of Section 82.300, RSMo., for the second and subsequent offenses involving the same violation at the same building or premises, the punishment shall be a fine of not less than one hundred dollars ($100.00) or more than five hundred dollars ($500.00) for each and every day that such violation shall continue, or by imprisonment for ten (10) days for each and every day such violation shall continue or by both such fine and imprisonment in the discretion of the court.
4. 
Add: Section 302.3.1 Trees are to be kept a minimum of three (3) feet from buildings or roofs.
5. 
Section 302.4. Insert: "seven (7) inches."
6. 
Add: 303.2.1 In changes of residential occupancies with a swimming pool (that requires a safety enclosure) if door alarms are not present, they will be provided by the owner. They will comply with the International Swimming Pool and Spa Code.
7. 
Section 304.14, insert "April 15 to November 15."
8. 
Delete and replace: Section 307.1 Every exterior and interior flight of stairs having more than four (4) risers shall have a handrail on one (1) side of the stair, and every open portion of a stair, landing, balcony, porch, deck ramp or other walking surface that is more than thirty (30) inches above the floor or grade below shall have guards. Handrails shall not be less than thirty (30) inches in height or more than forty-two (42) inches in height measured vertically above the nosing of the tread or above the finished floor of the landing or walking surfaces. Guards shall not be less than thirty-six (36) inches in height above the floor of the landing, porch, deck, or ramp or other walking surface. Exception: Guards shall not be required where exempted by the adopted building code.
9. 
Add: Section 403.5.1 Clothes dryer exhaust systems are to be maintained in good repair and clean.
10. 
Add: Section 404.4.1.1 The maximum occupancy limit for a bedroom is three (3) persons.
11. 
Add: Section 507.2 Gutters and downspouts will be provided on residential and commercial buildings unless the installation is not technically feasible.
12. 
Add: Section 507.3 Sump pump discharge is to be terminated no closer than ten (10) feet to the property line.
13. 
Section 602.3, insert: "October 1 to May 1."
14. 
Section 602.4, insert: "October 1 to May 1."
15. 
Add: Section 605.2.1 All receptacles located within six (6) feet of standing water, over exposed concrete floors in basements and receptacles in garages shall have ground fault circuit interrupter protection.
16. 
Add: Section 703.2.1 Garage dwelling separations shall comply with R302.5 of the 2015 International Residential Code. All garages and carports shall comply with R309.1 and 309.2 of the 2015 International Residential Code.
