No person shall cause or permit the diversion of the flow of stormwater
or other discharge of water from any drain, ditch, or drainage facility
onto any public roadway located within the Township of Fallowfield.
For purposes of this section, the diversion of water from drains,
ditches, or drainage facilities shall include the deliberate or incidental
obstruction of any existing drain, ditch, or drainage facility, the
obstruction of any such drain, ditch, or drainage facility by the
accumulation of rubbish, vegetative matter, or other debris.
No person shall alter the existing shape, grade, or contour of land,
or construct any driveway, pathway, road, retaining wall, or other
fixture which same alteration results in the flow of water into a
public roadway, or which same accelerates the flow of water onto a
public roadway.
The Code Enforcement Officer of the Township of Fallowfield is duly
empowered to enforce the terms and conditions of this article, and
to bring such summary criminal proceedings as necessary to enforce
the terms and conditions of the penalty provisions of this article.
Any person who violates or permits a violation of this article shall,
upon conviction in a summary proceeding brought before a Magisterial
District Judge under the Pennsylvania Rules of Criminal Procedure,
be guilty of a summary offense and shall be punishable by a fine of
not more than $1,000, plus costs of prosecution. In default of payment
thereof, the defendant may be sentenced to imprisonment for a term
not exceeding 90 days. Each day or portion thereof that such violation
continues or is permitted to continue shall constitute a separate
offense, and each section of this article that is violated shall also
constitute a separate offense.[1]
