It is hereby recognized that with regard to the use of Township-owned parks, there is a need to establish policies with regard to the activities that may be conducted in said parks in order to properly protect the peace, safety and order of the public.

A. 
At no time will drugs or narcotics or alcoholic beverages be allowed in the parks.
B. 
Any person violating § 221-6A shall, upon conviction thereof, be penalized as provided in § 1-15 of the Code of the Township of Hillsborough.
C. 
No person shall be under the influence of drugs or narcotics or alcoholic beverages in the parks.
D. 
A person found to be guilty of being under the influence of drugs or narcotics in the parks shall be penalized as provided in § 1-15 of the Code of the Township of Hillsborough.
E. 
A person who is intoxicated in a park may be assisted to his or her residence or to an intoxication treatment or other facility by a Township police officer consistent with the requirements contained in N.J.S.A. 26:2B-16, a portion of the New Jersey Alcoholism Treatment and Rehabilitation Act, and shall not be charged with a violation of the Code of the Township of Hillsborough.

A. 
No domestic animal shall be permitted to run at large within the parks. All such pets must be kept on a leash not exceeding six feet in length. It shall be the responsibility of the owner to remove any animal droppings.
B. 
No person shall ride, drive, lead or keep a saddle horse within the parks, with the exception of Otto's Farm Park and Mike Merdinger Meadow.

No person shall leave bottles, broken glass, ashes, wastepaper or other refuse anywhere within the parks, except in a properly provided receptacle designated for that purpose.
No person shall pick flowers, foliage, berries or fruit or cut, break, dig up or in any way mutilate or injure any tree, shrub, plant, fern, grass, turf, railing, seat, fence, structure or any other physical objects within the parks.
No person shall build, light or maintain a fire within the parks except in a stove, grill or fireplace provided at the parks or brought to the parks for cooking purposes.
A. 
No person shall discharge any weapon or firearms within the park. Firearms shall not be carried nor had in possession within the parks. Shooting with bow and arrow is also prohibited.
B. 
No person shall molest, trap, capture, hold, remove, injure or kill any animal or disturb its habitat within the parks.
A. 
No person shall engage in any commercial enterprise, including but not limited to the offering of services, soliciting, selling or peddling any liquids or edibles for human consumption, or distribute circulars or hawk, peddle or vend any goods, wares or merchandise within the parks.
B. 
No person shall cut, carve, paint, mark, paste or fasten on any tree, fence, wall, building, monument or other object within the parks any bill, advertisement or inscription, nor shall any person distribute, cast, throw or place any handbill, pamphlet, circular, advertisement or notice of any kind within the parks.
A. 
Footpaths or walks established for pedestrian travel shall not be used for vehicular travel. The use of mopeds or motorized bikes will be limited to roadways, drives and parking areas as established and opened to all other vehicular traffic.
B. 
No person shall drive or propel or cause to be driven or propelled, along or over any road within the parks, any vehicle at a rate of speed greater than 15 miles per hour.
C. 
No person shall park any vehicle outside of designated parking areas.
A. 
The hours of operation of the parks shall be from dawn to dusk, Monday through Sunday, unless otherwise scheduled through the Hillsborough Township Director of Recreation or the Recreation Commission, with the exception of AVM and Docherty Park, which shall be open from dawn to 10:30 p.m. from April 1 through October 31.

B. 
Reserved use of any of the facilities shall be scheduled through the Director of Recreation.
No person shall remain within the parks who does not abide by conditions adopted and posted by the Hillsborough Township Committee for the preservation of good order and the protection of property within the parks, and no person shall remain within the parks who does not abide by the instructions and directions of duly authorized officers or agents of the Hillsborough Township Committee in the lawful performance of their duties. Any person directed by an agent or officer of the Hillsborough Township Committee to leave the park shall do so promptly and peaceably.

The following terms when used in §§ 221-16 through 221-20 shall have the meanings indicated.
ROLLER SKATES or ROLLER BLADES
A pair of devices normally worn on the feet with a set of wheels attached regardless of the number or placement of those wheels and used to glide or propel the user over the ground.
SKATEBOARDS
A device made of material designed primarily to be stood upon, with a set of wheels attached, regardless of the number or placement of those wheels and used to glide or propel the user over the ground. It includes skateboards that are motorized. It also includes skateboards, or similar devices, with a handle commonly referred to as "scooters" or "razor boards."
SKATE PARK
The Township-owned skate park in Ann Van Middlesworth Park and any subsequent skate parks erected or acquired or areas designated by the Township for skateboarding and/or roller-blading.

No person shall operate, or cause to be operated, skateboards, roller skates, roller blades, or the like upon any structure or object not intended for that purpose, including, by way of example and not limitation, benches, picnic tables, playground equipment and bicycle racks unless the areas are designated for said use.

A. 
All persons, regardless of age, must wear on his/her head a properly fitted and fastened safety helmet which meets the standards of the American National Standards Institute (ANSI Z90.4 bicycle helmet standard), the Snell Memorial Foundation's 1990 Standard for Protective Headgear for Use in Bicycling, or the American Society for Testing and Materials (ASTM) helmet standard or other such standard, as appropriate.
B. 
No person shall operate, or cause to be operated, skateboards, roller skates, roller blades or the like in a reckless or hazardous fashion or in a manner creating interference with others using the Skate Park.
C. 
All persons using the Skate Park must abide by all posted rules and regulations adopted by the Township governing body by resolution.
D. 
Only skateboards and roller blades are allowed in the Skate Park.
E. 
All persons using the Skate Park must abide by all directions, commands or orders of any police officer or Township official.

Notwithstanding any other action which a law enforcement officer is authorized to take, upon probable cause to believe a minor has violated §§ 221-16 through 221-18, the officer shall cause the minor's parent, guardian or other adult in the minor's household to be notified of the situation. If circumstances warrant, the officer shall request that the parents, guardian or other adult respond to headquarters to take custody of the juvenile.

The use of Hillsborough Township athletic fields or facilities for team play, team practice and/or other organized events requires a permit issued by the Hillsborough Township Recreation Office. The permit must be secured in advance and accompany the authorized group to the reserved field or facility. Failure to secure said permit and/or failure to produce said use permit upon the request of a Township police officer or municipal employee will result in removal from the field or facility and which may include a Municipal Court summonses and violation penalties in accordance with § 221-21.

Unless another penalty is expressly provided for by New Jersey statute, any person, except juveniles who shall be handled in accordance with the applicable juvenile laws and procedures, violating the provisions of this article shall, upon conviction, be punished by:
A. 
A fine not to exceed $100; and/or
B. 
A sentence of community service of not more than 30 days, and/or
C. 
Removal from the Skate Park for a period of time not to exceed 30 days, and/or
D. 
Court-ordered restitution for damages to public and/or private property.
