As used in this Article, the following terms shall have these prescribed meanings:
CITY
The City of Tipton, Missouri.
DOG
Any member of the canine family.
FIERCE AND DANGEROUS DOG
Shall mean and include:
1. 
Any dog with a known propensity, tendency or disposition to attack, to cause injury, or to otherwise endanger the safety of human beings or domestic animals; or
2. 
Any dog which bites, inflicts injury, assaults or otherwise attacks a domestic animal or human being; or
3. 
Any dog owned or harbored primarily or in part for the purpose of dog fighting or any dog trained for dog fighting.

A. 
It shall be unlawful for any person to keep or harbor within the City any fierce or dangerous dog without being properly controlled as follows:
1. 
By confinement inside a residential structure in such a manner that access to the outside, and persons outside the structure and it's immediate area is restricted by means of stout and securely latched doors and windows.
2. 
By confinement on a leash at all times when beyond the premises of the person keeping or harboring such dangerous or vicious dog, said leash being not greater than four (4) feet in length, made of chain, and having a minimum tinsel strength of not less than three hundred (300) pounds; provided further, such dog shall at all times when beyond the premises of such person be securely muzzled.

Any outdoor structure used to pen up a fierce or dangerous dog must have secure sides and a secure top attached to the sides. All structures used to confine a dangerous dog must be locked with a key or combination lock when such animals are within the structure. Such structure must have a secure bottom or floor attached to the sides of the pen or the sides of the pen must be embedded in the ground no less than one (1) foot. All such structures must be kept in a clean and sanitary condition.

If any fierce or dangerous dog, whether the dog license or dog tag tax be paid or not, shall be found running at large within the City, or on the premises of other persons, or shall be allowed to run at large in any tenement building occupied by two (2) or more families, and shall thereby annoy or endanger any person, or their property, the City Marshal or any member of the Police Force may use any force necessary, including killing, to subdue said dog, in order to protect the inhabitants of the City of Tipton and their property.

Any person or persons who shall hinder, interfere with, or resist the Marshal or any person under his/her direction, in the discharge of the duties imposed upon him/her by any Section in this Article shall be deemed guilty of a misdemeanor.

No animal may be declared dangerous if the threat, injury or damage was sustained by a person who, at the time, was committing a willful trespass or other tort upon the premises occupied by the owner or keeper of the animal, or was teasing, tormenting, abusing or assaulting the animal or has in the past, been observed or reported to have teased, tormented, abused or assaulted the animal or was committing or attempting to commit a crime.

Any person violating any provision of this Article shall be deemed guilty of a misdemeanor and shall be punished by a fine of not less than fifty dollars ($50.00) and not more than five hundred dollars ($500.00), or imprisoned not more than ninety (90) days, or by both such fine and imprisonment.
