Elections Governed By State Law. Elections
in the City of Bonne Terre shall be governed by the provisions of
Chapter 115, RSMo., as the same now exist or hereafter amended, except
as may now or hereafter be provided by ordinance not inconsistent
with the Missouri State Statutes.

The general election for elective officers for the City of Bonne
Terre shall be held on municipal election days every year as set by
Section 115.121(3), RSMo.

Special elections shall be called by ordinance adopted by the
City Council as provided by law.

A. General. A municipal election for the qualified voters of
this City shall be held on the first (1st) Tuesday after the first
(1st) Monday in April of each year.
B. Mayor. On the first (1st) Tuesday after the first (1st)
Monday in April of 2008, and every four (4) years thereafter, a municipal
election of the qualified voters of the City of Bonne Terre shall
be held for the purpose of electing a Mayor who shall hold his/her
office for a term of four (4) years and until his/her successor is
elected and qualified.
C. Election Of Councilpersons. One (1) Councilperson shall
be elected from each of such four (4) wards by the qualified voters
thereof at the first (1st) election for Councilpersons held in the
City. At the first (1st) election held on the 8th day of April, 2008,
the Councilpersons elected from the odd-numbered wards shall be elected
for a term of one (1) year and the Councilpersons elected from the
even-numbered wards shall be elected for a term of two (2) years.
At each annual election held thereafter, successors for Councilpersons
whose terms expire in each year shall be elected for a term of two
(2) years.

A. Any
person who desires to become a candidate at any City election, for
any elective office, shall file with the City Clerk not sooner than
8:00 A.M. on the sixteenth (16th) Tuesday prior to the election and
not later than 5:00 P.M. on the eleventh (11th) Tuesday prior to the
election written declaration of his/her intent to become a candidate
at the election. The form of serving declaration shall be substantially
as follows:

I, the undersigned, having all the legal qualifications required
by the Missouri State Statutes and by the City ordinances, hereby
notify you in writing that I am and shall be a candidate for the upcoming
municipal election for the office of __________ and request you to
place my name on the official ballots as a candidate at the said election
for the aforesaid office.

B. The
City Clerk shall, before the seventeenth (17th) Tuesday prior to any
election in which offices are to be filed, notify the general public
of the opening filing date, the office or offices to be filled, the
proper place for filing and the closing filing date of the election.
Such notification may be accomplished by legal publication published
in at least one (1) newspaper of general circulation in the City of
Bonne Terre, Missouri.

A. All
candidates for municipal elective office must pay a filing fee in
the amount of twenty-five dollars ($25.00) at the time of declaration
of candidacy. The City Clerk shall not accept the declaration of candidacy
without the fee payment.
B. All
fees paid pursuant to this Section shall be directed to the City Treasurer
for deposit into the City's general revenue account and a receipt
so issued to the payor. The filing fee shall not be refundable.
No person shall be a candidate for municipal office unless such
person complies with the provisions of Section 115.346, RSMo., regarding
payment of municipal taxes or user fees.
The City Clerk shall, on or before the sixteenth (16th) Tuesday
prior to any election at which City offices are to be filled by said
election, notify the general public of the opening filing date, the
office or offices to be filled, the proper place for filing, and the
closing filing date of the election. Such notification may be accomplished
by legal notice published in at least one (1) newspaper of general
circulation in the City.
In City elections, the City Clerk shall notify the County Clerk
prior to 5:00 P.M. on the tenth (10th) Tuesday prior to any City election
except as noted in Section 115.125.1, RSMo. The notice shall be in
writing, shall specify that the City Council is calling the election,
the purpose of the election, the date of the election, and shall include
a certified copy of the legal notice to be published including the
sample ballot. The notice and any other information required by this
Section may, with the prior notification to the election authority
receiving the notice, be accepted by facsimile transmission prior
to 5:00 P.M. on the tenth (10th) Tuesday prior to the election, provided
that the original copy of the notice and a certified copy of the legal
notice to be published shall be received in the office of the election
authority within three (3) business days from the date of the facsimile
transmission.

Whenever there is a tie vote in the election of any elected
official, the matter shall be decided as provided in Section 115.517,
RSMo.

When the election authority shall have declared any person elected
to any City office, the City Clerk shall at the next meeting of the
City Council administer the oath of office to the person, who shall
attest their oath with their signature. The original of the oath shall
be delivered to such person so elected as a certificate of this election,
attested by the City Seal.

The Mayor and City Council are hereby authorized to issue and
negotiate bonds or other securities for any purpose authorized by
and in compliance with the terms of Sections 77.160, 77.180 and 95.320
et seq., RSMo.

A. The
Council shall divide the City into four (4) Wards. The boundaries
of the Wards shall be approved by the Council and may be changed by
the Council, however, the population of the Wards shall be as equal
as possible. The exact description of the boundaries of the Wards
and the map thereof shall be kept by the City Clerk at the City Hall
with the date of approval of the map, signature of the Mayor and attestation
by the Clerk.
B. Establishment Of Ward Boundary Lines. The map of the City
of Bonne Terre prepared by the Southeast Missouri Regional Planning
Commission filed with the City Clerk and reviewed by the City Council
dated the 14th day of August, 2007, is hereby approved in which the
ward lines are shown but not described.
C. The
legal descriptions prepared by the Southeast Missouri Regional Planning
Commission filed with the City Clerk and reviewed by the City Council
dated the 11th day of September, 2007, are hereby approved and accepted
as follows:
1. First Ward shall be that part of the City of Bonne Terre, Missouri,
described as follows:
Beginning at the intersection of Benham Street and North Division
Street, thence in an easterly direction along the centerline of Benham
Street to its intersection with the existing corporate limits of the
City of Bonne Terre, thence following the existing corporate limits
of the City of Bonne Terre in a northerly, westerly and southerly
direction to their intersection with the centerline of Buchanan Street
located on the western side of the City, thence following the centerline
of Buchanan Street in an easterly direction to its intersection with
the centerline of North Norwine Street, thence in a northerly direction
with the centerline of North Norwine Street to its intersection with
the centerline of Southpark Drive, thence in an easterly direction
with the centerline of Southpark Drive to its intersection with the
centerline of Buchanan Street, thence in an easterly direction along
the centerline of Buchanan Street to its intersection with the centerline
of North Division Street, thence in a southerly direction along the
centerline of North Division Street to its intersection with the centerline
of Benham Street being the point of beginning.
2. Second Ward shall be that part of the City of Bonne Terre, Missouri,
described as follows:
Beginning at the intersection of the centerline of Buchanan
Street with the centerline of North Division Street, thence in a southerly
direction along the centerline of North Division and South Division
Streets to their intersection with the centerline of Murrill Street,
thence in a westerly direction along the centerline of Murrill Street
to its intersection with the centerline of Francis Street, thence
in a southwesterly direction along the centerline of Francis Street
to its intersection with the centerline of Shepard Street, thence
in a southeasterly direction along the centerline of Shepard Street
to its intersection with the centerline of Francis Street, thence
in a southwesterly direction along the centerline of Francis Street
to its intersection with the centerline of Cole Street, thence in
a southeasterly direction along the centerline of Cole Street to its
intersection with the centerline of Hill Street, thence in a southwesterly
direction along the centerline of Hill Street to its intersection
with the centerline of Branch Street, thence in a southwesterly direction
along the centerline of Branch Street to its intersection with the
existing corporate limits of the City of Bonne Terre, thence in a
westerly and northerly direction along the existing corporate limits
of the City of Bonne Terre to their intersection with the centerline
of Buchanan Street, thence in an easterly direction along the centerline
of Buchanan Street to its intersection with the centerline of North
Norwine Street, thence in a northerly direction along the centerline
of North Norwine Street to its intersection with the centerline of
Southpark Drive, thence in an easterly direction along the centerline
of Southpark Drive to its intersection with the centerline of Buchanan
Street, thence in an easterly direction along the centerline of Buchanan
Street to its intersection with the centerline of North Division Street
being the point of beginning.
3. Third Ward shall be that part of the City of Bonne Terre, Missouri,
described as follows:
Beginning at the intersection of the centerline of Buchanan
Street with the centerline of North Division Street, thence in a southerly
direction along the centerline of North Division and South Division
Streets to their intersection with the centerline of Murrill Street,
thence in a westerly direction along the centerline of Murrill Street
to its intersection with the centerline of Francis Street, thence
in a southwesterly direction along the centerline of Francis Street
to its intersection with the centerline of Shepard Street, thence
in a southeasterly direction along the centerline of Shepard Street
to its intersection with the centerline of Francis Street, thence
in a southwesterly direction along the centerline of Francis Street
to its intersection with the centerline of Cole Street, thence in
a southeasterly direction along the centerline of Cole Street to its
intersection with the centerline of Hill Street, thence in a southwesterly
direction along the centerline of Hill Street to its intersection
with the centerline of Branch Street, thence in a southwesterly direction
along the centerline of Branch Street to its intersection with the
existing corporate limits of the City of Bonne Terre, thence along
the existing corporate limits of the City of Bonne Terre in an easterly
direction to its intersection with the centerline of the Union Pacific
Railroad formerly the Missouri Pacific Railroad, thence in a northerly
direction along the centerline of the Union Pacific Railroad formerly
the Missouri Pacific Railroad to its intersection with the centerline
of Benham Street, thence in a westerly direction along the centerline
of Benham Street to the centerline of North Division Street being
the point of beginning.
4. Fourth Ward shall be that part of the City of Bonne Terre, Missouri,
described as follows:
Beginning at the intersection of the centerline of the Union
Pacific Railroad formerly the Missouri Pacific Railroad with the centerline
of Benham Street, thence in an easterly direction along the centerline
of Benham Street to its intersection with the existing corporate limits
of the City of Bonne Terre, thence in an easterly, southerly and westerly
direction along the existing corporate limits of the City of Bonne
Terre to their intersection with the centerline of the Union Pacific
Railroad formerly the Missouri Pacific Railroad, thence in a northerly
direction along the centerline of the Union Pacific Railroad formerly
the Missouri Pacific Railroad to its intersection with the centerline
of Benham Street being the point of beginning. Excluding two (2) small
parcels along Lake Street, currently not within the corporate boundaries
of the City of Bonne Terre, but surrounded by the City of Bonne Terre.
D. The
City map delineating and describing the wards of the City shall remain
in the City Hall and be available for inspection during normal business
hours.
