A. 
Membership. There is hereby created a Board of Zoning Adjustment which shall consist of five (5) residents as members. They shall be appointed by the Board of Aldermen and shall serve for terms of five (5) years each. The first (1st) Board appointed shall serve respectively: one (1) for one (1) year, one (1) for two (2) years, one (1) for there (3) years, one (1) for four (4) years and one (1) for five (5) years. All members shall be removable for cause by the appointing authority upon written charges and after a public hearing. Vacancies shall be filled for the unexpired term of any member who resigns or otherwise no longer serves as a member.
B. 
Procedures. The Board of Zoning Adjustment shall adopt rules of procedure in accordance with the provisions of this zoning ordinance and the provisions of Chapter 89, RSMo.
C. 
Appeals. Appeals to the Board of Adjustment may be taken by any person aggrieved, by any neighborhood organization as defined in Section 32.105, RSMo., representing such person, or by any officer, department, board or bureau of the municipality affected by any decision of the administrative officer. The appeal shall be taken within a period of not more than three (3) months and in the manner provided by the rules of the Board. An appeal shall stay all proceedings in furtherance of the action appealed from, unless the enforcement officer shall certify to the Board that by reason of facts stated in the certificate the grounds of appeal or a stay would, in his/her opinion, cause immediate peril, jeopardize or be detrimental to life or property.
D. 
Fees. Every application or appeal to the Board of Zoning Adjustment shall be accompanied by a filing fee of three hundred dollars ($300.00). All applications or appeals necessitating the publication of notices in a newspaper shall be accompanied by a filing fee of thirty-five dollars ($35.00) or the cost of such publication, whichever is greater.
