There is hereby established a Department of Public Utilities in accordance with the provisions of this article.

In accordance with Section 23, Paragraph (7) of Chapter 72 of the Acts of 2013, there shall be a Commissioner of Public Utilities.

(1) 
The Commissioner of Public Utilities shall ensure compliance with all utility laws, ordinances, rules and regulations of the commonwealth and the City of Pittsfield pertaining to water supply, wastewater treatment and solid waste collection and disposal.
(2) 
The Commissioner of Public Utilities shall supervise the buildings, grounds, machinery, equipment, pipes, reservoirs, watersheds, wells and all pertinent matters relating to water supply and wastewater treatment.
(3) 
The Commissioner of Public Utilities shall be responsible for the construction, extension, improvement, operation and maintenance of the water, sewer and wastewater treatment facilities and distributing systems owned or operated by the City of Pittsfield. The Commissioner of Public Utilities shall also perform related duties as may be required or assigned.

The powers and duties of the Commissioner of Public Utilities are set forth in Chapter 19, Article VI, and Chapter 22, Article I, In General, Section 22-6.
