The language set forth in this chapter shall be interpreted
in accordance with the following rules of construction:
A. The singular number includes the plural and the plural includes the
singular.
B. The present tense includes the past and future tenses and the future
tense includes the present.
C. When used in connection with an action of an owner or park manager,
the word "shall" is mandatory, while the word "may" is permissive.
D. Terms connoting a particular gender shall include each and every
gender.
E. Whenever a word or term is defined and hereinafter appears in the
text of this chapter, its meaning shall be construed as set forth
in the definition thereof, and any word appearing in parenthesis between
a word and its definition shall be construed in the same sense as
that word.
F. All measured distances shall be to the nearest integral yard; if
a fraction is 1/2 yard or more, the integral yard next above shall
be taken.

G. All words and terms not defined in this section shall be construed
in their generally accepted meanings.
H. All provisions of this chapter imposing duties upon the City, its
officers or agents are advisory, unless the context clearly requires
that the provision be construed as mandatory.

As used in this chapter, the following terms shall have the
meanings indicated:
ACCESSORY STRUCTURE
A building subordinate to and smaller than a principal building
or manufactured home that contributes to the comfort, convenience
or necessity of the occupants of the principal building or manufactured
home.
COMMISSION
The El Paso Zoning Board of Appeals.

DRIVEWAY
A minor private way used by vehicles and pedestrians on a
manufactured home lot or used for common access to a small group of
lots or facilities.
FAMILY
One or more persons living together in a single dwelling
unit as a traditional family or the functional equivalent of a traditional
family. It shall be a rebuttable presumption that four or more persons
living together in a single dwelling unit, who are not related by
blood, adoption, or marriage, do not constitute the functional equivalent
of a traditional family. In determining the functional equivalent
of a traditional family, the following criteria shall be present:

A.
The group shares the entire dwelling unit.
B.
The group lives and cooks together as a single housekeeping
unit.
C.
The group shares expenses for food, rent, utilities or other
household expenses.
D.
The group is permanent and stable, and not transient or temporary
in nature.
E.
Any other factor reasonably related to whether the group is
the functional equivalent of a family.
LICENSE
A written license issued by the City allowing a person to
operate and maintain a manufactured home park under the provisions
of this chapter and regulations issued under this chapter.
MANUFACTURED HOME
A factory-assembled, completely integrated structure designed
for permanent habitation, with a permanent chassis, and so constructed
as to permit its transport, on wheels temporarily or permanently attached
to its frame, and is a movable or portable unit that is eight body
feet or more in width, 40 body feet or more in length, and 320 or
more square feet, constructed to be towed on its own chassis (comprised
of frame and wheels) from the place of its construction to the location,
or subsequent locations, at which it is connected to utilities for
year-round occupancy for use as a permanent habitation, and designed
and situated so as to permit its occupancy as a dwelling place for
one or more persons, and specifically includes a "manufactured home"
as defined in Subdivision (53) of Section 9-102 of the Uniform Commercial
Code (810 ILCS 5/9-102). The term shall include units containing parts
that may be folded, collapsed, or telescoped when being towed and
that may be expected to provide additional cubic capacity, and that
are designed to be joined into one integral unit capable of being
separated again into the components for repeated towing. The term
excludes campers and recreational vehicles. The term "mobile home"
shall not include modular homes and their support systems. The words
"mobile home" and "manufactured home" are synonymous for the purposes
of this chapter.

MOBILE HOME

MOBILE HOME LOT
A parcel of land for the placement of one manufactured home
which is designated for the exclusive use of the occupant.
MOBILE HOME PARK
A parcel of land which has been developed for the placement
of two or more manufactured homes and is owned by an individual, firm,
trust, partnership, public or private association or corporation.
MOBILE HOME STAND
That part of a manufactured home lot which has been reserved
for the placement of one manufactured home with accessory structures
or additions.
PARK MANAGER
The person who owns or has charge, care or control of the
manufactured home park.
PARK STREET
A private way, including on-street parking lanes where applicable,
which affords the principal means of access to individual manufactured
home lots or service buildings.
PERMIT
A written certification issued by the City of El Paso or
its duly authorized representative permitting the construction, alteration
or extension of a manufactured home park under the provisions of this
chapter and regulations issued hereunder. This certification shall
also be used for approval of plans for additions, accessory structures,
installations, or repair of structures on a manufactured home lot.
PERSON
Any individual, firm, trust, partnership, public or private
association or corporation.
RECREATIONAL VEHICLE (RV)
A vehicular-type unit primarily designed as temporary living
quarters for recreational, camping or travel use, which either has
its own motor power or is mounted on or towed by another vehicle.
The basic entities are:
A.
CAMPING TRAILERA vehicular portable unit mounted on wheels and constructed with collapsible partial side walls which fold for towing by another vehicle and unfold at the camp site to provide temporary living quarters for recreational, camping or travel use.
B.
MOTOR HOMEA vehicular unit designed to provide temporary living quarters for recreational, camping or travel use, built on or permanently attached to a self-propelled motor vehicle chassis or on a chassis cab or van which is an integral part of the completed vehicle.
C.
TRUCK CAMPERA portable unit constructed to provide temporary living quarters for recreational, travel or camping use, consisting of a roof, floor and sides, designed to be loaded onto and unloaded from the bed of a pickup truck.
D.
TRAVEL TRAILERA vehicular unit, mounted on wheels, designed to provide temporary living quarters for recreational, camping or travel use and of such size or weight as not to require special highway movement permits when towed by a motorized vehicle, and with a living area of less than 220 square feet, excluding building equipment (such as wardrobes, closets, cabinets, kitchen units or fixtures) and bath and toilet rooms.
SERVICE BUILDING
A structure housing toilet, lavatory, park manager's office,
laundry facilities and such other facilities as may be required or
permitted by this chapter.
SEWER CONNECTION
The connection consisting of all pipes, fittings and appurtenances
from the drain outlets of the manufactured home to the inlet or the
corresponding sewer riser pipe of the sewerage system serving the
manufactured home lot.
SEWER RISER PIPE
That portion of the sewer lateral which extends vertically
to the ground elevation and terminates at each manufactured home lot.
WATER CONNECTION
The connection consisting of all pipes, fittings and appurtenances
from the water riser pipe to the water inlet pipe of the distribution
system within the manufactured home.
WATER RISER PIPE
That portion of the water supply system serving the manufactured
home park which extends vertically to the ground elevation and terminates
at a designated point of each manufactured home lot.
