A. It shall be unlawful for any person to have in their possession upon
any City-owned waterway any fish of any number, kind or size which
shall be prohibited or defined to be unlawful by the hunting and fishing
laws of the State of Missouri.
B. Any person who shall fish in any City-owned waterway shall have on
his/her person a valid fishing license issued by the State of Missouri,
and any violation thereof shall be a violation of this Chapter.
C. It shall be unlawful for any person to construct or utilize or occupy
any water-going craft upon said lake of a width in excess of six (6)
feet or which shall consist of a buoyed or floating platform of any
dimension ordinarily designed as a float or a raft.
D. It shall be unlawful for any person to moor, anchor or park any unoccupied
craft upon any portion of said City-owned waterway except along the
bank line thereof for a distance of one hundred (100) yards in either
direction from a lake spillway.
E. Every person while in a boat on any City-owned waterway shall have
in his/her possession an adequate life preserver.
F. The taking and pursuing of fish in any City-owned waterway shall
be governed by the rules and regulations adopted by the Missouri Department
of Conservation from time to time and/or as posted at any City-owned
waterway. Any violation of those rules and regulations shall be deemed
a violation of this Chapter.

A. No firearms and no hunting or trapping shall be permitted on any
City-owned waterway, except as set out in this Section.
B. The hunting of rabbits, squirrel, quail and wild turkey shall be
permitted during seasons as set by the State of Missouri only with
the use of a shotgun.
C. The hunting of water fowl shall be permitted with a shotgun during
the seasons set by applicable State and Federal agencies.
D. All blinds constructed after May 16, 2000, and used in the hunting
of water fowl shall be of a temporary construction. No permanent blinds
shall be allowed. Temporary blinds may be constructed no earlier than
August 15 and must be removed by February first or as soon thereafter
as weather permits. A permit to construct a blind must be obtained
at City Hall, which will require name, address and telephone number.
The permit must be attached to the blind.
E. The hunting of deer shall be permitted during the seasons set by
the State of Missouri only with a bow and arrow or a crossbow. The
construction of tree stands or other structures in connection with
the hunting of deer shall be prohibited.

F. Any person who shall violate any of the provisions hereof shall be
deemed guilty of an ordinance violation. All persons who hunt upon
said premises in all respects shall comply with the hunting laws of
the State of Missouri and any violation thereof shall constitute a
violation of this Chapter.

A. No person shall operate a motor vehicle on any roadway at any City-owned
waterway in excess of fifteen (15) miles per hour.
B. No person shall operate any all-terrain vehicle (ATV) of any description
on or off roadways at any City-owned waterway.
C. No person shall throw, drop or dump cans, paper, bottles, trash or
other litter on City-owned waterways, except in containers provided
for that purpose.
D. No person shall erect, construct or cause to be erected or constructed
any structures, dock or pier on any City-owned waterway without the
prior approval of the City Manager.
E. There shall be no parking of motor vehicles or of trailers of any
type on any road on City-owned waterways except in designated areas.
F. It shall be unlawful to swim in any City-owned waterway.
G. It shall be unlawful for any person to cut, destroy or remove any
trees or shrubs growing on City-owned waterways without the prior
approval of the City Manager.
H. No person shall operate a motor vehicle on municipal property or
a public park in any area designated as a trail, walkway, or a walking
or jogging trail, including but not limited to the pedestrian trail
located within the Marceline Country Club Lake. The City Manager is
authorized and directed to install appropriate signage for such trails
or walkways. For purposes of this Subsection, the term "motor vehicle"
means any self-propelled vehicle except wheelchairs or similar devices
used by disabled persons.

I. Any person found in violation of this Section shall be fined an amount
not to exceed the sum of two hundred dollars ($200.00), including
court costs.

A. Any boat motor in excess of ten (10) horsepower in the lake on the
City park situated in Section thirty-one (31), Township fifty-seven
(57), Range eighteen (18) in Linn County, Missouri, known as the Country
Club Lake, shall be operated at a no wake speed.
B. It shall be unlawful to swim in said lake.

A. The taking of or pursuing of fish or other game species from the
Park Pond, using any method, is prohibited.
B. No person shall swim, wade or otherwise enter the Park Pond.
C. No person shall allow or permit any domestic animal owned by such
person or under the control of such person to enter the Park Pond.
D. Any person found in violation hereof shall be fined as follows: for
violations committed within a twelve-month period beginning with the
first violation, two hundred dollars ($200.00) for the first violation,
two hundred seventy-five dollars ($275.00) for the second violation,
three hundred fifty dollars ($350.00) for the third violation, and
four hundred fifty dollars ($450.00) for the fourth and any subsequent
violations. Any such fine shall include court costs.
