No person shall fire or discharge any firearm within the limits of any park, playground, or within 500 feet of the boundaries of that portion of the Blackstone River Greenway located within the Town of Millville; or within 500 feet of the pedestrian pathways used by the public as access to and from the Blackstone River Greenway. No person shall fire or discharge any firearms on any private property except with the written consent of the owner or the legal occupant thereof, and such consent shall be renewed annually, carried at all times by any person, and upon request shall be shown to a police officer or officer of the Department of Conservation, or the property owner or his agent.
This bylaw shall not apply to the lawful defense of life or property, nor to any law enforcement officer acting in the discharge of his duties.
The Millville Police Department shall enforce this bylaw, violation notices and enforcement orders.
Any person violating any of the provisions of this bylaw shall be punished by a fine of not more than $100. Each day or part thereof that such violation occurs or continues shall constitute a separate offense. As an alternative to criminal prosecution or civil action, the Town of Millville may elect to utilize the noncriminal disposition procedure set forth in MGL c. 40, § 21D, in which case the Millville Police Department, or an authorized agent of the Town of Millville, shall be the enforcing person. The penalty for each violation under this form of disposition shall be $100. Each day or part thereof that such violation occurs or continues shall constitute a separate offense.
