A. 
There is hereby established in the Borough of Mount Ephraim a Uniform Construction Code enforcing agency to be known as the "Mount Ephraim Construction Code Enforcing Agency," consisting of a Construction Official, Building Subcode Official, Plumbing Subcode Official, Fire Protection Subcode Official and such other subcode officials as the Commissioner of the Department of Community Affairs, State of New Jersey, shall hereafter adopt as part of the State Uniform Construction Code. The Construction Official shall be the chief administrator of the Enforcing Agency.
B. 
Each official position created in Subsection A hereof shall be filled by a person qualified for such position pursuant to P.L. 1975, c. 217,[1] as amended, and N.J.A.C. 5:23, provided that, in lieu of any particular subcode official, an on-site inspection agent may be retained by contract pursuant to N.J.A.C. 5:23. More than one such official position may be held by the same person, provided that such person is qualified pursuant to P.L. 1975, c. 217, and N.J.A.C. 5:23 to hold such position.

The public shall have the right to do business with the Enforcing Agency at the office location except for emergencies and unforeseen or unavoidable circumstances. Upon the enactment date of this chapter, the Borough Clerk, shall post in her office and publish in an official newspaper of the Borough notice of the locations of the Mount Ephraim Construction Code Enforcing Agency, together with, upon adoption of a designating resolution by the Borough Council, the names, addresses and business telephone numbers of the code office and all subcode officials or their duly appointed designees.
D. 
Notwithstanding any provision of this chapter, the Borough Board of Commissioners, after consultation with the Borough Fire Marshal, shall adopt and provide for the enforcement of a firesafety maintenance code or the continuation of the enforcement of a firesafety maintenance code. Chapter 217 of the Laws of 1975 provides for the adoption and enforcement of a fire prevention subcode and shall apply to fire prevention in "related construction activities" which are defined as those which in any way may affect, pertain to or involve the issuance of a construction permit or initial certificate of occupancy under said Act. No firesafety maintenance code or the enforcement thereof shall in any way conflict with or otherwise affect the terms and enforcement of the State Uniform Construction Code adopted pursuant to the State Uniform Construction Code Act aforesaid.
E. 
Central permit office. The Borough of Mount Ephraim shall establish a central permit office under the direction and supervision of the Borough Construction Official, which office shall be of same location as the Mount Ephraim Construction Code Enforcing Agency. This office shall receive applications for construction permits and plan review, issue construction permits and certificates of occupancy, collect fees, penalties, fines and issue notices and orders. The office shall be opened at a time to be determined by the Construction Official. This shall be posted in a conspicuous place and shall be comparable with the amount of construction activity in the Borough. Nothing herein shall prevent the Borough from establishing branch offices, but the public shall not, unless in the case of an emergency or unforeseen or unavoidable circumstances, be required to do business except at the central office.
A. 
The fee schedules as established by the State of New Jersey pursuant to the Uniform Construction Code and its attendant administrative regulations are hereby established as the fee schedules for the Borough of Mount Ephraim for the Borough's building subcode fee schedule, plumbing subcode fee, electrical subcode fee, fee for demolition for the removal of a building or structures and fee for certificate of occupancy with the following exception: the minimum fee for all subcodes shall be set forth in Chapter 165, Article II, Fee Schedule. A copy of said fee schedules shall be available for public display in the Construction Code office of the Borough of Mount Ephraim, County of Camden and State of New Jersey.

B. 
Preparation of biannual report. The Construction Official shall, with the advice of the subcode officials, prepare and submit to the Board of Commissioners biannually a report recommending a fee schedule based on the operation expenses of the Agency and any other expenses of the Agency and any other expenses of the Borough fairly attributable to the enforcement of the State Uniform Construction Code Act.
C. 
Collection of surcharge fees. In order to provide for the training, certifications and technical support programs required by the most recent editions of the Uniform Construction Code, the Construction Code Official of the Borough of Mount Ephraim shall collect, in addition to the fees specified above, a surcharge fee in the amount set forth by law.[2]
