It shall be unlawful for any home, apartment or residence to
install any garbage disposal unit which shall not first have been
approved by the Plumbing Inspector of the Borough of Mount Ephraim.
If said units are found acceptable, the Plumbing Inspector shall issue
permits for their operation and installation, giving due regard to
whether said units can be operated without overloading or otherwise
burdening the existing sewer system of the Borough. Said units shall
be so constructed and shall so function that they will not obstruct
or break down the sewer lines and system. If the Plumbing Inspector
shall determine that the said unit will operate in a manner which
will obstruct or break down said sewer lines or system, no permit
shall issue.
It shall be unlawful for any restaurant or other commercial
establishment engaged in the handling, preparation and serving of
foods to install or use a commercial garbage disposal unit after the
effective date of this article unless there shall first have been
filed with the Engineer of the Borough, plans and specifications of
said disposal unit; and the Plumbing Inspector and Engineer of the
Borough shall examine said plans to determine whether said disposal
unit can be operated without overloading or otherwise burdening the
existing sewer system of the Borough. Said units shall be so constructed
and shall so function that they will not obstruct or break down the
sewer lines and system. If the Engineer of the Borough shall determine
that said unit will operate in a manner which will obstruct or break
down said sewer line or system, no permit shall issue.
It shall be unlawful for any garbage disposal unit as described in §§
330-13 and
330-14, properly licensed under §§
330-13 and
330-14, to introduce materials which will obstruct and break down the sewer lines or system. This shall be true notwithstanding that, in itself, the disposal unit meets the tests prescribed in §§
330-13 and
330-14. For the purposes of this section, introduction by the disposal unit into the sewer lines of the hard shells or skeletons of seafood shall be deemed prima facie violation of this article, and the owner and user of said unit shall bear the burden of establishing to the satisfaction of the Plumbing Inspector that the introduction of these materials is in no way harmful as set forth above to the sewer lines or system.
The Plumbing Inspector, in accordance with §§
330-13 and
330-14, shall issue permits for the operation, installation and use of all garbage disposal units as described therein; in the issuance of said permits, he shall be guided by the general purposes of the sections, i.e., to prevent stoppage, overflow and breakdown in the sewer lines or system.

Violations of this article shall be punishable as provided in the penalty provisions contained in Chapter
305, Penalties.
