A. 
Leaf waste. All residential and commercial, industrial, or institutional establishments that gather leaves shall separate all leaf waste from municipal solid waste and place it for collection at the times and in the manner theretofore or hereafter prescribed by the Township.
(1) 
Leaf waste will be collected by the Township as appropriately advertised in the newspaper of general circulation.
(2) 
Leaf waste shall be deposited near the street cartway but not on the pavement or gravel surface of the street.
(3) 
In no instance shall leaf waste be deposited in any drainage swale, ditch, or wetland or on public property or others' property.
(4) 
In no instance shall leaf waste be permitted to be placed closer than 10 feet from any stormwater inlet, structure, or other feature.
(5) 
In the event that a property configuration does not provide for a suitable location to place leaf waste for collection, the Public Works Director may designate a placement of leaf waste as close to the property line as possible; furthermore, the property owner shall authorize access to the property by the Township for leaf waste collection.
B. 
Brush waste. All residential and commercial, industrial, or institutional establishments that gather brush waste shall separate all brush waste from municipal solid waste and place it for collection at the times and in the manner theretofore or hereafter prescribed by the Township.
(1) 
Brush waste will be collected by the Township as appropriately advertised in the newspaper of general circulation.
(2) 
Brush waste must be placed in unobstructed, reasonable piles or bundles (cut ends toward the street) immediately behind the street curb, if one exists; if no curb exists, brush waste must be placed near the street cartway but not on the pavement or gravel surface of the street.
(3) 
In no instance shall brush waste be permitted to be placed closer than 10 feet from any storm water inlet, structure, or other feature.
(4) 
In no instance shall brush waste be deposited in any drainage swale, ditch, or wetland or on public property or others’ property.
(5) 
In the event that a property configuration does not provide for a suitable location to place brush waste for collection, the Public Works Director may designate a placement of brush waste as close to the property line as possible; furthermore, the property owner shall authorize access to the property by the Township for brush collection.
(6) 
All brush waste must be placed curbside prior to the start of scheduled collections.
(7) 
Accumulations or piles of brush waste and/or organic materials are prohibited, except in properly maintained composting containers or a confined area.
(8) 
This article shall not apply to independent contractors working on behalf of Township residents. The Township shall not collect brush waste set at the curb by such contractors. Any contractor working within the Township must remove all brush waste without the assistance or obligation of the Township.
C. 
Grass clippings. All residential customers and commercial, industrial or institutional establishments which mow and subsequently collect grass clippings from their lawns shall separate all grass clippings from municipal solid waste. All persons responsible for grass cutting are encouraged to recycle the clippings on the lawn as mulch or through composting. All grass clippings not left on the lawn or privately composted shall be deposited at Township-designated grass recycling drop-off locations. No leaf waste, brush waste, or other non-grass materials are permitted at the Township-designated dropoff locations. The Township-designated grass recycling dropoff locations are for the sole use of Township residents and businesses for grass clippings originating in the Township.
D. 
Nothing herein shall require any person to gather leaf waste, brush waste, or grass clippings or prevent any person from utilizing such for compost, mulch, or other agricultural, horticultural, silvicultural, gardening, or landscape purposes.
A. 
Such person shall, within seven days after the delivery, mailing, or leaving of such notice, make settlement by paying to College Township a sum as specified in Chapter A203, by Township resolution, which may from time to time be amended. Upon the failure of such person to make settlement, as aforesaid, within seven days, the Township may institute an action for violation pursuant to § 172-39B.
B. 
Any person failing to comply with the provisions of § 172-39A shall, upon conviction by a Magisterial District Judge, be subject to a fine of not less than $100 nor more than $1,000, together with the cost of prosecution (including reasonable attorney's fees), or imprisonment in the Centre County Prison for a period of not more than 30 days. If the defendant neither pays nor timely appeals the judgment, the municipality may enforce the judgment pursuant to the applicable rules of procedure. Every violator of the provisions of this article shall be deemed guilty of a separate offense each and every day such violation continues and shall be subject to the penalty imposed by this section for each and every separate offense.
In addition to the foregoing penalty, the Township may require the owner or occupant of a property to remove any accumulation of leaf waste, brush waste, and/or grass clippings, as identified under Chapter 172, and should said person fail to remove such waste after seven days following written notice, the Township may cause the waste to be collected and disposed of with the cost for such action to be charged to the owner or occupant of the property. Failure by the owner or occupant of the property to pay said charges within 30 days will result in a lien being filed against the property for said charges, including any associated legal costs incurred by the Township relative to performing said action.
Should any section, paragraph, sentence, clause, or phrase of this article be declared unconstitutional or invalid for any reason, the remainder of this article and chapter shall not be affected thereby.
