This chapter shall be known as the "Snowmobile Regulations of
the Town of LaFayette."

Owners, operators and drivers of snowmobiles on the Town of
LaFayette's snowmobile trail system shall fully comply with Title
D, Articles 21 and 25, of the Parks, Recreation and Historic Preservation
Law of the State of New York. If at any time there is a conflict between
the provisions of this chapter and the provisions of the Parks, Recreation
and Historic Preservation Law, the more restrictive provision shall
apply and the more severe penalty for a violation shall apply.

A. Pursuant to Parks, Recreation and Historic Preservation Law § 25.03,
snowmobiles may be operated on the shoulders and other specifically
designated portions of the following Town highways in the Town of
LaFayette, and no others: (Reserved)
B. The shoulders and designated portions of the above highways are hereby
determined to be uncongested and safe for snowmobile travel, by virtue
of their rural character, and subject to posting in accordance with
regulations of the Parks, Recreation and Historic Preservation Department
pursuant to Title D of the Parks, Recreation and Historic Preservation
Law.

Pursuant to Parks, Recreation and Historic Preservation Law
§ 25.09, the following regulations are effective:
A. The regulations established by this section shall apply to the operation
of snowmobiles on publicly owned lands, waters, property and public
streets and highways in the Town of LaFayette.
B. No snowmobile shall be operated on publicly owned lands, waters, streets or highways in the Town by any person who shall not have attained his 16th birthday, except that a person between the age of 14 years of age and 16 years of age who holds a snowmobile safety certificate issued pursuant to Parks, Recreation and Historic Preservation Law § 25.19, a snowmobile liability and property damage insurance certificate pursuant to Subsection
C of this section and is accompanied by his parent or guardian on the same or a companion snowmobile shall be allowed to operate a snowmobile on publicly owned lands, waters, streets or highways duly authorized for snowmobile operation in the Town of LaFayette.
C. No snowmobile shall be operated on publicly owned lands, waters,
streets or highways in the Town unless the owner thereof shall have
in force snowmobile liability and property damage insurance written
by an insurance carrier authorized to do business in this state. Such
insurance shall have limits not less than $10,000 because of bodily
injury or death of one person, $20,000 because of bodily injury or
death of two or more persons in one accident and $5,000 because of
injury to or destruction of property of others in one accident. Proof
of such financial responsibility in the form of a valid, current certificate
issued by such insurance carrier shall be in the possession of the
owner or operator of any such snowmobile and shall be exhibited for
inspection and copying upon the request of any person.
D. No snowmobile shall be operated on publicly owned lands, waters,
streets or highways in the Town except during the hours designated
by resolution of the Town Board of the Town of LaFayette for such
operation.
E. Pursuant to this chapter and Parks, Recreation and Historic Preservation
Law § 25.09, the Town Board of the Town of LaFayette may,
from time to time, by resolution permit the operation of snowmobiles
on the roadway, shoulder or inside bank of other Town highways whose
outside bank or slope is determined to be impassable, provided said
highway, or portions thereof, is fully posted in accordance with regulations
of the Parks, Recreation and Historic Preservation Department pursuant
to such section.

Any person, firm or corporation who or which violates any provision of this chapter shall be guilty of an offense and subject to penalties as set forth in Chapter
1, Article
II, General Penalty, of the Town Code. The foregoing penalties are separate from and in addition to penalties prescribed by any other applicable statute, local law or regulation.
