A. 
The purpose of this section is to protect public health, safety and welfare, and to prevent contamination of groundwater by assuring that unused, unsafe or noncomplying wells, or wells which may act as conduits for contamination of groundwater, or wells which may be illegally cross-connected to the municipal water system, are properly abandoned.[1]

B. 
All wells on premises served by the municipal water system shall be abandoned in accordance with the terms of this article and Ch. NR 812, Wis. Admin. Code, no later than 30 days following connection to the municipal water system, unless a well operation permit has been obtained by the well owner from the Village of Coloma. In the event an owner fails to abandon all wells as required within 30 days after receiving written notice by the Village, the Village may complete or cause to be completed any work necessary to bring the property into compliance, and charge the costs thereof to the owner of the premises. Such charges shall be due in 30 days. Charges not paid in full may be applied as lien upon the property.
C. 
Well operation permit. The Village may grant a permit to a private well owner to operate a well, provided that the conditions of this article are met. The Village, or its agent, may conduct inspections or have water quality tests conducted at the applicant's expense to obtain or verify information necessary for consideration of a permit application. The following conditions must be met for issuance of a well operation permit:
(1) 
The well and pump installation meet or are updated to meet NR Ch. 812, Wis. Admin. Code.
(2) 
The well has a history of producing bacteriologically safe water as evidenced by at least two samplings taken a minimum of two weeks apart.
(3) 
There are no cross-connections between the well and pump installation and the municipal water system.
(4) 
The proposed use of the well and pump installation can be justified as being necessary in addition to water provided by the municipal water system.
