There shall be a Department of Administration, the head of which shall be the Business Administrator. The Business Administrator shall be appointed by the Mayor with the advice and consent of Council. The Business Administrator shall be chosen solely on the basis of his or her executive and administrative qualifications with special reference to his or her actual experience in, or his or her knowledge of, accepted practice in respect to the duties of his or her office. The Business Administrator shall either have a bachelor's degree from a recognized, accredited college or university, or commensurate relevant experience. In addition to these requirements, the Business Administrator shall have at least five years of responsible experience in an executive or administrative position.
The Business Administrator, under the direction and supervision of the Mayor, shall:
A. 
Assist in the preparation of the budget.
B. 
Administer a centralized purchasing system.
C. 
Be responsible for the development and administration of a sound personnel system.
D. 
Perform such other duties as Council may prescribe as delineated by ordinance.
The term of the Business Administrator shall be for the term of the Mayor appointing him or her, and until the appointment and qualification of his or her successor. His or her annual compensation shall be fixed by Council in accordance with the current Salary Ordinance,[1] as determined by resolution. The Business Administrator may enter into an employment agreement with the Township to be negotiated by the Mayor and approved by the Township Council.

The Business Administrator shall, subject to the direction of the Mayor, supervise the administration of each of the departments created and established in this chapter. For this purpose, he or she shall have power to investigate the organization and operation of any and all departments, to prescribe standards and rules of administrative practice and procedure, and to consult with the heads of the departments under his or her jurisdiction, provided that with respect to any department of law or department of audit, accounts or control, the authority of the business administrator under this section shall extend only to matters of budgeting, personnel and purchasing.
A. 
There is hereby established the Division of Purchasing, the head of which shall be the Purchasing Agent. The Purchasing Agent shall meet the qualifications necessary for qualified purchasing agent pursuant to N.J.S.A. 40A:11-9. The Business Administrator shall supervise the centralized purchasing system as established within the Division of Purchasing.
B. 
The Purchasing Agent shall:
(1) 
Prepare and enforce specifications for the purchase of materials and supplies. For purchases which require public bidding, or solicitation of quotations for amounts more than 50% of the current statutory bid threshold, specifications must be approved by resolution prior to the issuance, publication or release of said specifications and prior to the request for receipt of bids.
(2) 
Advertise for bids and seek quotations on prices for the purchase of materials and supplies.
(3) 
Receive bids and quotations and make appropriate recommendations to the Township Council.
(4) 
Prepare contractual and related documentation for the approval of the Township Council and supervise the execution of the same.
(5) 
Administer the performance of all municipal contracts.
(6) 
Inspect or supervise the inspection of all materials and supplies, the rendition of contractual services and determine their quality, quantity and conformity with specifications.
(7) 
Manage any central storeroom or storerooms or warehouse or warehouses that exist or may be established by the Township.
(8) 
Purchase, store and distribute all materials and supplies and contract for all services required by any Township department, office or agency.
(9) 
Arrange and supervise the sale of Township personal property or property in the possession of the Township, pursuant to law.
(10) 
Supervise and administer all joint purchasing agreements between the Township and other contracting units of the State of New Jersey.
(11) 
Prepare prebidder specifications, regulations and standard questionnaires for bidders, subject to the approval of the Township Council.
(12) 
Use the fair and open process approved by the governing body according to N.J.S.A. 19:44A-1 et seq., to recommend the award of a contract for any purchase over $17,500 and up to the bid threshold.
(13) 
Perform such other duties as directed by the Business Administrator.
C. 
Nothing contained herein shall require the Division of Purchasing or the Purchasing Agent to prepare specifications and contractual documentation or supervise the execution and performance of contracts for public works or improvements under the jurisdiction of the Municipal Engineer.
D. 
There is hereby created the position of Assistant Purchasing Agent. The Assistant Purchasing Agent shall assist the Purchasing Agent in fulfilling the functions enumerated herein.
All purchases made and contracts awarded through the Division of Purchasing for any supplies or materials or contractual services shall be pursuant to a requisition from the Director of the Township department, office or agency whose appropriation will be charged. No purchase shall be made nor obligation incurred unless the Chief Financial Officer certifies that a sufficient unencumbered balance or appropriation is available to pay therefor. Purchase order requisitions shall be established and prepared by the Division of Purchasing in accordance with purchasing procedures and policies manual as adopted by resolution, no later than 90 days after the effective date of the adoption of this chapter.
A. 
All purchases made by the Purchasing Agent shall conform to the requirements of the N.J.S.A. 40A:11-1 et seq., and all specifications shall be drafted in a manner to encourage free, open and competitive bidding.
B. 
Whenever practicable, materials and contractual services shall be procured through the Division of Purchase and Central Services under state contract procedures.
A. 
The Purchasing Agent is authorized to advertise for and receive bids in connection with all purchases, contracts or agreements, in accordance with the provisions of the Local Public Contracts Law.[1] The Township Council shall be the contracting agent and shall award such contracts and purchases as may be recommended by the Purchasing Agent.

B. 
The Purchasing Agent shall determine the method of presenting bids, except that such method shall be confined to either personal presentation at bid opening or by registered mail. In either case, the method shall be stated in the public advertisement and, if by registered mail, proper safeguards shall be provided to ensure the security of bids. Bids received after the time stated in the advertisement shall be considered as nonresponsive and shall be returned unopened to the sender.
C. 
All bids will be opened by the Purchasing Agent in public in accordance with the bid specifications and applicable law. A record shall be kept of the bid openings, and the same shall be available to the public.
D. 
Following review and evaluation of the bids, the Purchasing Agent shall recommend the lowest qualified bidder to the Township Council, which shall award the contract or take such other action as it deems proper.
There is hereby created within the Department of Administration the Division of Information Technology Services.
The Division of Information Technology Services shall:
A. 
Operate the centralized data processing services for all departments and offices of the Township, including the operation of the Township payroll system, as well as manage and administer LAN's (local area networks) and WAN's (wide area networks) for all Township departments and offices, including the Department of Public Safety, as may be applicable.
B. 
Maintain all Township disbursement and budget records, such as budget summaries, bill lists and vendor analyses, and administer and manage all computerized systems to include financial, accounting and tax collection systems, engineering systems, building systems, public words systems, law enforcement, recreation, human resources, GIS, mobile and wireless, web commerce, voice and data communications, as may be applicable.
C. 
Maintain all Township computer hardware, software, and servers, including recommending any upgrades of the Township computer system.
D. 
Maintain the official Township of Jackson website.
E. 
Create programming and systems in-house or advise as to the need for purchases of systems from third-party vendors.
F. 
Review departmental requests for software and hardware and make recommendations.
G. 
Perform such other duties as directed by the Business Administrator.
There is hereby created a Division of Finance within the Department of Administration, the head of which shall be the Chief Financial Officer. His or her compensation shall be set in accordance with the current Salary Ordinance.[1]

A. 
No person shall be appointed or reappointed as a Chief Financial Officer unless he or she holds a municipal finance officer's certificate pursuant to N.J.S.A. 40A:9-140.2 or he or she has been previously granted tenure in the position pursuant to N.J.S.A. 40A:9-140.13. Appointment to the position of Chief Financial Officer shall be pursuant to the terms of N.J.S.A. 40A:9-140.10.
B. 
The Chief Financial Officer shall be appointed for a term of four years, effective as of the first day of January of the year of appointment. The Chief Financial Officer shall be appointed by the Mayor with the advice and consent of the Township Council.
C. 
Duties. The Chief Financial Officer shall perform such duties as delineated within the applicable statutes, administrative regulations and rules and procedures as established by the Department of Community Affairs, Local Finance Board.
There is hereby created the position of Assistant Municipal Treasurer. The Assistant Municipal Treasurer shall, under the direction and supervision of the Chief Financial Officer, perform the following duties:
A. 
Prepare written answers to routine correspondence and memorandums.
B. 
Automated payroll coordination.
C. 
Cash reconciliations and proof verification.
D. 
Prepare bill lists for review by the Chief Financial Officer.
E. 
Assist the Chief Financial Officer in preparing reports and cost analysis of Township operations.
F. 
Prepare budget variance reports for the purpose of monitoring departmental expenditures in comparison to departmental budget resources.
G. 
Monitor and verify all inventories, with fixed asset inventories conducted in accordance with the Technical Accounting Directives issued by the Local Finance Board.
H. 
Assist the Chief Financial Officer in preparing statistical information for the investment of Township funds on a daily basis.
I. 
Maintain an inventory of all property owned by the Township and have custody of all municipal personal property.
J. 
Any other duties as may be assigned by the Chief Financial Officer and the Business Administrator.
A. 
Under the direction and supervision of the Chief Financial Officer, the Division of Finance shall:
(1) 
Assist the Mayor and Business Administrator in the preparation of and supervision of the administration of the municipal operating and capital budget for submission to Township Council.
(2) 
Establish and uniformly enforce a system of accounts and controls for municipal financial operations of the Township.
(3) 
Using statistical, demographic and economic data, prepare long-range financial projections of expenditures, need for capital projects and facilities, need for particular services and other long-range financial and service needs projections for the information of the Township Council, Mayor and Business Administrator.
(4) 
Prepare and prescribe uniform forms and procedures for the budget preparation and payment processes for all departments and other appropriate spending agencies of the Township.
(5) 
Have custody of all Township funds and maintain all records of disbursements of the Township.
(6) 
Prepare all documents and make recommendations to the Township Council as to all transfer and emergency appropriations and prepare all necessary capital budget appropriation documents under the supervision of Township bond counsel.
(7) 
May serve on the Township negotiation team as fiscal advisor.
(8) 
Establish and supervise a program of contract cost administration for the purchase of goods and services.
(9) 
Develop and install records and procedures to enable each department to prepare workload and performance reports, expressed in appropriate work units, to be used for budgeting purposes.
(10) 
Evaluate and make recommendations, from a budgetary viewpoint, of various municipal programs and administer budgetary controls as to all financial assistance received by the Township.
(11) 
Maintain and enforce a system of budget control and cost analysis for budgetary items and, in this regard, conduct inquiries on behalf of the Township and report to the Township Council as to fiscal irregularities.
(12) 
Conduct a continuing performance audit for municipal operations for determining quality of work and devising improvements in efficiency and economy.
(13) 
Invest all available Township of Jackson funds in order to obtain the highest possible return thereon.
(14) 
Perform such other duties as directed by the Business Administrator.
A. 
Division of Revenue Collections. There is hereby created, within the Department of Administration, the Division of Revenue Collections, the head of which shall be the Tax Collector. The Division of Collection shall be responsible for:
(1) 
Charging and collecting payments as well as any penalties for delinquent payments for real estate taxes, pursuant to law.
(2) 
Enforcing all municipal liens and charges, including the undertaking of any in rem foreclosure and tax sale proceedings.
(3) 
Certifying searches for taxes and other liens on real property as may be authorized by law.
(4) 
Perform such other duties as directed by the Business Administrator.
B. 
Tax Collector. There is hereby created the office of Tax Collector of the Township of Jackson pursuant to N.J.S.A. 40A:9-142.
(1) 
Appointment and term of office. The Tax Collector shall be appointed by the Mayor, with the advice and consent of the Township Council, and shall serve a term of office of four years commencing on January 1 of the year of appointment and ending on December 31 of the fourth year, or until a successor shall be appointed and qualified. A vacancy in the office of Tax Collector, other than due to expiration of term, shall be filled by appointment for the unexpired term. The Tax Collector shall possess a Tax Collector certificate pursuant to N.J.S.A. 40A:9-145.7.
(2) 
Duties. The duties of the Tax Collector shall be as prescribed by law. The Tax Collector shall perform such other duties which are related to his or her work as are prescribed by the Mayor and Township Council, and shall be a full-time employee.
C. 
Assistant Municipal Tax Collector. There is hereby created the position of Assistant Municipal Tax Collector of the Township of Jackson, whom shall be the Collector of Arrears of Taxes pursuant to N.J.S.A. 40A:9-143.
(1) 
Appointment and term of office. The Assistant Municipal Tax Collector shall be appointed in accordance with N.J.S.A. 40A:9-143 and shall serve a term of office of four years, commencing on January 1 of the year of appointment and ending on December 31 of the fourth year, or until a successor shall be appointed and qualified.
(2) 
Duties. The Assistant Municipal Tax Collector shall work in conjunction with and under the direction of the Tax Collector. The Assistant Municipal Tax Collector shall perform all duties and functions as directed by the Tax Collector and, in the absence of the Tax Collector, shall perform all of the duties of the office of Tax Collector.
There is hereby created within the Department of Administration, the Division of Personnel, the head of which shall be the Personnel Officer.
The Division of Personnel shall be responsible for:
A. 
Develop and administer the Township's personnel program, including up-to-date job classifications and pay plans, active recruitment of needed personnel and in-service training programs.
B. 
Design, install and maintain personnel records for each Township officer and employee, including a job description and qualifications required, the education, training and experience of the employee, any professional or trade licenses held, all personnel actions taken with respect to the employee, compensation, pension status, the Merit System Board and any other such information deemed pertinent at the discretion of the Personnel Officer.
C. 
Develop, install and administer an orderly procedure for the consideration, review and adjustment of employee grievances subject to any requirements in collective bargaining agreements.
D. 
Coordinate the processes of appointment and removal of municipal employees within the various departments with department heads, the Business Administrator and the Mayor and, to this end, review and recommend proposed procedures.
E. 
Maintain a continuing review and analysis of budget operations, work programs and costs of municipal services.
F. 
As directed by the Mayor or Business Administrator, assign and transfer employees temporarily, from one department to another as efficient administration may require.
G. 
Develop, prescribe and enforce rules and regulations for the efficient management of the Township government, so as to avoid any duplication or overlapping of effort among the departments or among units within a department, and for the improvement of methods and procedures of administration.
H. 
May conduct entrance and exit interviews of employees.
I. 
Attend meetings and conferences at the request of Council.
J. 
Monitor labor relations and negotiations and regularly advise the Municipal Attorney of any labor issues.
K. 
Monitor and administer employee fringe benefit programs, as applicable.
L. 
May conduct a desk audit of all positions to determine whether duties and responsibilities correspond to job classifications and salary grade.
There is hereby created the position of Municipal Insurance Representative within the Department of Administration.
The Municipal Insurance Representative shall advise the Mayor and Township Council on insurance matters. The Municipal Insurance Representative shall serve at a yearly compensation of $1, with no other compensation or benefits. In the event the Commissioners vote to compensate the representatives in an amount over $1, the amount over $1 shall be reimbursed to the Township. The Municipal Insurance Representative shall be appointed by the Mayor, with the advice and consent of Council, in accordance with N.J.S.A. 40A:10-37 to serve as a Commissioner of the Joint Municipal Insurance Fund.
If the Municipal Insurance Representative is a member of the governing body, he or she shall hold office for two years or for the remainder of his or her term of office as a member of the Township Council, whichever shall be less, and until his or her successor shall have been duly appointed and qualified. If the Municipal Insurance Representative is an employee of the Township of Jackson, he or she shall hold office at the pleasure of the Mayor and Township Council. In the event of a vacancy caused by any reason other than expiration of the term as a member of the Township Council, the office shall be filled by the Mayor, with the advice and consent of Council.

A. 
Purpose. The purpose of this section is to create the administrative mechanisms needed for the execution of the Township of Jackson's responsibility to assist in the provision of affordable housing pursuant to the Fair Housing Act of 1985.[1]

B. 
Definitions. As used in this section, the following terms shall have the meanings indicated:
ADMINISTRATIVE AGENT
The entity responsible for administering the affordability controls of some or all units in the affordable housing program for the Township of Jackson to ensure that the restricted units under administration are affirmatively marketed and sold or rented, as applicable, only to low- and moderate-income households.
MUNICIPAL HOUSING LIAISON
The employee charged by the governing body with the responsibility for oversight and administration of the affordable housing program for the Township of Jackson.
C. 
Establishment of position and compensation; powers and duties.
(1) 
Establishment of position of Municipal Housing Liaison. There is hereby established the position of Municipal Housing Liaison for the Township of Jackson.
(2) 
Subject to the approval of the Council on Affordable Housing (COAH) and/or the Superior Court of New Jersey, Ocean County, the Municipal Housing Liaison shall be appointed by the governing body and may be a full- or part-time municipal employee.
(3) 
The Municipal Housing Liaison shall be responsible for oversight and administration of the affordable housing program for the Township of Jackson, including the following responsibilities which may not be contracted out, exclusive of Subsection C(3)(f) which may be contracted out:
(a) 
Serving as the Township of Jackson's primary point of contact of all inquiries from the state, affordable housing providers, administrative agents, and interested households;
(b) 
Monitoring the status of all restricted units in the Township of Jackson's fair share plan;
(c) 
Compiling, verifying, and submitting annual reports as required by COAH;
(d) 
Coordinating meetings with affordable housing providers and administrative agents, as applicable;
(e) 
Attending continuing education opportunities on affordability controls, compliance monitoring, and affirmative marketing as offered or approved by COAH;
(f) 
If applicable, serving as the administrative agent for some or all of the restricted units in the Township of Jackson as described in Subsection C(6) below.
(4) 
Subject to approval by COAH, the Township of Jackson may contract with or authorize a consultant, authority, government or any agency charged by the governing body, which entity shall have the responsibility of administering the affordable housing program of the Township of Jackson, except for those responsibilities which may not be contracted out pursuant to Subsection C(3) above. If the Township of Jackson contracts with another entity to administer all or any part of the affordable housing program, including the affordability controls and affirmative marketing plan, the Municipal Housing Liaison shall supervise the contracting administrative agent.
(5) 
Compensation. Compensation shall be fixed by the governing body at the time of the appointment of the Municipal Housing Liaison.
(6) 
Administrative powers and duties assigned to the Municipal Housing Liaison. The Municipal Housing Liaison shall perform the duties set forth in Subsection C(3) above and shall also oversee the duties of the Affordable Housing Administrator as set forth as follows:
(a) 
Affirmative marketing.
[1] 
Conducting an outreach process to insure affirmative marketing of affordable housing units in accordance with the affirmative marketing plan of the Township of Jackson and the provisions of N.J.A.C. 5:80-26.15; and
[2] 
Providing counseling or contracting to provide counseling services to low- and moderate-income applicants on subjects such as budgeting, credit issues, mortgage qualification, rental lease requirements, and landlord/tenant law.
(b) 
Household certification.
[1] 
Soliciting, scheduling, conducting and following up on interviews with interested households;
[2] 
Conducting interviews and obtaining sufficient documentation of gross income and assets upon which to base a determination of income eligibility for a low- or moderate-income unit;
[3] 
Providing written notification to each applicant as to the determination of eligibility or noneligibility;
[4] 
Requiring that all certified applicants for restricted units execute a certificate substantially in the form, as applicable, of either the ownership or rental certificates set forth in Appendixes J and K of N.J.A.C. 5:80-26.1 et seq.;
[5] 
Creating and maintaining a referral list of eligible applicant households living in the housing region and eligible applicant households with members working in the housing region where the units are located; and
[6] 
Employing the random selection process as provided in the affirmative marketing plan of the Township of Jackson when referring households for certification to affordable units.
(c) 
Affordability controls.
[1] 
Furnishing to attorneys or closing agents forms of deed restrictions and mortgages for recording at the time of conveyance of title of each restricted unit;
[2] 
Creating and maintaining a file on each restricted unit for its control period, including the recorded deed with restrictions, recorded mortgage and note, as appropriate;
[3] 
Ensuring that the removal of the deed restrictions and cancellation of the mortgage note are effectuated and properly filed with the appropriate county's register of deeds or county Clerk's office after the termination of the affordability controls for each restricted unit;
[4] 
Communicating with lenders regarding foreclosures; and
[5] 
Ensuring the issuance of continuing certificates of occupancy or certifications pursuant to N.J.A.C. 5:80-26.10.
(d) 
Resale and rental.
[1] 
Instituting and maintaining an effective means of communicating information between owners and the administrative agent regarding the availability of restricted units for resale or rental; and
[2] 
Instituting and maintaining an effective means of communicating information to low- and moderate-income households regarding the availability of restricted units for resale or re-rental.
(e) 
Processing request from unit owners.
[1] 
Reviewing and approving requests from owners of restricted units who wish to take out home equity loans or refinance during the term of their ownership;
[2] 
Reviewing and approving requests to increase sales prices from owners of restricted units who wish to make capital improvements to the units that would affect the selling price, such authorizations to be limited to those improvements resulting in additional bedrooms or bathrooms and the cost of central air-conditioning systems; and
[3] 
Processing requests and making determinations on requests by owners of restricted units for hardship waivers.
(f) 
Enforcement.
[1] 
Securing annually lists of all affordable housing units for which tax bills are mailed to absentee owners and notifying all such owners that they must either move back to their unit or sell it;
[2] 
Securing from all developers and sponsors of restricted units, at the earliest point of contact in the processing of the project or development, written acknowledgement of the requirement that no restricted unit can be offered, or in any other way committed, to any person, other than a household duly certified to the unit by the administrative agent;
[3] 
The posting annually in all rental properties, including two-family homes, of a notice as to the maximum permitted rent together with the telephone number of the administrative agent where complaints of excess rent can be made;
[4] 
Sending annual mailings to all owners of affordable dwelling units, reminding them of the notices and requirements outlined in N.J.A.C. 5:80-26.18(d)4;
[5] 
Establishing a program for diverting unlawful rent payments to the municipality's affordable housing trust fund or other appropriate municipal fund approved by the DCA;
[6] 
Creating and publishing a written operating manual, as approved by COAH, setting forth procedures for administering such affordability controls; and
[7] 
Providing annual reports to COAH as required.
(g) 
The administrative agent shall have authority to take all actions necessary and appropriate to carry out its responsibilities hereunder as supervised by the Municipal Housing Liaison.

A. 
Establishment. There is hereby created a Division of Code Compliance consisting of Code Enforcement, Housing and Animal Control, the head of which shall be the Code Compliance Supervisor.
B. 
Duties of the Division. The Division of Code Compliance shall:
(1) 
Conduct field inspections and special investigations to ensure compliance with various municipal ordinances.
(2) 
Initiate and enforce rules and regulations in relation to enforcement of ordinances.
(3) 
Enforcing the provisions of the Township animal control ordinances and the state statutes, including, but not limited to, the taking into custody, impounding, and adoption of animals, as well as licensing.
(4) 
Perform any other such function as necessary to administer the purpose of this Department.
(5) 
Act as liaison for the Rent Leveling Board.
C. 
Creation of position. There is hereby established within the Township of Jackson the position of Code Compliance Supervisor. Said position shall be the division head for the Division of Code Compliance.
D. 
Appointment. The Division of Code Compliance Supervisor shall be appointed by the Mayor. The Supervisor shall report directly to the Township Business Administrator.
E. 
Duties of Code Compliance Supervisor. The Code Compliance Supervisor:
(1) 
Plans, coordinates, staffs, prioritizes, monitors, directs, evaluates and participates in the Township's code enforcement activities, involving zoning ordinances, housing codes, public nuisances, property maintenance, abandoned vehicles, animal control, license regulations and other issues relating to health, safety and welfare of the community; ensures safe work practices, work quality and accuracy.
(2) 
Assures that assigned areas of responsibility are consistent with local, state and federal regulations; stays current on related policies, regulations and trends.
(3) 
Participates in the development of policies and procedures; develops and recommends programs and projects.
(4) 
Participates in the selection and training of personnel; assumes responsibility for motivating and evaluating assigned personnel; provides necessary training; initiates discipline procedures as is appropriate.
(5) 
Develops schedules and methods for performing assigned duties; assigns work to staff; monitors work activities to ensure safe work practices, work quality and accuracy; ensures compliance with applicable rules, policies and procedures; maintains appropriate work records and documents which may include time sheets and work orders; prepares statistical and/or analytical reports on operations as necessary.
(6) 
Participates in the development of assigned budget; administers and monitors the approved budget; maintains supply inventories and supply and budgetary records.
(7) 
Addresses and responds to service questions, inquiries and complaints; establishes and maintains a customer orientation with assigned division.
(8) 
Establishes positive working relationships with representatives of community organizations, state/local agencies and associations, Township management, staff, and the public.
(9) 
Performs related duties and responsibilities as assigned.
F. 
Qualifications. The qualifications necessary for a person to be appointed to the position of Code Compliance Supervisor shall be as follows:
(1) 
Education:
(a) 
Graduation from an accredited college or university with a bachelor's degree.
(b) 
Applicants who do not meet the educational requirement may substitute additional work experience as described below, on the basis of one year of such experience being equal to 30 semester hour credits.
(2) 
Experience:
(a) 
Two years of experience in zoning involving the issuance of permits and enforcement of zoning ordinances and regulations.
(b) 
Possession of a master's degree in business administration from an accredited college or university may be substituted for one year of the above-required work experience.
G. 
Creation of position. There is hereby established within the Township of Jackson the position of Code Enforcement Officer within the Division of Code Compliance.
H. 
Duties of the Code Enforcement Officer. The Code Enforcement Officer shall have the following duties:
(1) 
Responsible for enforcing the municipal ordinances and codes of the Township.
(2) 
Responsible for reviewing the municipal ordinances of the Township on a continuing basis and to making periodic reports to the Division head or director, not less than once every six months, advising the Division head or director as to recommendations for new ordinances or regulations or the amendment of existing ordinances or regulations of the Township of Jackson.
(3) 
To attend all meetings of the Planning Board, Board of Adjustment and other meetings as required by the Code Compliance Supervisor.
(4) 
To submit monthly reports to the Code Compliance Supervisor detailing work performance.
(5) 
To make investigations, serve violation notices, make and process complaints for code violations and make court appearances as necessary in connection therewith.
(6) 
To maintain files of all papers and records pertinent to work performance.
(7) 
To perform such other duties as may be prescribed by the Department of Personnel.
I. 
Creation of position. There is hereby established within the Township of Jackson the position of Animal Control Officer within the Division of Code Compliance.
J. 
Duties of the Animal Control Officer. There shall be an Animal Control Officer within the Division of Code Compliance. The duties of the Animal Control Officer shall include but not be limited to the following:
(1) 
Enforcing the provisions of the Township animal control ordinances and the state statutes, including, but not limited to, the taking into custody, impounding, adoption of animals.
(2) 
Overseeing the administration of the animal control, including but not limited to the keeping of needed records and files.
(3) 
Reporting weekly to the Code Enforcement Officer as to the operations of animal control.
(4) 
Licensing dogs, kennels, pet shops, shelters and pounds.
(5) 
Performing such other duties as may be prescribed by the Department of Personnel.

A. 
Establishment. There is hereby created a Division of Zoning, the head of which shall be the Zoning Officer, who shall be appointed by the Mayor and report directly to the Township Administrator.
B. 
Duties of the Division. The Division of Zoning shall:
(1) 
Conduct field inspections and special investigations to ensure compliance with various municipal ordinances.
(2) 
Initiate and enforce rules and regulations in relation to enforcement of ordinances.
(3) 
Perform any other such function as necessary to administer the purpose of this Department.
(4) 
Act as liaison to the Planning Board.
(5) 
Act as liaison to the Zoning Board of Adjustment.
(6) 
Coordinate and advise the Township as to zoning issues.
(7) 
For purposes of administration, the Planning Board Secretary, Zoning Board Secretary and other clerical support staff to each Board shall be under the auspices of the Division of Zoning.
C. 
Creation of position. There is hereby established within the Township of Jackson the position of Zoning Officer within the Division of Zoning.
D. 
Duties of the Zoning Officer.
(1) 
To enforce the zoning ordinances of the Township of Jackson.
(2) 
To issue zoning permits.
(3) 
To issue flood hazard letters in writing when requested.
(4) 
To answer all inquiries with regard to zoning.
(5) 
To keep a record of all applications for permits and of all permits and certificates issued, with a notation of all special conditions involved.
(6) 
To file and safely keep copies of all plans submitted.
(7) 
To collect and record fees for zoning permits and flood letters.
(8) 
To prepare a monthly report for the Mayor and Township Council summarizing all activity of the previous months concerning the duties of the Zoning Officer.
(9) 
The Zoning Officer shall conduct field inspections and special investigations to ensure compliance with various municipal ordinances, initiate and enforce rules and regulations in relation to enforcement of ordinances, initiate necessary legal action against violators of various municipal ordinances, prepare needed reports, establish and maintain the records and files and may assist in the promulgation of municipal ordinances.
E. 
Creation of position. There is hereby established within the Township of Jackson the position of Assistant Zoning Officer within the Division of Zoning.
F. 
Duties of the Assistant Zoning Officer.
(1) 
To assist the Zoning Officer to enforce the zoning ordinances of the Township of Jackson.
(2) 
To perform all of the duties of the Zoning Officer at his or her direction or in his or her absence.
(3) 
To perform such other duties as may be prescribed by the Department of Personnel.

A. 
Establishment. There shall be a Division of Engineering, the head of which shall be the Township Engineer.
B. 
Creation of position. There is hereby established with the Township of Jackson the position of Township Engineer.
C. 
Appointment. The Township Engineer shall be appointed by the Mayor. The Township Engineer shall report directly to the Township Business Administrator. Should the office become vacant during any term, it shall be filled by a similar appointment, but for the unexpired term only.
D. 
Responsibilities; duties. The Engineer shall perform the duties prescribed by general law and ordinance. He/she shall:
(1) 
Prepare or cause to be prepared plans, designs, specifications, reports, investigations and cost estimates for all public works improvements undertaken by the Township.
(2) 
Provide and maintain surveys, maps, plans, specifications and control records with respect to all public works facilities owned and operated by the Township.
(3) 
Provide technical and engineering advice and assistance to other Township departments as needed.
(4) 
Recommend to Administration the undertaking of needed capital projects within the Township.
(5) 
Assist in the formation and implementation of the Township capital budget.
(6) 
Assign, with the approval of the Mayor or Business Administrator, projects to the special consulting engineers that have been previously appointed by the governing body, and supervise the same.
(7) 
Direct and supervise all personnel with the division.
(8) 
He or she shall render to the Administrator Council such reports, recommendations, or other documents as may be required, at regular stated intervals or on special request therefor. He or she shall hold himself or herself available for consultation and advice to all municipal officials and municipal boards or commissions and shall prepare and present to the Administration short- and long-range recommendations for the improvement of the Township in the areas within the functions and duties of his or her Department.
E. 
Qualifications. The qualifications necessary for a person to be appointed to the position of Township Engineer shall be as follow:
(1) 
Education:
(a) 
Graduation from an accredited college or university with a bachelor's degree.
(b) 
Duly licensed as a professional engineer in the State of New Jersey for at least five years.
(2) 
Experience:
(a) 
At least five years' experience in state, county, regional or municipal engineering activities.
F. 
Surrender of Township property on termination of service. All papers, documents, memoranda, reports and other materials relating to the administration of engineering duties of the Engineer shall be and remain the property of the Township. Upon termination of his or her services with the Township, the Engineer shall forthwith surrender to any successor all such property.
G. 
Special consulting engineers. Whenever, in the opinion of the Municipal Engineer, special consulting engineers should be appointed for a specific or particular project or matter, the Municipal Engineer shall provide a recommendation in writing to the Mayor and Township Council. A special engineer may only be appointed by appointment of the Mayor and resolution of the Township Council.

There is hereby created a Division of Conservation and Natural Resources, the head of which shall be the Forester, who shall report directly to the Township Administrator. The Forester shall act as a liaison to the Environmental Commission, Historic Preservation Commission and the Shade Tree Commission, and shall have such duties as prescribed by the Code Compliance Supervisor and as delineated elsewhere throughout this chapter. The Forester need not be a full-time employee and shall be subject to such fees as shall be approved by the Council.

There is hereby created a Division of Economic Development within the Department of Administration. The Division shall actively seek out and advise the Mayor and Council of grants, funds and loans available for various projects and programs in the Township, including but not limited to, Community Development and Enforcement Block Grant Program administered by the Office of Housing and Urban Development. The Division shall also be responsible for developing strategies to attract commercial ratables and for making recommendations to Mayor and Council regarding such ratables.

A. 
Establishment. There is hereby created a Division of Construction, the head of which shall be the Construction Code Official, who shall report directly to the Township Administrator.
B. 
Creation of position. There is hereby established within the Township of Jackson the position of Construction Code Official.
C. 
Appointment. The Construction Code official shall be appointed by the Mayor. The Construction Code Official shall report directly to the Township Business Administrator. Should the office become vacant during any term, it shall be filled by a similar appointment, but for the unexpired term only.
D. 
Responsibilities; duties. The duties and responsibilities are listed, and the Construction Code Official shall:
(1) 
Undertake enforcement proceedings for all building-related codes, issuing and administering permits issued thereby and reviewing all site and construction plans as specified by state statute.
(2) 
Have, perform, and discharge all of the functions, powers, and duties prescribed by law for a construction official.
(3) 
Inspect real property and improvements thereon under the applicable code provisions, supervising the demolition of condemned buildings and performing such further duties prescribed by state statute.
(4) 
Administer the provisions of N.J.S.A. 52-27D-119 et seq., the State Uniform Construction Act, and N.J.A.C. 5:23-1 et seq., the regulations for the State Uniform Construction Code and the various subcodes provided therein, including but not limited to building subcode, plumbing subcode, and electrical subcode.
(5) 
Act as enforcing agent for the State Uniform Construction Code.
(6) 
Direct and supervise all personnel within the department.
(7) 
He or she shall render to the Administration such reports, recommendations, or other documents as may be required, at regular stated intervals or on special request therefor. He or she shall hold himself or herself available for consultation and advice to all municipal officials and municipal boards or commissions and shall prepare and present to the Administration short- and long-range recommendations for the improvement of the Township in the areas within the functions and duties of his or her Department.
E. 
Qualifications. The qualifications necessary for a person to be appointed to the position of Construction Code Official shall be as follows:
(1) 
License: must hold New Jersey Construction Code Official license.
(2) 
Experience: must have three years of municipal construction official experience.
F. 
Subcode officials. Within the Division of Construction, under the direction of the Construction Code Official there shall be subcode officials. Subcode officials shall enforce the provisions of those subcodes for which they are responsible in accordance with Part II and qualified in accordance with Part IV of the State Uniform Construction Code and for which they have been appointed. Each subcode official shall be responsible for the administration and enforcement of the appropriate subcode, subject to the procedures of the enforcing agency as administered by the Construction Official. However, each subcode official shall have exclusive decisionmaking authority with respect to the technical provisions of the subcode for which he or she has been appointed the official. The subcode official shall enforce the State Uniform Construction Code and all applicable municipal ordinances and shall:
(1) 
Review those aspects of the application, plans and specifications appropriate to his or her subcode for approval and release to the Construction Official for issuance of the permit.
(2) 
Receive and review directly from the applicant applications for minor or emergency work for approval and release to the Construction Official for issuance of the permit.
(3) 
Comply with the time limitations for review as determined by the Construction Official.
(4) 
Review requests for variations as necessary.
(5) 
Perform all required inspections within three business days of the time for which inspection has been requested.
(6) 
Issue in the name of the enforcing agency notices of violation and notify the Construction Official of the same. The subcode official may issue verbal orders at the job site and shall record such orders in his or her inspection report.
(7) 
Complete reports of all inspections performed.
(8) 
Issue stop-work orders in the name of the enforcing agency and notify the Construction Official of the same.
(9) 
Perform final inspections and notify the Construction Official of approval in order that the Construction Official may issue a certificate of occupancy.
(10) 
Make inspection, review submitted date and notify the Construction Official of approval in the case of a change of use or a request for a certificate of continued occupancy.
(11) 
Assist the Construction Official in the preparation of all reports required by the State Construction Code.
(12) 
Attend meetings and hearings as required by the state regulations.
(13) 
Issue documentation and certification, such as cut-in cards, to utilities and/or public agencies if required by state regulations.
(14) 
Carry out such other functions as are necessary and appropriate to the position of subcode official.
G. 
Procedure for collection of fines. Whenever the Construction Official, or appropriate subcode official, issues a notice of violation of the Uniform Construction Code, the following procedural steps shall be followed. It is intended that these internal procedures supplement and be used in conjunction with state regulations and not supersede said regulations.
(1) 
Unless public health and safety demands otherwise, a notice of violation shall allow 30 days for compliance. This compliance period may be extended by the Construction Official if the violator makes a good faith effort to effectuate compliance.
(2) 
Unless state regulations require the immediate issuance of a penalty, upon the failure to correct the violation prior to the expiration of the compliance period provided in Subsection G(1), a fine shall be assessed in the manner provided in state regulations.
(3) 
The amount of the fine assessed shall be in accordance with state regulations.
(4) 
If the fine is not paid within 30 days of assessment, the Construction Code Official shall refer the matter to the Township Council to authorize collection pursuant to N.J.S.A. 2A:58-10 et seq., through the Township Attorney.
(5) 
The Clerk shall keep a list of violators upon whom fines have been reduced to judgment. Prior to the execution of any purchase order, the Chief Financial Officer shall check the list of outstanding judgments. If the person or entity due monies under the purchase order has an outstanding judgment, then the Chief Financial Officer shall refer the matter, with appropriate documentation, to the Township Attorney for institution of necessary action to collect upon the outstanding judgment.

The Division of Recreation and Senior Services shall:
A. 
Administer the work of the Division, and administer and operate playgrounds, facilities for indoor and outdoor sports, athletic, cultural and recreational programs and activities for children, youth and adults of the Township, including celebration of events, holiday activities and summer camps; and where authorized by law and by ordinance of the Township Council, charge and collect on behalf of the Township a reasonable fee for each person for admission to or use of facilities, programs and activities provided for under this provision.
B. 
Use public school property by agreement with the Board of Education.
C. 
Plan and develop additional public recreational areas and facilities.
D. 
Cooperate with other municipal departments, service clubs and organizations in furthering recreational and cultural interests in the Township.
E. 
Adopt reasonable rules, regulations and bylaws, subject to approval of the Council, for the conduct of persons participating in programs and activities or utilizing recreation facilities or equipment sponsored by the Division.
F. 
Study, investigate, develop and recommend recreation programs in conjunction with the Recreation Committee.
G. 
Conduct studies of the present and future recreational needs of the Township and develop immediate and long-range plans in consultation with the Recreation Committee for recommendation to the Mayor and the Township Council.
H. 
Maintain such records as may be required to control Division receipts, property and personnel, and provide information to the Mayor for budgeting and financing of recreational programs. Such records shall include time cards, or the equivalent Township-approved time-tracking device, for part-time and seasonal personnel.
I. 
Be responsible to the Township Council for the proper custody and preservation of the books, records and property under the Division's control, and the faithful performance of the duties of the Division.
J. 
Submit to the Mayor and Business Administrator monthly reports concerning the conduct and progress of the Division, including receipts and monies.
K. 
Administer the expenditure of funds in accordance with the annual budget.
L. 
Hire part-time and seasonal staff as needed, with the approval of the Mayor, to carry out the functions of the Division.

A. 
Organization. There is hereby established within the Division of Recreation and Senior Services a Recreation Advisory Board, which shall consist of a number of representatives from various recreational organizations located within the Township as set forth below.
B. 
Membership. The Recreation Advisory Board shall consist of one representative, appointed by the Mayor with the advice and consent of the Township Council, from each organization substantially utilizing Township facilities. Those organizations shall include, but are not limited to, Jackson Little League, Jackson Soccer, Jackson Lacrosse, Jackson Roller Hockey, Holbrook Little League, American Youth Football and Recreation Softball.
C. 
Term. All members of the Recreation Advisory Board shall serve for the balance of the calendar year in the year of their initial appointment. Thereafter, all appointments to the Board shall be for a term of one year, expiring on December 31 of the year of appointment. All members shall be appointed by resolution. The Council liaisons to the Recreation Committee shall also serve as members of the Recreation Advisory Board.
D. 
Alternate members. The Mayor, with the advice and consent of the Township Council, may, by resolution, appoint one alternate member from each organization represented in the Recreation Advisory Board. Alternate members shall take the place of a member from the same organization unable to attend a meeting. The length of the terms of the alternate members shall be the same as the length of the terms of the regular members of the Board.
E. 
Compensation. The members of the Board shall serve without compensation.
F. 
Meetings; designation of Chairperson. The Recreation Advisory Board shall meet no less than twice per year to carry out the functions stated in Subsection G of this section. At the first meeting of the year, the members of the Board shall hold an election to designate a Chairperson. The Chairperson shall preside over all meetings, be responsible for establishing the meeting agenda and act as the liaison between the Board and the Township Council and Assistant Recreation Supervisor. The agenda shall, at a minimum, provide each organization represented in the Board the opportunity to discuss their condition, needs, goals and objectives. If additional meetings during any given year are needed, a date and time shall be agreed upon by a majority vote at least 30 days prior to the additional meeting. At the conclusion of the meeting, the Board may engage in an open discussion as needed.
G. 
Functions and duties. The Board is purely advisory in nature. All decisions with respect to recreation programs and projects are the responsibility of the governing body. The Recreation Advisory Board shall:
(1) 
Formulate recommendations to the Mayor and Township Council concerning the development of recreation programs for residents of all ages;
(2) 
Act in an advisory capacity to the Mayor and Township Council in all matters pertaining to the recreation programs and the utilization of recreational areas, including, but not limited to, the scheduling, maintenance and utilization of such recreation areas and the need for equipment, services and building space for recreation;
(3) 
Make such individual studies and reports as may be requested by the Mayor, Township Council or Assistant Recreation Supervisor;
(4) 
Refer all maintenance concerns to the Assistant Recreation Supervisor; and
(5) 
Recommend fees for participation in Township-organized recreation activities and leagues.
H. 
Vacancies. A vacancy occurring other than by expiration of a term shall be filled for the unexpired term only, and the new appointee shall be appointed from amongst the members of the organization which the prior appointee had represented on the Board.

A. 
There may be a Recreation/Special Events Coordinator, who shall assist Administration in the administration and operation of the programs and activities of the Division. The Recreation/Special Events Coordinator shall be appointed by the Business Administrator, with the approval of the Mayor. The Recreation/Special Events Coordinator shall possess a bachelor's degree in recreation, or a closely related field, and have three years of experience in managing and operating recreational programs and activities. Additional experience may be substituted for the education requirement on a year-for-year basis, with 30 semester-hour credits being equal to one year of experience.
B. 
The Recreation/Special Events Coordinator shall carry out such duties as specifically designated by Administration.

There is hereby created within the Division of Recreation and Senior Services the Senior Services Program, the head of which shall be the Recreation Program Administrator. The Recreation Program Administrator shall be appointed on the basis of education, background and experience in the field of senior citizen program administration, which shall include graduation from a four-year course at an accredited college or university, and three years' experience in planning, developing and supervising recreational programs designed especially for the elderly. The Recreation Program Administrator shall coordinate and develop senior citizens programs and activities in the Township.

Under the direction and supervision of the Recreation Program Administrator, the Senior Services Program shall:
A. 
Develop programs and coordinate projects directed to the development of needed senior services in the Township.
B. 
Act as liaison between the Mayor and Township Council and various senior service agencies and programs, both public and private, on the local, state and federal levels.
C. 
Actively seek out and advise of grants, funds and loans which may be available for senior services and related programs.
D. 
Develop an understanding of the problems of senior citizens.
E. 
Establish a central location where senior citizens facing the problems of aging can turn for assistance through information on community resources.
F. 
Identify, locate and expand available community resources for senior citizens and the making of efforts to cause such resources to be more readily accessible and available to those who need them.
G. 
Act as a liaison between individual senior citizens, senior citizen groups and community resources and facilities and assistance to senior citizens.
H. 
Refer to the appropriate municipal officials any problems of individual senior citizens or groups of senior citizens relating to the functioning of municipal government, its agencies and instrumentalities.
I. 
Distribute information on resources available to senior citizens.
J. 
Render assistance to senior citizens in dealing with the problems of aging, including assistance programs for senior citizens, recreation, social and entertainment programs available for senior citizens.
