It shall be unlawful for any person:
1. To bring into the Borough of Saxonburg, for destruction by burning,
any refuse, trash, or yard waste produced outside the Borough.
2. To burn any refuse, trash, or yard waste on any public street or
alley in the Borough.
3. To burn any refuse or trash out of doors except in a container which
shall be located upon the property being occupied by the resident
of the operator of a business located in the Borough. The container
shall be such as will permit the refuse or trash to burn completely
and prevent ashes or sparks from being carried to other properties;
provided that, in cases where refuse or trash is too large for such
container, it may be burned in an open fire if said fire is more than
50 feet from the nearest building, is guarded continuously during
the burning, and the ashes or burning embers are controlled and extinguished
before the fire is left unguarded. Yard waste may be burned outside
of a container, provided the fire is located more than 50 feet from
the nearest building.
4. To burn refuse, trash, or yard waste out of doors at any time other
than Monday through Saturday between the hours of 6:00 a.m. and 1/2
hour before sunset and on Sundays and legal holidays between the hours
of 12:00 noon and 1/2 hour before sunset.
5. To burn refuse, trash, or yard waste during any periods where the
Borough, county, or state has declared a burning ban due to air quality
or drought situations.

Any person violating any provision of this Part shall, upon
conviction thereof, be sentenced to pay a fine of not more than $1,000
and costs of prosecution, including reasonable attorneys' fees
and costs, and, in default of payment of such fine and costs, to imprisonment
for not more than 30 days.

The Borough Council of the Borough of Saxonburg is hereby authorized
and directed to execute any and all documents necessary to effectuate
the purposes of this Part.
