There is hereby created a Park and Recreation Board in the City.
The Mayor with the approval of the Board of Aldermen shall appoint
a Board of nine (9) directors chosen from the citizens at large with
reference to their fitness for such office. At least six (6) of the
members shall be residents of the City and no member of the municipal
government shall be a member of the Board.

A. Said directors shall immediately after their appointment
meet and organize by the election of one (1) of the City resident
members as President and by the election of such other officers as
they may deem necessary. No member who is not a resident of the City
of Fredericktown shall be eligible to be an officer. Subject to the
following provisions, the Board shall make and adopt such bylaws,
rules and regulations for their guidance and for the government of
the parks as may be expedient, not inconsistent with Sections 90.500
to 90.570, RSMo. Prior to the adoption of any such rules or regulations
by the municipal public park board, said rules or regulations shall
first be submitted to the Board of Aldermen for their review and approval
by motion. Copies of any such bylaws, rules and regulations so adopted
shall be deposited in the office of City Clerk, City Hall. Any such
rule or regulation hereinafter adopted in accordance with the provisions
of this Section shall be enforceable by any duly appointed Peace Officer.
Any rule or regulation so violated shall be punishable in accordance
with the Code of Ordinances of the City of Fredericktown, Missouri.
B. The directors shall hold office, one-third (1/3) for one
(1) year, one-third (1/3) for two (2) years and one-third (1/3) for
three (3) years from the first of June following their appointment
and at their first regular meeting shall cast lots for their respective
terms; and annually thereafter the Mayor shall, before the first of
June of each year, appoint as before three (3) directors who shall
hold office for three (3) years and until their successors are appointed.
Any member appointed as a City resident member who, at any time during
their term, is no longer a resident of the City of Fredericktown shall
become ineligible to hold office and shall resign as a member of the
Board.
C. The Mayor may, by and with the consent of the Board of
Aldermen, remove any member of the Park and Recreation Board for misconduct
or neglect of duty.
D. Vacancies occasioned by removal, resignation or otherwise
shall be reported to the Board of Aldermen and shall be filled in
like manner as original appointments; except, that the term of office
is restricted to the unexpired term of office of the member replaced.
No director of the Board shall receive compensation as such.

A. There is hereby created two (2) Advisory Director positions
to the Park and Recreation Board of the City of Fredericktown, Missouri,
which members shall be appointed by the Mayor, subject to the consent
of the Board of Aldermen, and each Advisory Director shall be a citizen
of the City of Fredericktown and shall have been residents of the
City for at least two (2) years prior to their appointment. No member
of the Municipal Government shall be an advisory member of such Board.
B. Each member of the Advisory Board shall hold their respective
offices from the date of their appointment for a term of three (3)
years and shall be subject to removal in the same manner as provided
for voting members of the Park and Recreation Board.
C. Vacancies of Advisory Board members shall be filled for
the same term and in the same manner as provided for voting members
of the Board. No Advisory Directors of the Board shall receive compensation
as such.
D. Advisory Board members of the Park and Recreation Board
in the City of Fredericktown shall not be entitled to vote on any
matters coming before the Board, but shall be entitled to participate
in deliberations and activities of the Board.

The Park and Recreation Board shall have the exclusive control
of the expenditures of all money collected to the credit of the Park
Fund and of the supervision, improvement, care and custody of said
park. All monies received for such parks shall be deposited in the
Treasury of the City to the credit of the Park Fund and shall be kept
separate and apart from the other monies of the City and drawn upon
by the proper officers of the City upon the properly authenticated
vouchers of the Park Board. Said Board shall have power to purchase
or otherwise secure ground to be used for such parks, shall have power
to appoint a suitable person to take care of said parks and necessary
assistants for said person and fix their compensation and shall have
power to remove such appointees and shall in general carry out the
spirit and intent of Sections 90.500 and 90.570, RSMo., in establishing
and maintaining public parks.

A. The President of the Park and Recreation Board shall present
to the Board of Aldermen an annual report. Such report shall be presented
at the first Board of Aldermen meeting in May of each year and shall
consist of:
1.
The condition of their trust as of the first day
of May of that year.
2.
The various sums of money received from the park
fund and other sources.
3.
The sums of money expended by the Board and for
what purposes.
4.
Such other statistics, information and suggestions
as the Board may deem to be of general interest.
5.
The submission of a proposed park and recreation
budget for the coming year.
6.
Recommendations for improving the park and recreation
program and facilities.
7.
The submission of an annual planned program for
the use of the parks, recreation facilities and areas.
8.
All such portions of such report as related to
the receipts and expenditures of money shall be verified by affidavits.

The Park and Recreation Board shall be held as special trustees
for all donations of money, personal property or real estate for the
benefit of such park whenever such donations are accepted according
to the terms of the deed, gift, device or bequest of such property.
