Any person who intends to erect, alter, repair or take down
any building, or part thereof, on land abutting on any way which this
Town is obliged to keep in repair, and who desires to make use of
any portion of said way for the purpose of placing thereon building
materials or rubbish, shall give notice thereof to the Selectmen at
least 14 days prior to the commencement of such work. Thereupon, the
Selectmen may grant a permit to occupy such a portion of said way
to be used for such purpose as the necessity of the case demands and
the security of the public allows; such permit shall in no case be
in force longer than 90 days, and shall be on such conditions, and
by furnishing such security, by bond or otherwise, for the observance
and performance of the conditions and for the protection of the Town,
as the Selectmen may require; and especially in every case upon condition
that during the whole of every night, from sunset in the evening until
sunrise in the morning, lighted lanterns shall be so placed as effectually
to secure all travelers from liability to injury.
No person shall use any portion of any way which the Town is obliged to keep in repair for the purposes named in §
239-5 without a permit, in writing, of the Selectmen as above provided, nor having obtained such permit shall fail to comply with the conditions thereof. For any violation of such permit, the Selectmen may immediately revoke such permit.
