This chapter shall be known as the "Borough of Avalon Fire Escrow
Ordinance."
This chapter is adopted to manage fire-blighted properties,
to discourage the abandonment of properties, to prevent urban blight
and deterioration and to discourage arson and related crimes in the
Borough of Avalon.
In the construction of this chapter, the rules and definitions
contained in this section shall be observed and applied, except when
the context clearly indicates otherwise:
A. Words used in the singular shall include the plural, and the plural
the singular.
B. Words used in the present tense shall include the future tense.
C. The word "shall" is always mandatory and not discretionary.
D. The word "may" is permissive.
As used in this chapter, the following terms shall have the
meanings indicated:
BOROUGH TREASURER
The elected Treasurer of the Borough of Avalon or other appropriate
municipal officer authorized to collect real property taxes.
BUILDING INSPECTOR
The person authorized to act as the building official, or
any assistant to such person, who enforces the provisions of the Borough
Zoning Ordinance.
INSURANCE COMPANY
Includes any company, association or exchange authorized
by the Insurance Commissioner to transact the business of insurance
in the Commonwealth of Pennsylvania and empowered to issue policies
of insurance against loss by the perils of fire or explosion.

Any person who violates or permits a violation of this chapter
shall, upon being found liable therefor, pay a fine of not more than
$600, plus court costs and reasonable attorneys’ fees incurred
by the Borough in the enforcement proceedings. If the penalty is not
paid, the Borough shall initiate a civil action for collection in
accordance with the Pennsylvania Rules of Civil Procedure. Each day
a violation exists shall constitute a separate offense, and each section
of this chapter that is violated shall also constitute a separate
offense. In addition to or in lieu of enforcement under this section,
the Borough may enforce this chapter in equity in the Court of Common
Pleas of Allegheny County.
The Borough Manager shall file an exact copy of this chapter
with the Department of Community and Economic Development together
with the name, position and phone number of the municipal officer
responsible for compliance with this chapter.
