The office of Fire Chief of Manchester Township is hereby created.

The Fire Chief shall be appointed by the Township Manager pursuant to the provisions of Ord. 1969-4, "Creation of the Office of Township Manager" [Chapter 1, Part 1] and the provisions of any fire protection agreement with a fire company that may be entered into, from time to time, by the Board of Supervisors and may be removed from office for cause. The Township Manager shall also appoint, after consultation with the Fire Chief, an Assistant Chief or Chiefs to serve in the absence or incapacity of the Fire Chief. The Fire Chief shall fulfill the qualifications as may be established, from time to time, by the Board of Supervisors and shall not engage in nor follow any other occupation or business and shall devote his entire time and attention to the duties of his office. The Fire Chief shall take the oath of office required to be taken by the Township officials before assuming the duties of the office. The Fire Chief shall be chosen solely on the basis of his fire experience and qualifications.

The salary range for the office of Fire Chief shall be fixed by the Board of Supervisors, from time to time.

The Fire Chief shall be designated as the Assistant State Police Fire Marshal for Manchester Township as provided by law.

The Fire Chief shall abide by the provisions of any fire protection agreement with a fire company that may be entered into, from time to time, by the Board of Supervisors and shall provide input into the creation or amendment of any such agreement.

The Fire Chief shall participate in the designation of an Assistant Chief or Chiefs to act during his absence or incapacity.

The Fire Chief or the designated Assistant Chief shall attend all fires and emergencies within the Township and shall have charge and direct the operations at the scene.

The Fire Chief shall have full power and authority over all paid firefighters and over all firefighters at the scene of the fire or other emergency. He shall plan the strategy in overcoming the fire or other emergency and shall issue and enforce such orders as in his judgment may be necessary for the protection of property and the extinguishment of the fire or resolution of the emergency. He shall give all orders on the scene through channels of authority, unless by reason of an emergency it becomes necessary to give direct orders to any firefighter who may be available for immediate action.

The Fire Chief shall designate the locations of all new fire hydrants.
7. 
The Fire Chief shall prepare the rules, regulations and standard operating procedures for the operation of the Township Fire Department.

It shall be the duty of the Fire Chief, Assistant Chiefs or other officers in charge at the scene of a fire or emergency, if in their judgment it becomes necessary, to block highways adjacent to such scene in order to prevent interference by the public.

The Fire Chief and Assistant Chiefs are hereby invested with authority to make arrests and to have all the powers conferred by law upon police officers at the scene of the fire or emergency and shall enforce any other ordinance of the Township in which the Fire Chief is given the power of enforcement.

In the interest of public safety and security from fire, the Fire Chief and the Assistant Fire Chiefs are hereby designated as fire prevention code official and shall have full power and authority:
A. 
To enforce all laws, ordinances, rules and regulations relating to the manufacture, sale, storage or transportation of flammable or explosive substances.
B. 
At any and all reasonable times to enter upon and into any building or premises, within the Township, for the purpose of examining and inspecting the same to ascertain the condition of the structure and presence, arrangement or location of all appliances, materials, substances, goods, wares or merchandise therein to determine whether or not a fire hazard exists.

Fire prevention code officials shall inspect as often as may be necessary, all buildings and premises, except the interiors of private dwellings, for the purpose of ascertaining and causing to be corrected any conditions liable to cause fire or any violation of law, ordinance, rule or regulation relating to fire hazards. The interiors of private dwellings are subject to the provisions of this section, except that inspection thereof shall be made only when the Fire Chief receives a written complaint of the existence of a fire hazard therein.

If a fire prevention code officials finds upon inspection of any building or premises any rubbish, debris, waste, flammable or combustible materials and that the same or any appliances, goods, wares or merchandise are not so arranged or placed as to afford reasonable safeguard against the danger of fire or finds that any thereof are so arranged and placed that the occupants or persons rightfully on or in such buildings or premises would not, because of such arrangement and disposition, be afforded reasonable access to the exits in case of fire, or finds that by reason of such arrangement or disposition, the members of the Fire Department would unnecessarily or unreasonably be interfered with in the exercise of their duties in case of fire, he shall declare the same as a fire hazard and order, in writing, its elimination. In the aftermath of a fire, the Fire Chief shall have the power to order any and all remains or rubble that may pose a hazard to the public to be removed.
