1. PADEP or its designees normally ensure compliance with any permits
issued, including those for stormwater management. In addition to
PADEP compliance programs, Hummelstown Borough or their municipal
assignee may inspect all phases of the installation of temporary or
permanent stormwater management facilities.
2. During any stage of earth disturbance activities, if Hummelstown
Borough determines that the temporary or permanent stormwater management
facilities are not being installed in accordance with the approved
SWM site plan, Hummelstown Borough shall revoke any existing permits
or approvals until a revised SWM site plan is submitted and approved
as specified in this Part.
3. Stormwater BMPs shall be inspected by the landowner, or the landowner's
designee according to the inspection schedule described on the SWM
site plan for each BMP.

A. The landowner or the owner's designee (including Hummelstown
Borough for dedicated and owned facilities) shall inspect SWM BMPs,
facilities and/or structures installed under this Part according to
the following frequencies, at a minimum, to ensure the BMPs, facilities
and/or structures continue to function as intended:
(1)
Annually for the first five years.
(2)
Once every three years thereafter.
(3)
During or immediately after the cessation of a ten-year or greater
storm.
B. A written inspection report shall be created to document each inspection.
The inspection report shall contain the date and time of the inspection,
the individual(s) who completed the inspection, the location of the
BMP, facility or structure inspected, observations on performance,
and recommendations for improving performance, if applicable. Inspection
reports shall be submitted to the municipality within 30 days following
completion of the inspection.
C. If such inspections are not conducted or inspection reports not submitted
as scheduled, Hummelstown Borough, or their designee, may conduct
such inspections and charge the owner appropriate fees. Non-payment
of fees may result in a lien against the property.

Prior to conducting such inspections, Hummelstown Borough shall
inform the owner of its intent to conduct such inspections. The owner
shall be given 30 days to conduct required inspections and submit
the required inspection reports to Hummelstown Borough.

1. Upon presentation of proper credentials, Hummelstown Borough or its
designated agent may enter at reasonable times, upon any property
within the Borough of Hummelstown, to inspect the implementation,
condition, or operations and maintenance of the stormwater BMPs in
regard to any aspect governed by this Part.

2. Stormwater BMP owners and operators shall allow persons working on
behalf of Hummelstown Borough ready access to all parts of the premises
for the purposes of determining compliance with this Part.
3. Persons working on behalf of Hummelstown Borough shall have the right
to temporarily locate on any stormwater BMP in the Borough of Hummelstown
such devices, as are necessary, to conduct monitoring and/or sampling
of the discharges from such stormwater BMP.
4. Unreasonable delay in allowing Hummelstown Borough access to a stormwater
BMP is a violation of this Part.
