The following terms, as used in this Part 1, shall have the
following meanings:
ENTITY
Any person, persons, partnership, corporation (whether for
profit or non-profit), association, unincorporated association, or
group of joint venturers.
OUTSIDE OF PREMISES
Any location outside of any building in an area which is
open and accessible to the public, whether such area is on the public
right-of-way or on private property.
VENDING MACHINE
Any device that stores and discharges, for consumer use,
food or drinks, whether in metal, glass, plastic or paper containers.

No entity shall permit any vending machine to be located outside
of its premises unless such premises are being used in conjunction
with a commercial activity. A commercial activity does not include
a home occupation.

Any person, firm or corporation who shall violate any provision
of this Part 1 shall, upon conviction thereof, be sentenced to pay
a fine of not more than $300; and/or to imprisonment for a term not
to exceed 90 days.
