The following words, terms, and phrases, when used in this article, unless the context clearly indicates otherwise, shall have the following meanings ascribed to them:
PERSON WITH DISABILITY
Any person who is eligible to receive a person with disability plate or person with disability parking placard, pursuant to the provisions of the Pennsylvania Vehicle Code found at 75 Pa.C.S.A. § 1338, or any subsequent amendment thereto.
PERSON WITH DISABILITY PARKING PLACARD
The parking placard issued by the Pennsylvania Department of Transportation pursuant to the provisions of the Pennsylvania Vehicle Code found at 75 Pa.C.S.A. § 1338(b), or any subsequent amendment thereto.
PERSON WITH DISABILITY PLATE
The registration plate issued by the Pennsylvania Department of Transportation pursuant to the provisions of the Pennsylvania Vehicle Code found at 75 Pa.C.S.A. § 1338(a), or any subsequent amendment thereto.
SEVERELY DISABLED VETERAN
Any veteran who is eligible to receive a severely disabled veteran plate or severely disabled veteran placard pursuant to the provisions of the Pennsylvania Vehicle Code found at 75 Pa.C.S.A. § 1342, or any subsequent amendment thereto.
SEVERELY DISABLED VETERAN PLACARD
The parking placard issued by the Pennsylvania Department of Transportation pursuant to the provisions of the Pennsylvania Vehicle Code found at 75 Pa.C.S.A. § 1342(b), or any subsequent amendment thereto.
SEVERELY DISABLED VETERAN PLATE
The registration plate issued by the Pennsylvania Department of Transportation pursuant to the provisions of the Pennsylvania Vehicle Code found at 75 Pa.C.S.A. § 1342(a), or any subsequent amendment thereto.
Except for persons parking vehicles lawfully bearing a person with disability plate, or severely disabled veteran plate, or displaying a valid person with disability parking placard or severely disabled veteran parking placard when such vehicles are being operated by or for the transportation of a person with a disability or severely disabled veteran, no person shall park a vehicle on public or private property reserved for a person with a disability or a severely disabled veteran, which property has been posted or marked in accordance with the regulations of the Pennsylvania Department of Transportation, the requirements of the Chestnuthill Township Subdivision and Land Development Ordinance,[1] the requirements of the Chestnuthill Township Zoning Ordinance[2] or in accordance with the Americans with Disabilities Act.

Any police officer, the Chestnuthill Township Road Master, the Chestnuthill Township Fire Marshal, the West End Fire Company Fire Chief, the Chestnuthill Township Zoning/Code Enforcement Officer, or any other agent so designated by Chestnuthill Township, is hereby authorized to issue citations for the violation of this article. Among other methods, issuance of the citation may be accomplished by placing the same on the vehicle.
This article shall be enforced by action brought before a Magisterial District Judge in the same manner provided for the enforcement of summary offenses under the Pennsylvania Rules of Criminal Procedure. Any person, partnership, corporation or other entity who or which violates or permits a violation of the provisions of this article shall, upon conviction in a summary proceeding, pay a fine of not less than $50 nor more than $200 per violation, plus all court costs and reasonable attorney's fees incurred by Chestnuthill Township in the enforcement proceedings, and/or be imprisoned to the extent allowed by law for the punishment of summary offenses. Each day or portion thereof that a violation exists or continues shall constitute a separate violation, and each section of this article that is violated shall also constitute a separate offense. Further, the appropriate officers or agents of Chestnuthill Township are hereby authorized to seek equitable relief, including injunction, to enforce compliance with this article. All fines, penalties, costs and reasonable attorney's fees collected for the violation of this article shall be paid to Chestnuthill Township for its general use.
