As used in this Part, the following terms shall have the meanings indicated:
ALCOHOLIC BEVERAGE
Any liquor or brewed or malt beverage as defined by the Liquor Code of the Commonwealth of Pennsylvania, Act of April 12, 1951, P.L. 90, Article 1, § 101 et seq., as amended, 47 P.S. § 1-101, as amended.
OPEN CONTAINER
An open, unsealed, resealed, or partially refilled container, can, or bottle containing an alcoholic beverage.
ROAD, HIGHWAY STREET, ALLEY, WAY, PARKING AREA, SIDEWALK, PARK
Every such place located within the Borough of Oxford which is subject to use by the public.

It shall be unlawful for any person to consume any alcoholic beverage and/or possess an open container containing an alcoholic beverage in or upon any road, highway, street, alley, way, parking area, sidewalk, or park within the Borough of Oxford, except for:
1. 
Patrons at an approved outdoor cafe, as defined by Chapter 27, Zoning; and
2. 
Attendees at a special event where the serving of alcoholic beverages outdoors is conducted in accordance with the terms of Chapter 13, Part 2, § 13-212.

The possession of an open container by any person which contains a beverage with any percentage of alcohol upon any public place (as described in § 6-402) in the Borough of Oxford shall be prima facie evidence of consumption of such beverage in violation of this Part.

Any person, firm or corporation who shall violate any provision of this Part, upon conviction thereof, shall be sentenced to pay a fine of not more than $1,000 plus costs and, in default of payment of said fine and costs, to a term of imprisonment not to exceed 30 days. Each day that a violation of this Part continues shall constitute a separate offense.
