These regulations provide for the approval of plats for the subdivision of land within the Village of Woodridge, Sullivan County, New York. They may be cited as "Woodridge Subdivision Regulations."
These regulations are adopted under the authority provided to the Village of Woodridge by the § 7-728 of the Village Law of the State of New York.
These regulations are adopted for the following purposes:
A. 
Promoting the orderly growth and development of the Village and affording adequate facilities for the housing, transportation, distribution, comfort, safety, convenience, health and welfare of its population.
B. 
Protection and promotion of safety, health, welfare, convenience, economy and preservation of the environment.
C. 
Reduction of foreseeable maintenance and improvement problems as well as economic burdens associated with development of land.
A. 
On or after the effective date of these regulations, no lot in any subdivision may be sold, no permit to build on any land in a subdivision may be issued and no improvements within any subdivision may be installed except in accordance with the provisions of these regulations. All subdivisions hereafter created, regardless of the number of lots, the ownership of the parcels or the number of previous lots created from the parent parcel, shall fully comply with these regulations.

B. 
Any division of land which was not previously subdivided under these regulations and which involves two or fewer lots and: does not involve the construction of new streets; does not involve the construction of multiple dwelling units; does not involve the use of clustering techniques; and does not involve any lots less than one acre in size, shall not be considered a subdivision in terms of these regulations.
C. 
No approval shall be required for such division so long as the division of land otherwise complies with the standards of these regulations.
Wherever there is a difference between minimum standards or dimensions specified herein and those contained in other Village ordinances, the most restrictive shall govern.
As used in this chapter, the following terms shall have the meanings indicated:
BLOCK
A tract of land bounded by streets, or by a combination of streets and public parks, cemeteries, shorelines or watercourses or boundary lines of the Village.
BUILDING INSPECTOR
That official appointed by the Village Board charged with administering the building code and zoning ordinance.[1]
CLEAR SIGHT TRIANGLE
An area of unobstructed vision at a street intersection(s) defined by lines of sight between points at a given distance from the intersecting street right-of-way lines.
CLERK OF THE PLANNING BOARD
The person designated to perform the duties of the Clerk of the Planning Board who, for purpose of these regulations, shall be the Planning Board Chairman or his duly appointed representative.
COMMON OPEN SPACE
A parcel or parcels of land or an area of water, or a combination of land and water within a development site and designed and intended for the use or enjoyment of residents of the planned unit development or planned residential development. It does not include streets, off-street parking areas and areas set aside for public facilities.
CONDOMINIUM
An apartment house or houses, the apartments or dwelling units of which are individually owned, each owner receiving a deed enabling him to sell, mortgage or exchange his apartment independent of the owners of the other apartments in the building or buildings. All condominium subdivisions must be filed with the state prior to the sale of lots.
CUL-DE-SAC
A minor street terminated by a vehicular turnaround.
DEDICATION
The deliberate offering by its owner of land for any general or public uses. This shall not be construed as acceptance by the Village of responsibility for maintenance and/or ownership of such land and attendant facilities except where appropriate legal documents specifically relating to the same have been executed.
DEIS
Draft environmental impact statement. A preliminary report containing the description of a proposed action, its environmental setting, potential environmental impacts and reasonable alternatives.
EASEMENT
A grant by the owner of land for the use of all or a portion of such by others, including the public, for a specific purpose or purposes.
ENGINEER
A person licensed as a professional engineer by the State of New York.
FEIS
Final environmental impact statement. A completed report containing the description of a proposed action, its environmental setting, potential environmental impacts, ways to minimize the impacts and reasonable alternatives. A "FEIS" consists of the draft EIS plus any revisions, public comments and lead agency responses to the substantial comments.
FILING DATE
The date of receipt of a plat by the Clerk of Planning Board of Woodridge as noted on the plat.
HIGHWAY SPECIFICATIONS
Those specifications for the construction of roads in the Village of Woodridge as adopted by the Village Board.
LOT
A unit into which land is divided, or other parcel of land intended as a unit for transfer of ownership, lease, rent or use for development.
A. 
LOT AREAThe "lot area" is the area of a horizontal plane bounded by the front, rear and side lines excluding any public or private right-of-way.
B. 
LOT WIDTHThe "lot width" is the average horizontal distance between the side lot lines, measured parallel to the front lot line at the building line.
C. 
LOT LINE, FRONTThe "front lot line" is that boundary of a lot which is along an existing or proposed right-of-way. In the case of corner lots, the line having the frontage on the heavier-traveled road shall be designate as the "front lot line."
D. 
LOT LINE, REARThe "rear lot line" is that boundary of a lot which is most distant from and most nearly parallel to the front lot line.
PARCEL
An area of land resulting from the division of a tract of land for the purposes of transfer of ownership, use or improvement.
PERFORMANCE OR COMPLETION GUARANTY
A surety bond or certified check guaranteeing the subdivider will install all required or planned improvements.
PERSON
Any individual, firm, trust, partnership, public or private association or corporation or other entity.
PLAN or PLAT
A map or chart indicating the subdivision or resubdivision of land in its various stages of preparation, which can include the following:
A. 
SKETCH PLANA sketch of a proposed subdivision showing limited information as specified in these regulations, to enable the subdivider to save time and expenses in reaching general agreement with the Planning Board as to the form of the layout and objectives of these regulations.
B. 
PRELIMINARY PLATA drawing prepared by a licensed land surveyor showing the layout of a proposed subdivision, including but not restricted to road and lot layout and approximate dimensions, key plan, topography and drainage, all proposed facilities unsized, including preliminary plans and profiles at suitable scale and in such detail as necessary to properly present plans.
C. 
FINAL PLATA drawing prepared by a surveyor showing a proposed subdivision, containing in such additional detail all information required on a preliminary plat and the modifications, if any, required by the Planning Board at the time of a preliminary plat of such proposed subdivision if such preliminary plat has been so approved.
PLANNING BOARD
The Village of Woodridge Planning Board.
PUBLIC RIGHT-OF-WAY
Land reserved for use as a street, alley, interior walk or for other public purposes. The right-of-way shall not be considered as land area when computing lot size.
RIGHT-OF-WAY
A general term denoting land, property or interest therein, usually in a strip, acquired for or devoted to a highway. When a state, county, town or Village does not own fee title to a highway, the right-of-way shall be 25 feet from the center line of the road.
SEQR LONG FORM (EAF)
The full environmental assessment form that is used by an agency to determine the environmental significance or nonsignificance of a proposed action. It consists of three parts: Part One is filled out by the applicant; Parts Two and Three are completed by the lead agency.
SEQR SHORT FORM (EAF)
A simplified environmental assessment form that may be used by an agency to determine the environmental significance or nonsignificance of an action.
STATE ENVIRONMENTAL QUALITY REVIEW ACT (SEQR)
Article 8 of the New York State Environmental Conservation Law that requires any local, regional or state agency or body to evaluate all projects or actions that are directly undertaken by the agency; are funded by the agency; or require one or more permits or approvals from the agency. A subdivision requires evaluation under SEQR.
STREET
A strip of land, including entire right-of-way, intended for use as a means of vehicular and pedestrian circulation. Classes of streets are as follows:
A. 
MAJOR TRAFFIC STREETSThose serving large volumes of comparatively high-speed and long-distance traffic.
B. 
COLLECTOR STREETSThose which, in addition to giving access to abutting properties, intercept minor streets and provide routes, carrying considerable volumes of traffic to community facilities and to major traffic streets.
C. 
MINOR STREETSThose which primarily provide access to abutting properties.
D. 
STREET WIDTHThe shortest distance between the lines delineating the right-of-way of a street; 50 feet at a minimum.
SUBDIVIDER
Any person, firm, association, partnership, corporation, fiduciary, trust or other legal entity seeking subdivision of land hereunder as owner or agent of owner of land affected by a subdivision.
SUBDIVISION
A division or redivision of a lot, tract or parcel of land by any means into three or more lots, tracts, parcels or other divisions of land, including changes in existing lot lines for the purpose, whether immediate or future, of lease, transfer of ownership or building or lot development. A condominium development constitutes a subdivision.
A. 
MAJOR SUBDIVISIONAny subdivision not classified as a minor subdivision.
B. 
MINOR SUBDIVISIONAny subdivision containing three to five lots fronting on an existing street, or deeded right-of-way not involving construction of any new street or road, or the extension of municipal facilities, or the intended construction of multiple dwelling units, or the use of clustering techniques, or involving any lots less than one acre.
SURVEYOR
A person licensed as a land surveyor by the State of New York.
VILLAGE BOARD
The Village Board of the Village of Woodridge, Sullivan County, New York.
VILLAGE CLERK
That person appointed by the Mayor of the Village of Woodridge to perform the duties established by law for the position of Village Clerk.
