It is the purpose of this Part 2 to assure the planned, orderly, and successful conduct of public gatherings, parades, and other activities defined in § 13-202 as special events. The terms of this Part are designed to give the Borough necessary details about the proposed event so as to provide appropriate support and coordination, while preparing properly for any event that has the potential to place an exceptional burden on the Borough Police Department and/or other public services.

The following terms shall have the meanings indicated:
BOROUGH
The Borough of Oxford.
CHIEF OF POLICE
The Chief of Police of the Borough of Oxford.
MAYOR
The Mayor of the Borough of Oxford.
PARADE
Any march, procession (excluding wedding and funeral processions), demonstration of any kind, or any similar display in or upon any street, park, or other public place within the Borough of Oxford.
PERSON
Any individual, firm, partnership, association, corporation, company, or organization of any kind.
POLICE DEPARTMENT
The Police Department of the Borough of Oxford.
SPECIAL EVENT
A planned, arranged gathering or assembly of persons, for commercial purposes or otherwise, whether on private or public property, that will take place for a continuous period of not less than two hours.

1. 
A special event includes, but shall not be limited to, the following:
A. 
Musical production, participatory event, or show.
B. 
Outdoor theater; historical reenactment.
C. 
Arts and crafts show and/or sale.
D. 
Animal races or show, including equine show and competition.
E. 
Carnival or amusement.
F. 
Motor vehicle show.
G. 
An assembly, festival, and the like that is conducted outside a building and has projected attendance that will exceed the permitted seating capacity of the building.
H. 
Special event assemblage at a children's camp, sports training facility, or similar operation.
I. 
Parade.
2. 
A special event shall not include:
A. 
Any gathering under control of any public school under the auspices of the Pennsylvania Department of Public Education;
B. 
Any gathering or event that is organized, conducted, operated, and/or hosted by Oxford Borough or any other duly authorized governmental entity;
C. 
Any event sponsored and conducted by the Union Fire Company;
D. 
Any private family event, including, but not limited to, a family reunion or wedding, held on private property; or
E. 
Food or refreshment provided to customers of a commercial establishment on the site of such establishment to celebrate an anniversary, sale, or similar special occasion.
SPONSOR
Any person or entity that organizes, promotes, permits, or conducts a special event.

It shall be unlawful for any sponsor or legal title owner of a property to organize, promote, advertise, permit, or conduct a special event without complying with the terms of this Part 2 that are applicable to such special event.

1. 
Any sponsor planning a special event, as defined by this Part, shall file an application with the Police Department on a form provided by the Borough.

2. 
Where a special event permit is required, no special event shall be opened or operated in the Borough unless and until a permit has been issued for the same in accordance with this Part.
3. 
The permit application shall be filed with the Police Department not less than 45 days prior to the scheduled event.
4. 
The application for a permit shall set forth the following information:
A. 
The name, address, e-mail address, and telephone number of the person or persons sponsoring the event.
B. 
If the application is made on behalf of or by an organization, the name, address, and telephone number of the headquarters of the organization and of the authorized or responsible persons.
C. 
The date when the event is to be conducted.
D. 
The route to be traveled or the area within the Borough to be used for the event, including the starting point and termination point.
E. 
The approximate number of persons who will be involved with the event and, if there are animals and vehicles, the approximate number and types of animals and the approximate number and description of vehicles.
F. 
The hours when the event will start and end, and the times at which any portions of the event will begin to assemble at a particular area or areas.
G. 
Where the special event will include one or more transient retail businesses, the application shall identify the name and scope of such business.
5. 
No permit application will be considered or reviewed unless the application has been completed in its entirety and is accompanied by the required fee.
6. 
Applications filed by, or on behalf of, any organization registered with the Pennsylvania Secretary of State as a § 501(c)(3) corporation for religious, charitable, educational, or other purposes as allowed under the IRS Code will not be required to pay an application fee. Where such special event is proposed to include one or more transient retail businesses, the sponsoring organization may apply for the transient retail business permit(s) and may collect and retain the permit fee(s) for its own purposes.

The application for a permit shall be reviewed by the Mayor and the Police Department. After such review, the Mayor and the Police Department shall submit their recommendations to Borough Council. Thereafter, Borough Council shall review the application and approve or deny such application. In reaching such determination, Borough Council shall consider any and all relevant information and factors, including, but not limited to, the following:
A. 
Whether the requested event will substantially interrupt the safe and orderly movement of traffic within and contiguous to the event;
B. 
Whether the requested event will require the Borough to police such event and whether the number of police officers assigned to properly police such event will prevent the Borough from providing adequate police protection to the remainder of the Borough;
C. 
Whether the requested event will unduly or substantially interfere with proper and adequate fire and police protection or proper and adequate ambulance service to the areas contiguous to such event and the Borough in general;
D. 
Whether the requested event will otherwise substantially interfere with or be a substantial detriment to the general health, safety, and welfare of the Borough; and
E. 
Whether there are other events scheduled on the day of the requested event.
2. 
In the case of approval of a permit, Borough Council may attach such conditions regulating time, place, and the manner in which the event is conducted and such other conditions as will assure the general health, safety, and welfare of the Borough, its residents, and the people participating in such event. Where Police Department and/or Public Works Department services are required, Borough Council may stipulate that the permittee shall pay some or all of the applicable costs.

No permit shall be granted for a special event of more than 48 hours' duration unless the applicant specifically requests, and the permit specifically allows, an extension of that period.
2. 
No applicant shall be under 21 years of age.
3. 
No permit may be transferred or assigned.
4. 
[1]Any material violation of any provision of this Part or the repeated violation of any provision of this Part shall be sufficient grounds for the revocation of any permit. Upon the revocation of any permit, the person in charge or sponsor of the event shall immediately terminate the special event and cause the prompt and orderly dispersal of persons in attendance.

No programmed entertainment, amusement, or recreation or use of sound-amplification equipment shall be provided or permitted between the hours of 10:00 p.m. and 10:00 a.m., and it shall not be operated in a location which is less than 500 feet from any school, place of worship, residential or institutional use, or public road.

The application for a permit shall be accompanied by the required fee. The application fee shall be established by resolution of Borough Council from time to time and shall be kept on file at the Borough Building. For an organization meeting the terms of § 13-204, Subsection 1F, the fee shall be waived.

1. 
A permittee hereunder shall comply with all permit terms and conditions and with all applicable laws of the Borough and the Commonwealth of Pennsylvania.
2. 
The sponsor or other person in charge of such event shall carry the permit upon his or her person during the conduct of such event.
3. 
At the conclusion of the program, the permittee shall terminate the assembly or gathering and supervise the orderly dispersal of those in attendance. Where deemed necessary, the Borough shall authorize its agent to meet with the permittee to confirm that all terms of the permit have been met, or to identify violations that must be remedied.

The Mayor or his duly authorized agent shall have the right to suspend or revoke any permit issued under this Part for violations of one or more of the regulations promulgated herein.

1. 
No person shall unreasonably hamper, obstruct, impede, or interfere with any event or with any person, vehicle, or animal participating or used in an event issued a permit under this Part.
2. 
No driver of a vehicle shall drive between the vehicles or persons comprising a special event when such vehicles or persons are in motion and are conspicuously designated.
3. 
The Chief of Police shall have the authority, when reasonably necessary, to prohibit or restrict the parking of vehicles along the highway or part thereof constituting any portion of a parade route or event. The Chief of Police shall post signs to such effect, and it shall be unlawful for any person to park or leave unattended any vehicle in violation thereof.

Any person who shall be convicted of violation of any provision of this Part before any District Justice shall be sentenced to pay a fine of not more than $1,000, together with the costs of prosecution, or to suffer imprisonment in the county jail for a term not to exceed 30 days, or both.

1. 
Where the special event sponsor proposes to serve, or permit the serving of, alcoholic beverages during the event, the permit application form shall document the intended location, staffing, security, and ability to comply with the requirements of this section and of all applicable requirements of the Pennsylvania Liquor Control Board.
2. 
Alcoholic beverages may be served to patrons of the event only within an identified, confined and controllable space that is specified on the permit application form and approved by the Borough.
3. 
The area designated for the service of alcoholic beverages shall be sufficiently staffed for purposes of preventing open containers of alcohol from being transported outside the designated area, preventing underage consumption of alcohol, and preventing intoxication of patrons. In addition, adequate personnel shall be specifically assigned to the designated area to remove all leftover food and beverages, containers, cups, dishes, eating utensils, etc., upon departure of the patron.
4. 
An application for a special event that proposes offering alcoholic beverages may be denied by the Borough for any reason.
