All public streets hereinafter constructed in the Town of Alden by private developers shall be constructed in accordance with the specifications hereinafter set forth and made a part of this resolution and in accordance with the Standard Specifications adopted by the Town Board.[1]

A developer desiring a street to be accepted as a public highway of the Town of Alden shall file with the Town Clerk the following:
A. 
Deed conveying the area in which the street is constructed.
B. 
Title insurance preliminary report. (Policy on closing.)
C. 
Cash or bond in an amount set by the Superintendent of Highways to indemnify the Town for a period of one year from the date of acceptance of the street against any cost of repair or maintenance other than normal snow plowing and weed cutting.
D. 
An agreement in form acceptable to the Town Attorney agreeing to indemnify the Town as above set forth.

The right-of-way is to be expanded to a required seventy-foot right-of-way with construction of the pavement to be as per the detail as prepared by Krehbiel Associates, Inc., and which will, effective the date of this resolution, be placed on file with the Building Inspector of the Town of Alden, said specification and detail to be required forthwith from this date for any applicant for a public improvement permit to construct a road within the Town of Alden.
All costs of conveyances and title insurance shall be paid by the developer by cash or certified check at the time of the filing of the above documents with the Town Clerk.
The developer shall at the request of the Town comply with the provisions of § 171 of the Highway Law and execute any instruments reasonably required by the Town Attorney.
No building permits shall be issued unless the premises for which application is made have frontage upon a previously existing public street or upon a street constructed and accepted pursuant to the terms of this resolution.

All work shall be subject to the approval of the Superintendent of Highways, who shall approve the subgrade, the foundation course and the base course in sequence before any further work is started.
