This article shall be known and may be cited as the "Raffle
Licensing Ordinance of Leonia." The purpose is to enact an ordinance
providing for raffle permits to be issued by the Borough Clerk in
accordance with N.J.S.A. 5:8-50 et seq.
Any bona fide organization of veterans of any war in which the
United States has been engaged, churches, or religious congregations
and religious organizations, charitable, educational, and fraternal
organizations, civic and service clubs, senior citizens associations
and clubs, and officially recognized volunteer first-aid or rescue
squads may apply to the Borough of Leonia for issuance of a license
to hold and operate games of chance, restricted to the specific kind
of game of chance commonly known as a "raffle," as defined by N.J.S.A.
5:8-50 et seq., known as the "Raffle Licensing Law of New Jersey."
Each applicant for a license shall file a written application
in conformity with the Raffle Licensing Law of New Jersey and with
the rules and regulations adopted and promulgated by the Legalized
Games of Chance Control Commission of New Jersey.
The fees for such licenses shall be those provided in the Raffle Licensing Law of New Jersey or as set forth in Chapter
123.
The governing body, pursuant to N.J.S.A. 5:8-30 and 5:8-57,
may suspend and revoke any issued raffle license, after a hearing,
for any violation of this chapter or state law. The governing body
may suspend the operation of a bingo or raffle pending hearing, in
which case a hearing must be held within five days after such action.
Notice of a hearing shall be served personally upon an officer of
the license or the licensee at the address shown on the license. All
decisions and findings by the governing body regarding the suspension
or revocation of a bingo or raffle license shall be in writing.
Any person who violates any of the provisions of this chapter,
upon conviction, shall be subject to the penalties provided in the
New Jersey Administrative Code.
