Borough Council by simple resolution may from time to time hereinafter designate the official tower/salvor in the Borough of West Mifflin. Such official tower/salvor shall be summoned by Borough Police to tow and store motor vehicles which pose a threat to safety when the person owning or in possession or control of a motor vehicle is not present, unable or unwilling to summon a tower/salvor of his or her choice.
Council is hereby authorized to announce a request for proposals from persons and entities which desire to be designated the official tower/salvor for West Mifflin Borough. Said designation as the official tower/salvor for West Mifflin Borough shall not be exclusive. West Mifflin Borough has the right to designate one or more entities to serve in this capacity without limit as it deems appropriate in its sole discretion.
A. 
Considerations deemed to be mandatory for any tower/salvor include the following:
(1) 
Applicant must be a duly licensed tower/salvor;
(2) 
Applicant must own or exclusively operate a licensed salvor lot;
(3) 
Applicant must maintain minimal limits of comprehensive liability insurance coverage for all of its operations;
(4) 
Applicant must have properly licensed equipment capable of carrying out the terms of appointment;
(5) 
Applicant must have in effect workers compensation insurance coverage;
(6) 
No fees or charges will be billed to the Borough or paid by the Borough for any services of any nature arising out of towing and salvage operations.
(7) 
A contract will be entered into by the successful tower/salvor and the Borough which may be cancelled by the Borough on 30 days' notice without cause; it may be cancelled without notice for cause;
(8) 
Applicant must address all issues and clauses in the sample agreement attached.[1]

B. 
Additional matters to be considered by Council and which shall be addressed in the response of any prospective tower/salvor must include the following:
(1) 
Fee schedule;
(2) 
Location of salvage lot;
(3) 
The number and quality of all towing and salvor equipment;
(4) 
All items addressed and identified on sample towing/salvor contract attached;[2]

Number and training of staff;
(7) 
Such other matters as Council may deem to be relevant.
