Definitions. For purposes of this Section, the following
definitions shall apply:
COURSE OF CONDUCT
A pattern of conduct composed of a series of acts over time,
however short, evidencing continuity of purpose. Neither constitutionally
protected activity, nor shall this Section apply to any activities
regulated by the National Labor Relations Act, Railway Act or Federal
Employment Labor Management Act, as amended.
ELECTRONIC COMMUNICATION
The origination, emission, dissemination, transmission or
reception of data, images, signals, sounds or other intelligence or
equivalence of intelligence of any nature over any communications
system by any method including, but not limited to, fiber optic, electronic,
magnetic, optical, digital or analog method. By way of example, electronic
communication includes, but is not limited to, electronic mail, Internet-based
communications, pager service and electronic text messaging.
ELECTRONIC COMMUNICATIONS DEVICE
Any instrument, equipment, machine or other device that facilitates
telecommunication, including but not limited to, a computer, computer
network, computer chip, computer circuit, scanner, telephone, cellular
telephone, pager, personal communications device, transponder, receiver,
radio, modem or device that enables the use of a modem.
HARASS/HARASSMENT
To engage in a course of conduct that serves no legitimate
purpose and would cause a reasonable person to suffer significant
emotional distress and shall actually cause significant emotional
distress, or when the course of conduct consists of contact by a person
over the age of eighteen (18) years with a person under the age of
eighteen (18) years that would cause a reasonable parent to fear for
the safety or well-being of their minor child who is the target of
the contact.
