A. Public
Fireworks Display.
1. Permit Required. Public displays of fireworks shall require a separate
permit. Applications for public displays shall cost twenty-five dollars
($25.00) and only after the approval by the Board of Aldermen, proper
inspection by the Fire Chief and proof of insurance to satisfy claims
of property damage or personal injury arising out of any act or omission
on the part of the applicant, or agent or employee thereof.
2. Displays By Certain Entities Require Proof Of Financial Responsibility.
Permits for public displays for fireworks may be granted by the City
to fair associations, organizations or firms upon application and
approval by the Board of Aldermen. Such permits shall not be issued
until the fair associations, organizations or firms shall furnish
proof of financial responsibility to satisfy claims for damages to
property or personal injuries arising out of any act or omission on
the part of such fair associations, organizations or firms or any
agent or employee thereof.
3. City-Sponsored Displays. The provisions of this Section shall not
be construed to prohibit the presentation of supervised public displays
when ordered by the Mayor or Board of Aldermen to be discharged by
properly qualified individuals.
4. Approval Of Fire Chief Required. Fireworks used in public displays
shall be located, discharged or fired so that in the opinion of the
City Fire Chief, after proper inspection, such display shall not be
hazardous to any person or property.
5. Violations And Penalties. Any person who violates this Section shall be guilty of a misdemeanor and, upon conviction, shall be punishable pursuant to the Section
100.220 of this Code.
B. Time
Of Discharge Of Fireworks By Consumers Restricted. Fireworks may be
discharged by consumers in the City on July 4th of each year between
the hours of 9:30 a.m. and 11:30 p.m.

It shall be unlawful for any person, firm, or corporation within the corporate limits of the City of Seymour to sell, offer for sale or give away, or have in his/her or its possession, custody or control for the purpose of selling or giving away within said City any squib, Roman candle, torpedo, rocket, firecracker, or other combustible fireworks or substance for pyrotechnic display. Provided however, that nothing in this Section contained shall be construed to prohibit the official authorization of pyrotechnic display referred to in Section
210.2310. Provided further, that nothing in this Article contained shall be construed to prohibit the possession, sale, custody or control of the above-named articles by wholesale dealers inside or outside of this City.
