Editor's Note: This local law was subject to a permissive referendum. Since no valid petition requesting such referendum was filed, this local law was deemed duly adopted on 11-24-1995, in accordance with the applicable provisions of law.
The Clayton Fire Protection District, encompassing all of the property located within the Town of Clayton outside of the corporate limits of the Village of Clayton, and outside the limits of the Depauville Fire District, is hereby dissolved and discontinued as of 12:00 midnight on December 31, 1995, pursuant to the provisions of §§ 185 and 189-c of the Town Law.[1]

The Depauville Fire District, located within the Town of Clayton, Jefferson County, New York, is hereby dissolved and discontinued as of 12:00 midnight, December 31, 1995, pursuant to the provisions of §§ 185 and 189-c of the Town Law of the State of New York.[1]

All property of the Depauville Fire District not disposed of prior to the effective date of the dissolution shall be sold at public sale and the proceeds thereof shall be paid to the Supervisor of the Town of Clayton to be applied first in payment of any bonded or other indebtedness which may remain against the Depauville Fire District following the dissolution thereof, and any balance thereof shall be a credit to the taxable real property located within the Depauville Fire District in the next succeeding assessment of Town taxes following such dissolution. If there shall remain any outstanding indebtedness or unpaid bonds or other obligations not then due and payable, a sum sufficient to meet the principal and interest thereof shall be set apart from the sale proceeds as a sinking fund for the redemption of such outstanding obligations at their maturity and the payment of the interest thereon. If the proceeds of such sale and the income therefrom shall be insufficient to redeem such bonds or obligations at their maturity and to pay the interest thereon, there shall be levied and collected in annual installments from the Depauville Fire District such a sum as will be sufficient to pay the interest on such bonds or obligations and to redeem the same at maturity.
