This article shall be known and may be cited as the "Snow Removal
Ordinance."
As used in this article, the following terms shall have the
meanings indicated:
PRIVATE ROADWAY
Any street, highway or road that is open to the public as
a matter of right or custom, or is used as a means of ingress or egress
to a housing development or similar complex, or any portions thereof,
but which is not owned or maintained by either the Township of Carroll
or the Commonwealth of Pennsylvania.
SIDEWALK
Any improved pavement or part thereof fronting or alongside
of a street or highway, or within the curbline and the property line
of said street or highway, or between the property line and the vehicular
driveway; any unimproved or ground surface area or part thereof fronting
or along side of a street or highway and located within the curbline
and the property line, or between the property line and the vehicular
driveway, if such area is used or usable as a walkway by the general
public.
SNOW
Any snow, ice, slush, or any combination thereof, that has
fallen, formed, or accumulated on the ground.
Any owner, occupant, tenant, or any person who removes snow
from a private roadway, within the Township of Carroll, shall not
place the same snow on any public street, road, highway, or thoroughfare
when removing such snow, whether or not the public street, road, highway,
or thoroughfare had been plowed or cleared for the purpose of allowing
free and safe passage of vehicular traffic.
In any case where the owner, occupant, tenant or person as aforesaid, shall fail, neglect, or refuse to comply with any of the provisions in this article or within the time limit prescribed therein, the Township of Carroll may, in its discretion, proceed immediately to remove the snow from the sidewalk of owner, occupant, tenant or person, and to collect the expenses thereof, with any additional amount allowed by law, from such owner, occupant, tenant or person which may be in addition to any fine or penalty imposed under §
334-25 of this article. Such expenses shall be added to any penalty, fine or costs as restitution payable to the Township of Carroll.

Any owner, occupant, tenant or person who violates any section of this article shall pay a fine or penalty of not less than $25 nor more than $600 for violation of §
334-21 or not less than $75 nor more than $600 for violation of §
334-22, plus court costs. Such fine or penalty and costs may be in addition to any expenses and additional amounts authorized by law, imposed as provided under other sections of this article. If the Township of Carroll removes the snow under §
334-23 of this article, the cost of such removal shall be added as restitution to any fine imposed. Each offense and each day of a continuing offense shall be considered a separate violation of this article.
