A. 
Purpose. It is the purpose of this section to provide for the recovery of costs from the users of the City's POTW for the development and implementation of the program established herein. Users shall pay their proportionate share of operation and maintenance costs, including replacement costs of the treatment works within a service area. Any costs for operation and maintenance for all flow not directly attributable to users shall be distributed proportionately among all users of the recipient's treatment works. The applicable charges or fees shall be set forth in the SOP, to be revised from time to time, by the Superintendent and approved by the Wastewater Commission.

B. 
Pretreatment program charges and fees. User charges shall generate sufficient revenue to pay costs of operation and maintenance of treatment work, replacement of equipment, debt service costs, including debt service reserves and debt coverage requirements.

(1) 
Fees. Fees shall be based on actual or estimated use unless an exception applies pursuant to § 281.58(14)(b)7, Wis. Stats.
(a) 
Wastewater discharge permit processing fee. The City will charge significant industries a wastewater discharge permit fee to cover the costs of processing the wastewater discharge permit applications.
(b) 
Administrative fee. This will cover the cost of general administration of the Pretreatment Program, which will be assessed to all significant users.
(c) 
Sampling fee. This will cover the cost of administration of the sampling and laboratory analysis portions of the Pretreatment Program and will be based on the number of sampling days and parameters required by the City to monitor the significant users, or other users as determined to be necessary by the Superintendent.
(d) 
Surcharge fee. A charge in addition to the basic quantity flow charge shall be levied to any user for wastes which are found to be in excess of domestic or sanitary wastewater concentration for BOD, TSS, or phosphorus. Users discharging wastes in excess of domestic wastewater concentration for BOD, TSS, or phosphorus may be required to perform self-monitoring testing and/or flow metering on a schedule established by the Superintendent.
C. 
Septage sludge, holding tank, wastewater, contaminated groundwater and leachate chargers and fees. Persons with a permit for disposal of septic tank sludge and/or holding tank sewage, leachate or contaminated groundwater into the wastewater collection and treatment facilities shall be charged fees as established from time to time by the Wastewater Commission.

The Superintendent shall establish a financial management system that accounts for revenue generated, costs of operation and maintenance of the treatment work, including replacement of equipment, and debt service costs, including debt service reserves, and debt coverage requirements.
B. 
The Superintendent shall complete a review, at least biannually, of the wastewater contribution of users and user classes, the total costs of operation and maintenance of the treatment works and the user charge system.
C. 
The Superintendent shall notify each user, at least annually and in conjunction with a regular bill, the rate of charge attributable to service provided.
D. 
The Superintendent shall establish a replacement fund and make deposits to this fund on an annual basis. The replacement fund shall be utilized pursuant to § NR 162.08(3)(d), Wis. Adm. Code.
A. 
Severability. If any provision of this chapter is invalidated by any court of competent jurisdiction, the remaining provisions shall not be effected and shall continue in full force and effect.
This chapter shall be in full force and effect immediately following its passage, approval, and publication, as provided by law.
