Recognizing that certain uses, activities and
structures are necessary to serve the needs and provide for the convenience
of the citizens of the Borough and at the same time, appreciating
the fact that they or any one of them may be or may become inimical
to the public health, safety and general welfare of the community
if located without due consideration to the existing conditions and
surroundings, such uses are designated as conditional uses subject
to the standards and regulations hereby established. These standards
and regulations are intended to provide the Planning Board with a
guide for reviewing applications for conditional uses as provided
for by this chapter. As a result of the review procedure, the applicant
may be required to meet additional standards and regulations imposed
by the Planning Board during site plan review which are in keeping
with and will further the intent of these standards and regulations.
Such standards and regulations shall be provided for and maintained
as a condition of the establishment and maintenance of any use to
which they are a condition of approval. In acting upon an application
for conditional use approval, the Planning Board shall be guided by
the following standards and principles:
A. The use for which an application is being made is
specifically listed as a conditional use within the zone where the
property is located.
B. The design, arrangement and nature of the particular
use is such that the public health, safety and welfare will be protected
and reasonable consideration is afforded to the following:
1. The compatibility of the proposed use(s) and/or structure(s)
within the existing neighborhood.
2. The potential effect that the proposed use(s) and/or
structure(s) will have upon property values.
3. The adequacy of the proposed parking and traffic circulation
for the use(s) and/or structure(s) and the potential for traffic congestion
and/or the creation of undue traffic hazards.
4. The need for such facility or use(s) to serve the
area in which it is to be located.
5. The adequacy of proposed drainage facilities which
will serve the use(s) and/or the structure(s).
6. The adequacy of plans for screening any adverse aspects
of the use(s) and/or structure(s) from adjoining properties.
7. The adequacy of proposed outdoor lighting.
8. Compliance with the standards, principles and objectives
of the Master Plan.
C. All conditional uses shall also be required to obtain
site plan approval, unless otherwise specified in this chapter.
D. Conditional uses shall adhere to the additional standards
specified for the particular use under this Article except where no
additional standards are specified herein.
E. No use specified within this Article shall be considered
a conditional use unless it is specifically listed as a conditional
use in the zone district regulations.
Churches and places of worship may be permitted
as a conditional use in those zones specified provided that the use
and/or structures shall adhere to the minimum standards of the particular
zone and the following:
A. The minimum lot area shall be two acres.
B. The minimum lot width shall be 200 feet.
C. No principal building shall be located closer than
50 feet to any side or rear property line.
D. No accessory building shall be located closer than
30 feet to any side or rear residential property line.
E. Maximum lot coverage - 15%.
F. The height of structures to be constructed may exceed
the maximum height requirements of this chapter, provided, however,
that the front, rear and side yard requirements set forth above shall
be increased by two feet for each foot by which the height of the
structure exceeds the maximum height which would be otherwise permitted
by this chapter, and further provided that in no case shall any proposed
structure exceed 50 feet in height.
Public utility uses, such as water towers, pumping
stations, electric substations, radio towers, transmission lines,
switching stations, which must be provided above ground, may be permitted
as a conditional use in those zones specified provided that the use
and/or structures shall adhere to the minimum standards of the particular
zone and the following:
A. A statement is submitted setting forth the reasons
that the proposed installation must be provided above ground in a
specific location and why it is necessary and convenient for the efficiency
of the public utility system or for the satisfactory and convenient
provision of service by the utility to the neighborhood or area in
which the particular use is to be located.
B. The design of any building in connection with such
facility conforms to the general character of the area and will not
adversely affect the safe and comfortable enjoyment of property rights
of the zone in which it is located.
C. Adequate and attractive fences and other safety devices
will be provided.
D. Sufficient landscaping including shrubs, trees and
lawn are provided and will be periodically maintained.
E. The public utility use and lot meet all the applicable
minimum requirements of the district in which it is located, except
that it need not have the minimum required lot area.
F. Any public utility that includes small wind energy systems and/or solar energy system shall be in accordance with Subsection
30-5.32 of this chapter.

Public and private schools may be permitted
as a conditional use in those zones specified provided that the use
and/or structures shall adhere to the minimum standards of the particular
zone and the following:
A. A statement setting forth full particulars on the
building and/or use is submitted.
B. The lot upon which such use is proposed shall conform
to the following standards and requirements:
1. Minimum lot area: five acres.
2. Minimum front yard setback: 100 feet.
3. Minimum side and rear yard setbacks: 50 feet.
4. Maximum lot coverage: 10%.
C. Accessory buildings shall not be located closer than
30 feet to any residential property line.
D. The proposed use shall in no way be detrimental to
the surrounding property values, and the structure or use proposed
shall serve a useful purpose in the Borough and otherwise promote
the general welfare of its residents.
Marinas may be permitted as a conditional use
in those zones specified provided that the use and/or structures shall
adhere to the minimum standards of the particular zone and the following:
A. No principal or accessory building shall be located
closer than 50 feet to any street line or 25 feet to other property
lines, except that buildings for boat repair or maintenance shall
not be located closer than 50 feet to any property line.
B. Boats shall not be stored or displayed closer than
35 feet to any street line or 20 feet to any other property line.
C. No railway or other launching facility shall be located
closer than 20 feet to any property line.
D. Adequate utilities shall be supplied to each boat
slip including electricity, lighting and water supply.
Private yacht clubs, private beach clubs and
other similar activities may be permitted as a conditional use in
those zones specified provided that the use and/or structures shall
adhere to the minimum standards of the particular zone and the following:
A. Swimming pools shall be subject to the provisions of Section
30-8.8 of this chapter.
B. Minimum lot area - five acres.
C. Maximum lot coverage by buildings and structures (including
swimming pools) - 20% of the lot area.
D. No building, structure, recreation area or parking
area shall be located closer than 50 feet to a residential property
line.
E. The maximum membership limit of said organization
shall be fixed at the time of application and shall be commensurate
with the amount of land to be used and the exact nature of the use.
No further expansion of said membership shall be made unless additional
land is acquired and supplemental application is made to the Planning
Board.
F. Off-street parking requirements shall be determined by the Planning Board, except that where swimming pools are provided, the off-street parking requirements shall be not less than the requirements under Section
30-8.8C, plus such additional parking as may be deemed necessary by the Planning Board.
Professional office buildings may be permitted
as a conditional use in the A-2 High Rise Residential Zone provided
that the use and/or structures shall adhere to the minimum standards
of the A-2 High Rise Residential Zone and the following:
A. Minimum lot area - 40,000 square feet.
B. Minimum lot width - 150 feet.
C. Minimum front yard setback - 50 feet.
D. Minimum rear yard setback - 30 feet.
E. Minimum side yard setback - 15 feet.
F. Maximum building height - four stories but not more
than 50 feet.
Child care centers for infants and children
shall be permitted only upon receipt of a conditional use permit and
provided that the following standards are met together with any other
requirement deemed necessary by the approving authority to ensure
that the health, safety and welfare of the children are protected
and maintained:
A. Child care centers shall be licensed by the New Jersey
Department of Human Services in accordance with N.J.S.A. 40:55D-66.4
and 66.5.
B. Child care centers shall be incorporated into a principal
use structure.
C. Parking shall be provided in accordance with the provisions of Section
30-8.21 of this chapter. Pick up/drop-off areas shall be provided which will provide for safety for children exiting and entering vehicles for queuing of vehicles.
D. Outdoor recreation space, tot lot equipment and play
areas shall be fenced and landscaped.
E. Child care centers shall be screened from adjacent residential uses or zones in accordance with the provisions of Section
30-8.4B of this chapter.

Automotive gasoline station mini marts shall only be permitted
as a conditional use in the B-2 (Business-Special) Zone District in
accordance with the following standards:
A. An automotive gasoline station mini mart shall have frontage on NJ
Route 36 and Riverdale Avenue.
B. Minimum principal building setback from adjacent properties: 100
feet.
C. Minimum landscaped buffer to adjacent properties: 25 feet.
D. The site shall be screened by a six-foot-high board-on-board or vinyl
fence on all sides not fronting on a public right-of-way. This fence
shall not extend into the required sight triangle for any access drive
on-site, or on adjacent sites. This fence may be incorporated into
a required landscaped buffer.
E. Parking shall conform to the requirements of Subsection
30-8.21.
F. A solid waste enclosure area shall be provided. The enclosed area
shall be so designed that solid waste shall not be seen from a public
street or from adjoining property.
G. Waste receptacles for use by the public shall be provided adjacent
to parking areas.
H. Outdoor storage of merchandise shall be prohibited.
I. Drive-through windows shall be prohibited.
J. The sale, rental or storage of cars, trucks, trailers, boats or any
other vehicles shall be prohibited.
K. Maintenance and service of cars, trucks, trailers, boats or any other
vehicles shall be prohibited.
