The following definitions shall apply to this article:
WASTE
Any garbage, refuse, trash, debris or other discarded substances
and materials, including wood, plaster, metals, asphaltic substances,
bricks, block, unsegregated concrete and dredging waste.
No person shall use or permit to be used any property or portion
of property within the Township for the filling of land, dumping or
burying of any waste, whether generated within the Township or elsewhere.
This prohibition shall not apply to waste which, pursuant to applicable
laws and regulations of the United States of America or Commonwealth
of Pennsylvania, is of such a nature that it may lawfully be used
as fill, dumped or buried; provided, however, that such filling, dumping
or burying is in accordance with the applicable laws and regulations.

Any person, firm or corporation who shall violate any provision of this article, upon conviction thereof in an action brought before a Magisterial District Judge in the manner provided for the enforcement of summary offenses under the Pennsylvania Rules of Criminal Procedure, shall be sentenced to pay a fine of not more than $1,000 plus costs and, in default of payment of said fine and costs, to a term of imprisonment not to exceed 90 days. Each day that a violation of this article continues or each section of this article which shall be found to have been violated shall constitute a separate offense. In addition to the remedies set forth in this article, any continued
violation of this article shall constitute a nuisance and may be abated
by proceedings against the violator by appropriate equitable action
in the Court of Common Pleas.
