It is the purpose of this article to preserve and promote the
character and appearance and conserve the property values of the Village,
the attractiveness of whose residential area is one of the economic
mainstays of the community; and to that end, it has been found necessary
to regulate the parking of commercial vehicles on streets and in or
about dwellings.
It shall be unlawful for a person, driver or an operator to
park a truck or other commercial vehicles or equipment for hire, including
a taxicab, in or upon any street, road or alley within the Village
of Malverne during the hours of each day for more than four consecutive
hours; except, however, that this section shall not apply to nor prohibit
the stopping, standing or parking of fire-fighting equipment and vehicles
or emergency vehicles, or public utilities and contractors while engaged
in the repair, maintenance or construction of streets or street utilities
within the Village, or contractors providing services to a resident
or merchant.
No commercial vehicle shall be permitted to be kept or parked
on an open lot or in any front, side or rear yard or driveway or upon
any open area in or about a dwelling except temporarily while providing
services to a dwelling. Nothing in this section shall prohibit the
parking by an owner or occupant of a noncommercial motor vehicle in
the driveway of a dwelling.
For the purpose of this article, the following terms shall have
the meanings indicated:
COMMERCIAL VEHICLE
A.
Includes every type of motor-driven vehicle:
(1)
Ordinarily used for commercial purposes, whether or not registered
as a commercial vehicle;
(2)
Having a gross weight in excess of 18,000 pounds; or
(3)
Having a length in excess of 30 feet.
B.
A van with commercial plates shall not be considered a "commercial
vehicle" within the meaning of the foregoing definition if no lettering
or advertising or equipment is visible from the exterior thereof.
Any persons, associations or corporations which or who violate
the provisions of this article, upon conviction, shall be fined not
less than $50 nor more than $300 for each violation. A summons issued
for violation of this article by a police officer or code enforcement
officer shall be returnable in the Malverne Village Court.
