As used in this chapter, the following term shall have the meaning indicated:
TEMPORARY STORAGE CONTAINER DUMPSTER
An outdoor unit commonly referred to as a "dumpster," "pod," "temporary garage," "soft-side storage unit" or similar unit used to store home furnishings and/or personal items on a temporary basis during a time of home repair, construction, renovation or relocation.
A. 
No person shall place upon any property in the Borough of Upper Saddle River a temporary storage unit/dumpster unless the owner of the property has obtained a temporary storage unit/dumpster permit from the Building Department or Zoning Department.
B. 
Application for such temporary storage unit/dumpster shall be in writing on a form provided by the Borough and shall be presented to the Building Department or Zoning Department.
C. 
Temporary storage units shall not exceed 160 square feet in foot print and a dumpster may have a storage capacity not greater than 40 cubic yards.
D. 
The temporary storage unit/dumpster shall be placed on the driveway or on alternative approved location as directed by the Borough Building Department or Zoning Department.
E. 
The application shall be submitted to the Borough Building Department or Zoning Department, which shall review the application for completeness and issue said permit.
F. 
The temporary storage unit/dumpster shall be temporary in nature, and no temporary storage unit/dumpster shall be placed or remain on the same premises more than 120 days cumulatively in a calendar year. The start date of the time period shall be the date of delivery, as shown on the delivery ticket, which must be supplied to the Building Department or Zoning Department Officer upon request.
G. 
An initial temporary storage unit or dumpster permit shall be issued for 60 days, provided however, that two extensions of up to 30 days for each extension of the permit may be granted. No more than two extensions may be granted. Any application for an extension shall be required to be submitted at least 14 days prior to the expiration of the initial permit or of the first extension.
H. 
No more than one temporary storage unit/dumpster may be placed upon any single residential property at one time.
I. 
A temporary storage unit/dumpster may be attached to a valid construction permit and shall expire 120 days after the issuance of a temporary certificate of occupancy.
The permit application and review fee shall be $50 for the initial temporary storage unit/dumpster permit and $25 for each extension not to exceed two extensions.
A. 
The Police Department, Construction Official, Zoning Enforcement Officer or their duly authorized designated persons are hereby authorized as enforcement officers of this article.
B. 
It shall be the responsibility of the Borough Construction Official or Zoning Officer to issue temporary storage unit permits.
Any person convicted of violating the provisions of this chapter shall be subject to such fines and penalties as set forth in Section 1-15 of the Borough Code. Each and every day on which a violation of any provision of this chapter occurs shall constitute a separate violation.
