1. Any drain or conveyance, whether on the surface or subsurface, that
allows any nonstormwater discharge, including sewage, process wastewater,
and wash water, to enter the waters of the commonwealth is prohibited.
2. No person shall allow, or cause to allow, discharges into surface
waters of this commonwealth which are not composed entirely of stormwater,
except:
A. As provided in Subsection
3 below; and
B. Discharges allowed under a state or federal permit.
3. The following discharges are authorized unless they are determined
to be significant contributors to pollution to the waters of the commonwealth:
A. Discharges from firefighting activities;
B. Potable water sources, including water line flushing;
D. Air-conditioning condensate;
F. Water from crawl space pumps;
G. Flows from riparian habitats and wetlands;
H. Uncontaminated water from foundations or from footing drains;
J. Dechlorinated swimming pool discharges [per Department of Environmental
Protection (PADEP) requirements];
K. Uncontaminated groundwater;
L. Water from individual residential car washing; and/or
M. Routine external building washdown and pavement washwaters where
spills or leaks of toxic or hazardous materials have not occurred
(unless all spill material has been removed) and where detergents
are not used.
4. In the event that the Borough or PADEP determines that any of the discharges identified in Subsection
3 significantly contribute to pollution of the waters of this commonwealth, the Borough of Hatfield or PADEP will notify the responsible person(s) to cease the discharge.
5. Upon notice provided by the Borough under Subsection
4, the discharger will have a reasonable time, as determined by the Borough, to cease the discharge consistent with the degree of pollution caused by the discharge.
6. Nothing in this section shall affect a discharger's responsibilities
under state law.

1. Roof drains and sump pumps shall discharge to infiltration or vegetative
BMPs and, to the maximum extent practicable, satisfy the criteria
for disconnected impervious areas (DIAs).
2. Roof drains shall not be connected to streets, sanitary or storm sewers or roadside ditches, except as provided in Subsection
3.
3. When the Borough Engineer determines that it is more advantageous
to connect directly to streets or storm sewers, connections of roof
drains to streets or roadside ditches may be permitted by the Borough
of Hatfield.

1. No person shall modify, remove, fill, landscape, or alter any stormwater
management (SWM) best management practices (BMPs), facilities, areas,
or structures unless it is part of a maintenance program approved
by the Borough Engineer and written approval of the Borough has been
obtained in advance.
2. No person shall place any structure, fill, landscaping, or vegetation
into a stormwater facility or BMP or within a drainage easement which
would limit or alter the functioning of the stormwater facility or
BMP without the prior written approval of the Borough.

1. The following connections are prohibited, except as provided in §
26-171, Subsection
3, above:
A. Any drain or conveyance, whether on the surface or subsurface, which
allows any nonstormwater discharge, including sewage, process wastewater,
and washwater, to enter the separate storm sewer system, and any connections
to the storm drain system from indoor drains and sinks.
B. Any drain or conveyance connected from a commercial or industrial
land use to the separate storm sewer system which has not been documented
in plans, maps, or equivalent records and approved by the Borough
of Hatfield.
