A.
It shall be unlawful for any person to smoke in any area where smoking
is prohibited or restricted under this chapter.
B.
Any person found to be in violation of the provisions of this chapter
shall be guilty of a violation and subject to a fine of $250.
C.
Any person found to have violated the provisions of this chapter
twice within a twelve-month period shall be guilty of a violation
and subject to a fine of $500.
D.
Any person found to have violated the provisions of this chapter
three times within a twelve-month period shall be guilty of a Class
A misdemeanor and subject to a fine of up to $750 and a sentence of
up to three months in jail.
This chapter may be enforced by any law enforcement agency having
jurisdiction to act in the City of Auburn.
