A. No person shall possess or set off any
fireworks within the City limits except "consumer fireworks" as that
term is defined in Section 320.106, RSMo., and no person may use or
set off any consumer fireworks except during the time specified by
this Section.
B. Consumer fireworks may be used and set
off within the City limits only on the dates of July 1 to July 6,
inclusive, and only between the hours of 10:00 A.M. and 10:00 P.M.;
except that on July 4 consumer fireworks may be used and set off between
the hours of 10:00 A.M. and Midnight.
C. Anyone who uses or sets off fireworks at
any time shall be responsible for cleaning up and disposing of any
debris which results from the use, setting off or explosion thereof.
D. Any person convicted of possessing or setting
off any firework or fireworks which are classified as something other
than "consumer fireworks" shall be punished by the imposition of a
fine of not more than five hundred dollars ($500.00) or by a sentence
of confinement of not more than ninety (90) days, or by both such
fine and sentence of confinement.
E. Any person convicted of using or setting
off consumer fireworks at any time other than as is permitted by this
Section shall be punished by the imposition of a fine of up to fifty
dollars ($50.00) for the first offense and by the imposition of a
fine of up to two hundred fifty dollars ($250.00) for all subsequent
offenses.
F. Any person convicted of failing to clean
up and/or dispose of any debris resulting from the use, setting off
or explosion of any firework or fireworks shall be sentenced to the
payment of a fine of up to fifty dollars ($50.00) for the first offense
and by the imposition of a fine of up to two hundred fifty dollars
($250.00) for all subsequent offenses.
