All owners of underground utilities shall be responsible for
any and all costs associated with the protection and/or relocation
of their utilities if said utilities interfere with the City's
ability to repair and/or maintain its utilities.
All owners of underground utilities shall be responsible for
any and all costs associated with the repair of any damage done to
any City of Paterson utility caused by the construction and/or relocation
of that company's utility.
All owners of underground utilities shall promptly, when notified
by the City of a conflict, take the necessary steps to protect and/or
relocate their utilities. Failure by the utility owner to act promptly
may result in the City performing the work and having all associated
costs borne by the respective utility owner(s). This shall also include
the costs of any potential relocation of residents caused by such
disturbance.
Failure to comply with the provisions of this article shall
result in a revocation of any construction permit(s) currently in
place for said utility owner, and suspension of the issuance of new
permits, until the matter is addressed to the satisfaction of the
City.
